This paper explores the complexities of the role of the workers' compensation case manager working for claims agents in South Australia. It provides a brief outline of the many skills required by case managers as they deal with the worker's injury, issues of compliance, the legislation, the social and psychological aspects of the worker's claim and the treatment and management of the worker's welfare. It describes the tensions brought about by the dual nature of the case manager's role that encompasses claims processing and injury management, and the conflicts between human and organisational motivations. These findings, although imprecise, demonstrate that in order to achieve sustainable return to work outcomes, case managers need to be competent, well-trained and team players capable of acting as mediators or brokers across the stakeholders. The aim of this paper is to explore the different views of the problems and possibilities of the role of the claims/injury manager from the perspective of the major stakeholders. Some views on the redesign of the role incorporating a partnership and holistic emphasis rather than the claims processing focus are suggested.

The Social Security Organisation (SOCSO) of Malaysia introduced the Return to Work (RTW) Program in 2007 which is a comprehensive multidisciplinary biopsychosocial rehabilitation program for its Insured Persons who are experiencing disability due to accidents in the workplace or those claiming for invalidity. This rehabilitation program is unique as it involves the concept of “disability management” in which each Insured Person who is referred to the program, is assigned to a Disability Case Manager who is actively involved throughout the return to work process. Up to date (December 2013), 11,090 workers were motivated to participate in the SOCSO RTW Programme, and this requires many work processes, countless paper-work and massive physical files and document management. Due to this massive information flow, the demand for a more efficient information system is needed. From the beginning, the whole idea was to create an accessible, quick and user-friendly application. The application is now used by the SOCSO RTW Department in managing their information. This application was built on an open source platform which can be access through the internet. It is also a “learning application” where it uses its historical data to assist the case managers to generate standard rehabilitation plans and forecast possible return to work outcomes. The beauty of such application is that it is easily replicated, configurable (email notifications, reminders, etc) to meet the needs of the case managers in various jurisdiction. The scope of the application can also be easily defined to meet the size of an enterprise using the application. With better management of information, this application has contributed in reducing processing time, repetitive paperwork, minimal storage areas and almost real-time flow of information in the SOCSO's RTW Case Management system. Apart from that, the application now stores a wealth of information such as rehabilitation strategies for various disability or illnesses or demographic backgrounds.

HIV / AIDS has become a phenomenon in the social environment of society for the last few years. Fear of stigma and discrimination from local people makes PLWHAs reluctant to reveal themselves. People with HIV who have revealed themselves must face the risk of discrimination and stigma that must be experienced in everyday life. This study aims to explain interpersonal communication among PLWHA who have done self-disclosure. The method that’s being used is a qualitative approach with case study method. The case study was conducted at ODHA Berhak Sehat Community. The data collection is done by conducting in-depth interviews with informants. Subjects in this study were people living with HIV/AIDS (PLWHA) who had opened their status for some time. In addition interviews were also conducted with specialists in sexually transmitted diseases as a research triangulator. It was found that PLWHA who have revealed status with the closest people cause a sense of trust. PLWHA do not receive discrimination, but rather supportiveness. And, an open - minded attitude from the closest person. Furthermore, the results of the study are discussed in this article.

Adoption processes are often heavily influenced by interpersonal communication. Marketing managers are increasingly trying to use these relationships to foster the market penetration of their products. In an empirical study of the US market for an innovative medical device, we survey the social network of (mostly chief) anesthetists from 151 hospitals. We confirm the influences from personal communication on individual adoption decisions through hazard regressions. We then use a multi-agent modeling framework trying to identify what seeding strategies would have been optimal to achieve a fast market penetration, i.e. which and how many anesthetists should be selected to initiate personal communication processes.

Abstract The central objective of the post-socialist European countries which are also Member States of the EU and Council of Europe, as proclaimed and enshrined in their constitutions before their official independence, is the establishment of a democracy based on the rule of law and effective legal protection of fundamental human rights and freedoms. In this article the author explains what, in his opinion, is the main problem and why these goals are still not sufficiently achieved: the ruthless simplification of the understanding of the social function and functioning of constitutional courts, which is narrow, rigid and holistically focused primarily or exclusively on the question of whether the judges of these courts are “left or right” in purely daily-political sense, and consequently, whether constitutional court decisions are taken (described, understood) as either “left or right” in purely and shallow daily-party-political sense/manner. With nothing else between and no other foundation. The author describes such rhetoric, this kind of superficial labeling/marking, such an approach towards constitutional law-making as a matter of unbearable and unthinking simplicity, and introduces the term A Populist Monster. The reasons that have led to the problem of this kind of populism and its devastating effects on the quality and development of constitutional democracy and the rule of law are analyzed clearly and critically.

Key stakeholders (injured workers, rehabilitation co-ordinators, rehabilitation providers, treating doctors and insurers) in the occupational rehabilitation process were interviewed to gain their perspective concerning the degree to which case management was viewed as the organising principle of post-injury management and to whom this role was most frequently assigned. Findings indicated that there were differences in stakeholder perceptions about who should fill this role for the injured worker, with the majority of each group claiming case management as their proper role. In contrast, 35% of the injured workers interviewed stated that they either did not have a case manager or that they case managed themselves. Although it was argued that rehabilitation co-ordinators are suitably placed to act as case managers, they were nominated least by injured workers. Three vignettes of successful case management were presented and recommendations for policy and practice were made.

Some characteristics of the social behavior of field-dependents as well as their superior recognition of ambiguous social stimuli led to the hypothesis that they would show greater self-disclosure than field-independents. This hypothesis was tested by administering the 60-item Jourard Self-disclosure Questionnaire (JSDQ) to 13 field-dependent and 13 field-independent Ss. In terms of total self-disclosure scores, field-dependents showed significantly (.025) higher levels than field-independents. Results are discussed in light of personality theories which emphasize the role of self-conceptual transactions in the development of the self.

Summary1. State, solidarity and social cohesion. 2. Doctrinal and jurisprudential notes on the principle of non-regressivity of social rights. 3. Limits to the regressivity of social rights. a) Limits derived from international law. b) Limits derived from dignity as essential content of social rights. c) Limits derived from the prohibition of arbitrariness: the need for sufficient motivation. 4. Conclusion: constitutionalamendment and non-regressivity of social rights.Abstract:This paper analyzes the constitutional recognition of the principle of non-regressivity of social rights in Spain. It starts from the succinct analysis of the social model of our Constitution which implies the recognition of economic and social rights. This recognition is the constitutionalization of the principles of solidarity and social cohesion. The principle of social cohesion has been defined by the Council of Europe and explicitly included in the constitutive treaties of the European Union. The need to achieve social cohesion underpins the inclusion in the Constitutions and international treaties of the principle of non-regression of social rights. In the Spanish Constitution of 1978 this principle is not expressly included. The non-inclusion in the Constitution of this principle poses a danger to social cohesion in times of economic crisis. For its part, the Constitutional Court has established an ambiguous doctrine on this subject, which has been analyzed in this work, as well as the most significant doctrinal contributions on the subject. In order to know which are the limits of the regressivity of the social rights that give content of this principle an international comparison has been made as well as a study of constitutional principles. Limits to the regressivity of content, effectiveness and protection of social rights have been obtained from the study of international order and constitutional values and principles. This paper concludes by suggesting a proposal for constitutional amendment that includes the principle of non-regressivity of social rights in the Spanish Constitution establishing some requirements of those measures that imply a regression of their content such as: they shall be fully justified in relationship with all the rights, values and principles contained in the Constitution and in the international treaties signed by the Spanish State and in the context of full exploitation of the maximum resources available; Shall be applied after a more comprehensive examination of all possible alternatives; Shall in any case be of a temporary nature until the economic circumstances permit the restoration of the content, effectiveness, protection and pre-existing guarantee of the social rights affected; In any case they will respect the essential minimum content of social rights as a manifestation of human dignity; Shall be reasonable and sufficiently motivated; Shall not infringe, inter alia, the principles of legal certainty, legitimate expectations, non-discrimination and non-retroactivity of provisions restricting individual rights; Shall be proportionate and shall respect the principles of solidarity, cohesion and social sustainability.
