LABURPENA: Lan honek sortu berri den jurisprudentzia txikia aztertzen du, jakinarazpenak eta aitorpen arduratsuak, herritarren jardueran Administrazioaren esku-hartzeko bitarteko arrunt gisa, ondo ezagutzeko; bereziki, hirigintzako arlora begiratuko dugu. Zalantza guztiak konpondu nahi dira, adibidez, mota honetako teknikak aurkeztutakoan edo, hala badagokio, aurkezpenik egin ezean. Halaber, aztertzen da jurisprudentzia baketsua ekintza irregularrak gelditzeko behin behineko neurriarekin lotuta. ABSTRACT: This work analyzes the most recent minor jurisprudence in the field of responsible communications and declarations, as an ordinary means of administrative intervention in civic activity and especially with regard to urban planning. The aim is to clarify some doubts raised regarding the procedure to follow in the case of the submission of this type of techniques or, as the case may be, in the case of no submission; we also analyze the peaceful jurisprudence in relation to the precautionary measure to stay of the irregular action. RESUMEN: Este trabajo analiza la jurisprudencia menor más reciente en el ámbito de las comunicaciones y declaraciones responsables, como medio ordinario de intervención administrativa en la actividad ciudadana y especialmente en lo que respecta al ámbito urbanístico. Se busca despejar algunas dudas surgidas en relación con la tramitación a seguir ante la presentación de este tipo de técnicas o, en su caso, ante su falta de presentación, así como analizar la jurisprudencia pacífica en relación con la medida cautelar de paralización de la actuación irregular.

This article has two purposes. The first is to show how one can know in a simple way what is an ordinary and obligatory means to care for a person with a serious illness. Using the information at hand, one must be able to answer yes to each of these three questions: “Is this the ordinary, usual, or valid way of treating this illness?” “Is it working?” “Is it within the capacity of the patient to undergo and of the caregivers to administer?” The second purpose of the article is to show the moral validity of these questions, using a historical overview of theological and magisterial teaching and a systematic analysis and moral testing of the three questions.

This paper will examine the nature of the Eucharist as a “sacrament of peace”, a sacrament by which the Christian believer is reconciled to Christ and the Church. While, properly-speaking, the Sacrament of Reconciliation is the ordinary means of this activity, one sees that the Eucharist provides a healing balm for sin, enflames the soul with the fire of charity, and reveals itself as both a symbol of peace already realized and a sign of peace yet to come. This “sacrament of peace” bestows God’s peace to the Church, which, in turn, commissions the Christian to embody this peace through works of mercy and initiatives of justice. Through this, we see the social and missional implications for a community centered around the Eucharistic table. Helpful to this investigation will be the Eucharistic theology of the late Orthodox theologian, Alexander Schmemann and Pope Emeritus Benedict XVI.

Manumissio servi dotalis and the Protection of Dowry in Roman LawSummaryAs opposed to a widespread opinion, examination of legal sources shows, the Roman law neither prohibited manumissio servi dotalis, nor it required wife’s consent. It does not mean, dowry could be freely reduced by means of manumissio. Value of the dowry was still protected by the rules of subrogation, applicable to all the assets acquired by husband iure patroni. However, subrogation did not apply to assets received by husband from his libertinus and exceeding what was required by the rules of patronage. Manumissio, to which wife opposed was perfectly valid in law, however it was not praised. In such a case, income from the patronage was acquired directly by wife and only the surplus was subject to subrogation as a dowry.Sources consider as a manumissio servi dotalis also those situations, in which, the manumitted slave was, strictly speaking, no longer part of the dowry. In such a cases where was no subrogation of course. There were two types of such a situation. The first concerned dotis aestimatio, with which dowry ceased to form a distinct patrimony and became only a husband’s debt, due to wife with the end of marriage. In such a case there was no place for subrogation. Wife’s dowry interest was protected only by the prohibition of manumissiones in case of husband’s insolvency. This however was ordinary means of protecting all creditor against fraus creditorum not a specific solution for servus dotalis. The second type of such a situation rose when wife consented to exclude a slave out of the dowry. Similarly, the slave was no longer part of dowry and all the advantages received from him by husband as a patron were his personal. In this case dowry was indeed diminished, nevertheless wife approved it.

Roy Gigengack (2017a en b) heeft veel waardering voor het boek Doing Qualitative Research: The Craft of Naturalistic Inquiry van Joost Beuving en Geert de Vries (2015). Maar hij heeft ook kritiek. Een van die kritieken is dat de auteurs ten onrechte alle vormen van kwalitatief onderzoek naturalistisch noemen. Deze kritiek is terecht. In het boek van Beuving & De Vries staat: ‘Naturalistic research is qualitative research by ordinary means into everyday situations, aiming to disturb these situations as little as possible. (…) As a craft, naturalistic inquiry may be considered the artisanal core of qualitative research and hence of ethnography and all the other varieties of qualitative research’ (p. 19). Gewone middelen zijn onder meer: kijken, praten, luisteren, samen eten, uitgaan en ook verzamelen van documenten, maar dan alleen bestaande documenten (extant of existing documents), denk ik. Zo weinig mogelijk verstoren houdt immers in dat de onderzoeker geen documenten laat maken speciaal voor het onderzoek; dus geen uitgelokte documenten (elicited of solicited documents). In naturalistisch onderzoek past geen manipulatie. Een naturalistisch onderzoek is ‘an unobtrusive strategy’ (p. 16).

Abstract: The article explores the ideas of Annemarie Schimmel relating to aspects of feminism in Sufism. According to Schimmel, that Sufism, or mystical Islam is the awareness of a single reality and love of the Absolute, because the forces that separate the true mystic by asceticism is love. Even true love can make enjoyment of all that painful. Mystical considered a mysterious thing that can not be achieved by ordinary means or by intellectual effort. While the literature and difficult spiritual life depicted as blind men touching an elephant, in pengambaraannya will say according to the elephant body parts are touched. While the nature of feminine in Sufism has been revealed as to uncover the elements of womanhood is in Sufism itself, like having love, affection, obedient, patient, prejudiced either (ḥusnu ẓan), and willing to sacrifice. From here it turns keperempuan nature not only possessed by women alone, but is owned by the Sufis men. Abstrak: Artikel ini akan mengeksplorasi pemikiran Annemarie Schimmel yang berkaitan dengan aspek feminisme (keperempuan) dalam tasawuf. Dalam pandangan Schimmel, bahwa tasawuf atau mistik Islam merupakan kesadaran terhadap kenyataan tunggal dan cinta Yang Mutlak, sebab kekuatan yang memisahkan antara mistik sejati dengan hanya sekedar tapa brata (asceticism) adalah cinta. Bahkan cinta sejati dapat menjadikan kenikmatan terhadap segala yang menyakitkan. Mistik dianggap sebagai hal yang misterius yang tidak dapat dicapai dengan cara-cara biasa atau dengan usaha intelektual. Sedangkan literature dan kehidupan rohaninya sulit digambarkan sebagaimana orang buta yang menyentuh gajah, dalam pengambaraannya akan mengatakan sesuai dengan bagian tubuh gajah yang disentuhnya. Sedangkan sifat keperempuan (feminin) dalam tasawuf telah terungkap sebagaimana mengungkap unsur-unsur kewanitaan yang ada dalam tasawuf itu sendiri, seperti memiliki cinta, kasih sayang, taat, sabar, berprasangka baik (ḥusnu ẓan), dan rela berkorban. Dari sini ternyata sifat keperempuan tidak hanya dimiliki oleh perempuan saja, tetapi dimiliki oleh para sufi laki-laki. Keywords: feminism, tasawuf, asketicisme, Jalāl, dan Jamāl.

This chapter explore how the growing Hispanic presence makes the ramifications of moral and social issues more imminent in numerous parishes. In this context, Catholic teachings such as those on justice and civic responsibility are more salient when embodied in local organizing initiatives that enable grassroots people to address community concerns and participate in the decision-making processes affecting them and their families. Arguably, the most significant contribution Latino Catholics make to public Catholicism is the various ways they reveal that the sometimes-harsh realities of everyday pastoral work are the ordinary means through which the church lives out its mission to transform lives, communities, and society.
