A society satisfying Rawls’s principles would satisfy its dependency needs better than our society does today, but justice as fairness fails to appreciate the full array of issues of justice dependency raises. It does not recognize failure of noncooperating members of society to receive caregiving as an injustice; it does not recognize systematic disadvantage to caregivers as unjust; and it does not recognize as unjust when society’s basic arrangements render some unable to provide or procure the caregiving their dependents require. A just society is compliant with principles of justice in caregiving. Such principles can be presented in a Rawlsian way—as those chosen in a suitably designed initial situation, and as part of a political conception of justice in Rawls’s terms. This feminist political constructivism concedes as much to the dependency critique as it defends in Rawls, and is responsive to antiracist criticism of Rawlsian ideal theory.

In the article its author has attempted to systematize various concepts and ways of approaching the issue of security by representatives of political constructivism. Constructivism is a relatively young concept, which emerged as an alternative to liberalism and political realism. The article presents the main assumptions of the constructivist vision of security, the approach to security by representatives of conventional and critical constructivism, as well as the concept of ontological security developed by constructivists.

AbstractIn spite of its dominance, there are well-known problems with Rawls’s method of reflective equilibrium (MRE), as a method of justification in meta-ethics. One issue in particular has preoccupied commentators, namely, the capacity of this method to provide a convincing account of the objectivity of our moral beliefs. Call this the Lack-of-Objectivity Charge. One aim of this article is to examine the charge within the context of Rawls’s later philosophy, and I claim that the lack-of-objectivity charge remains unanswered. A second aim of this article is to examine the extent to which, despite Rawls’s express intention to avoid reliance on Kant’s moral philosophy, supplementing Rawls’s political constructivism with some Kantian elements, in particular Kant’s idea of a universal principle of right, not only addresses some of the issues raised by the lack-of-objectivity charge, but also does so without compromising the ability of the Rawlsian account to accommodate the pluralism of conceptions of the good, which he takes to be a fact of modern democracies. I argue for a revised justificatory methodology, which combines Rawls’s MRE and Kant’s Critical Method.

AbstractIn this article I argue that G.A. Cohen is mistaken in his belief that the concept of justice needs to be rescued from constructivist theorists of justice. In doing so, I rely on insights of John Rawls’ later work Political Liberalism and Rainer Forst’s discourse theory of justice. Such critical engagement with Cohen’s critique of constructivism is needed, because Cohen bases his critique of constructivism almost exclusively on Rawls’s arguments and positions in A Theory of Justice. He thus neglects - at least by and large - that Rawls had further developed his constructivist method of justification in his later work Political Liberalism, as well as that Forst’s discourse-theoretical works offer elaborate versions of constructivism. These refined versions of constructivism recognize a plurality of reasonable conceptions of ideal justice and draw an important distinction between moral and political constructivism. Because of these features these advanced constructivist theories are not in need of Cohen’s rescue.

Nosso método de trabalho envolve uma leitura analítica do texto e de comentadores pertinentes ao assunto proposto.ABSTRACT: This study aims to objective analyze the political constructivism of the Third Conference of the work Political Liberalism, by John Rawls. Specifically, we understand how limiting the universe of construction to the parameters by the political discourse, we can extend the reach of the principles agreed in the original position to a much larger universe in the face of comprehensive moral doctrines. We demonstrate what political constructivism no consistent as opposed to utilitarian moral intuitionism or the Kantian moral constructivism, but as capable of absorbing models with this degree of reasonableness. This will be provided through a public justification of both the content and form of the model adopted. Thus, the overlapping consensus presented by Rawls is directly responsible for the democratic results we expect from a society where democracy takes up space as a fact and has a value accepted as legitimate. KEYWORDS: Constructivism; justification; liberalism.
