THE BARBARIES LEGALIZATION: labor reform and new labor relations in BrazilLA LEGALIZACIÓN DE LAS BARBARÍAS: reforma laboral y nuevas relaciones laborales en BrasilRESUMOEste artigo discute as principais mudanças na legislação trabalhista brasileira a partir da entrada em vigor da Lei N°13.467/2017, denominada de reforma trabalhista. Considera essa alteração legislativa como resposta da classe hegemônica brasileira às mudanças estruturais no capitalismo globalizado no bojo da denominada reestruturação produtiva [caracterizada pela ascensão do neoliberalismo e pela substituição do fordismo pelo modelo de acumulação flexível]. A metodologia utilizada constituiu-se em pesquisa bibliográfica e consulta a bases de institucionais [PNAD-contínua e CAGED]. Conclui que a reforma trabalhista tem se configurado num mecanismo de precarização do trabalho no Brasil, caracterizado pelo crescimento do trabalho intermitente, da informalidade e da subutilização, além de restringir o acesso à justiça do trabalho.Palavras-chave: Trabalho; Neoliberalismo; Precarização.ABSTRACTThis article discusses the main changes in Brazilian labor legislation from the entry into force of Law No. 13,467/2017, called labor reform. It considers this legislative change as a response from the Brazilian ruling class to the structural changes in globalized capitalism within the so-called productive restructuring (characterized by the rise of neoliberalism and the replacement of Fordism by the flexible accumulation model). The methodology utilized consisted of bibliographic research and consultation of institutional bases [PNAD-continuous and CAGED]. It concludes that the labor reform has been configured in a mechanism of work precariousness in Brazil, characterized by the growth of intermittent work, informality and underutilization, in addition to restricting access to labor justice.Keywords: Work; Neoliberalism; Precariousness.RESUMENÉste artículo argumenta los principales cambios en la legislación laboral desde la entrada en vigor de Ley N°13.467/2017, denominada reforma laboral. Purpose: Modeling intermittent work capacity is an exciting development to the critical power model with many possible applications across elite sport. With the Skiba 2 model validated using subelite participants, an adjustment to the model’s recovery rate has been proposed for use in elite cyclists (Bartram adjustment). The team pursuit provides an intermittent supramaximal event with which to validate the modeling of W′ in this population. Methods: Team pursuit data of 6 elite cyclists competing for Australia at a Track World Cup were solved for end W′ values using both the Skiba 2 model and the Bartram adjustment. Each model’s success was evaluated by its ability to approximate end W′ values of 0 kJ, as well as a count of races modeled to within a predetermined error threshold of ±1.840 kJ. Results: On average, using the Skiba 2 model found end W′ values different from zero (P = .007; mean ± 95% confidence limit, –2.7 ± 2.0 kJ), with 3 out of 8 cases ending within the predetermined error threshold. Using the Bartram adjustment on average resulted in end W′ values that were not different from zero (P = .626; mean ± 95% confidence limit, 0.5 ± 2.5 kJ), with 4 out of 8 cases falling within the predetermined error threshold. Conclusions: On average, the Bartram adjustment was an improvement to modeling intermittent work capacity in elite cyclists, with the Skiba 2 model underestimating the rate of W′ recovery. In the specific context of modeling team pursuit races, all models were too variable for effective use; hence, individual recovery rates should be explored beyond population-specific rates.

This study check the effectiveness of the intermittent work as a key method of work of the quality in the quantity by the layout of a plyometric work. The question always remains to find the training methods scientifically validated which lead to improve these qualities. We put forward the hypothesis that the intermittent training by plyometric exercises will improve the football players, aerobic an anaerobic capacities. Twenty football players aged between 18 and 23 years coming from Tissemsilt university team were invited to participate in our study (table1). Our population was spilt up into 2 groups in a random way. An experimental group (EG) and control group (CG). The programme was calibrated on 8 weeks and planned as follow: two weeks of intermittent work 10s/20s, four weeks of intermittent work 30s/30s, two weeks of intermittent work 15s/30s. The frequency of these types of training was 2 sessions/week. The footballers did a physical tests: (SJ; CMJ). The (RSA) test, and the Yo-yo test. The tests were again proposed to the footballers: this allowed us to compare the obtained results between the two tests before and after the training. After eight weeks of training, we recorded a development in the experimental sample in the (MAS), vertical jump (CMJ), and (RSA) tests, while we did not record a significant difference in the vertical jump (SJ) test (p<0.05), As with the control sample, the development was limited to (MAS) and (RSA) only. This study shows the effectiveness of the training programme applied to the experimental sample in the post-tests between the two groups, with the exception of the vertical jump test (SJ), where there was no significant difference.

RESUMO:O presente artigo trata do contrato de trabalho intermitente, regulado pela recente Lei da Reforma Trabalhista no Brasil. A partir das justificativas apresentadas para as modificações legislativas atinentes à matéria, busca-se confrontar os propósitos declarados da lei com as dimensões concretas de sua aplicação, analisando-se a matéria a partir da compreensão do direito do trabalho como elemento protetivo do sujeito trabalhador. Constituída em torno de um ideário com viés liberalizante da economia, o novo regramento do trabalho intermitente revela-se uma expressão de um verdadeiro direito do trabalho de exceção, por meio do qual mecanismos originariamente protetivos ao trabalhador – tais como a própria figura de um contrato de trabalho juridicamente regulado – passam a se constituir como mera expressão de chancela da sua exploração. O artigo passará por uma exposição teórica e conceitual da tese do direito do trabalho de exceção. Em seguida, será abordado o regime jurídico adotado para o contrato de trabalho intermitente no Brasil, para então se propor uma análise crítica da legislação e seus efeitos sobre a subjetividade da classe trabalhadora. ABSTRACT:This paper offers an approach on the intermittent work, ruled by the recent Labor Reform Act in Brazil. By confronting the justification of the legal changes concerning this topic, I try to analyze the declared purposes of the new law under the paradigm of the protective conception of work regulation. The new rules of intermittent work were conceived as an expression of a liberal approach of economics and reveal themselves as a remark of an exceptional Labor Law, by means of which originally protective mechanisms – as the regulated work contract – become a mere expression of the reinforcement of exploitation. The paper begins by theoretically explaining the thesis of exceptional Labor Law. Then, I will expose the legal regime of intermittent contracts in Brazil and propose a critical analysis of the fresh law and its effects on working class subjectivity.

RESUMONo presente estudo, objetivou-se analisar o contrato de trabalho intermitente, nova modalidade contratual introduzida pela Lei 13.467/2017 que surgiu com a proposta de flexibilizar as relações de trabalho, já que inúmeros trabalhadores antes desabrigados pela legislação, agora encontrariam amparo neste dispositivo e finalmente sairiam da informalidade, inclusive reduzindo os índices de desemprego. Porém, verificou-se neste trabalho que a proposta inicial só seria viabilizada com uma maior regulamentação deste tipo contratual eis que da maneira com que foi redigido, possui grandes lacunas e antinomias, gerando graves prejuízos ao trabalhador. Isto implica numa precarização das relações de trabalho, já que não há garantia de remuneração mínima, podendo o trabalhador ficar sem recebimento de qualquer remuneração nos meses em que não prestar serviços, trazendo reflexos negativos para toda a sociedade, pois não saberá se terá ou quanto será seus rendimentos ao final do mês para garantir seu sustento e de sua família. Assim, uma das alternativas, em comparação com o modelo Português, seria a criação de uma garantia contratual anual mínima de carga de trabalho e tempo mínimo de meses para o labor, inclusive devendo alguns deles ser consecutivos, visando maior segurança jurídica e econômica para o trabalhador e para o empregador. PALAVRAS-CHAVE: Contrato de Trabalho Intermitente; Flexibilização; Precarização.  ABSTRACTIn the present study, the purpose of this study was to analyze the intermittent work contract, a new contractual modality introduced by Law 13.467 / 2017, which came about with the proposal to make work relations more flexible, since many workers previously displaced by legislation would now find support in this device. finally they would leave the informality, even reducing the indices of unemployment. However, it was verified in this work that the initial proposal would only be made possible with a greater regulation of this contractual type, since in the manner in which it was drafted, it has great gaps and antinomies, causing serious losses to the worker. This implies a precariousness of labor relations, since there is no guarantee of minimum remuneration, and the worker can not receive any remuneration in the months in which he does not render services, bringing negative repercussions to the whole society, since he will not know if he will have or will be your income at the end of the month to secure your livelihood and your family's. Thus, one of the alternatives, in comparison to the Portuguese model, would be the creation of a minimum annual contractual guarantee of workload and minimum time for work, including some of them being consecutive, aiming at greater legal and economic security for the and the employer. RESUMOO objetivo central deste artigo é investigar o contrato de trabalho intermitente, institucionalizado a partir da Lei 13.467 de 2017 que ensejou a reforma trabalhista brasileira. Trata-se uma nova modalidade de contratação, desconhecida no Brasil, mas que já vinha sendo difundida em muitas legislações ao longo do globo e ficou conhecida como o contrato de trabalho “zero hora”. Por esta modalidade enquadra-se a prestação de serviços subordinada, mas não contínua, que ocorre com alternância de períodos de execução de serviços e de inatividade e que no Brasil poderá ser realizada independentemente do tipo de atividade do empregado e do empregador, o que tende a facilitar sua generalização. Destarte, se vislumbra conhecer e interpretar criticamente esse novo formato de contratação pelo método jurídico-sociológico, buscando entender os impactos jurídicos, sociais e econômicos dele advindos, sobretudo na tentativa de verificar as possibilidades de adequação desse tipo de contrato às bases principiológicas do Direito do Trabalho e às novas conformações de trabalho experimentadas nos últimos anos. Tenta-se na presente investigação empreender verdadeira trincheira hermenêutica em prol de uma contrarreforma, objetivando engendrar práticas laborais juridicamente sustentáveis. Em conclusão, aventa-se a possibilidade de incidência desse contrato ao modelo Uber de serviços, destacando-se a importância desse exercício hermenêutico de resistência, a fim de que a reforma trabalhista seja palco de novas possibilidades de proteção dos trabalhadores.PALAVRAS-CHAVETrabalho Intermitente. Uber.ABSTRACTThe main objective of this paper is to investigate the intermittent work contract, institutionalized in the Act 13.467 of 2017 that led to the Brazilian labor reform. This is a new modality of hiring, unknown not Brazil, but it is already being spread in many acts throughout the globe and became known as the "zero hour" work contract. This modality includes the provision of subordinate services, but not continuous, which occurs with the alternation of periods of service execution and inactivity, and that in Brazil will be performed independently of the type of activity of the employee and the employer, which tends to facilitate its generalization. Therefore, it is envisaged to know and interpret critically this new format of contracting by the legal-sociological method, seeking to understand the legal, social and economic impacts of it, especially in the attempt to verify the possibilities of adequacy of this type of contract to the foundational bases of the Labor Law and the new working scenario experienced in recent years. In the present investigation it is attempted to embark on a true hermeneutic trench in favor of a counter-reform, with the aim of produce legally sustainable labor practices. In conclusion, it's rising the possibility of incidence of this contract made like the Uber model of services, highlighting the importance of this hermeneutic exercise of resistance, so that the labor reform can be an arena of new possibilities of protection of workers. KEYWORDSIntermittent Work.
