66 Buffalo Law Review 123 (2018)This Article offers an unorthodox theory of insanity. According to the traditional theory, insanity is a cognitive or volitional incapacity arising from a mental disease or defect. As an alternative to the traditional theory, some commentators have proposed that insanity is an especially debilitating form of irrationality. Each of these theories faces fair-minded objections. In contrast to these theories, this Article proposes that a person is insane if and because he lacks a sense of agency. The theory of insanity it defends might therefore be called the lost-agency theory.According to the lost-agency theory, a person lacks a sense of agency when he experiences his mind and body moving but doesn’t experience himself as the author or agent of those movements. The title character in the movie Dr. Strangelove suffered from what’s known as alien hand syndrome. People suffering from this syndrome experience the moving hand as their hand but don’t experience themselves as the author or agent of its movements. The lost-agency theory portrays insanity as alien hand syndrome writ large. The insane actor is like someone possessed by an alien self. He’s not in charge of his mind or body when he commits the crime.

AbstractThe fact that Veblen was a keen critic of the neo-classical concept of “economic man” is well known. However, the following issues have not been discussed in enough depth: how he rebuilt the traditional theory of human nature through his new methodology of economics, how much his methodological revision broadened the scope of economics, and what kind of phenomena Veblen’s economic theory elucidates. This article examines these issues and aims to show the logical connection between Veblen’s controversial proposal on the methodology of economics and his analysis of economic phenomena. Specifically, it reconsiders Veblen’s analysis of economic action using a unique concept of instincts, his logic of explaining the relation between society and human nature, his way of drawing history from the relativistic worldview, and his characteristic method of grasping the cause and effect of economic phenomena. Finally, it highlights the importance of modifying the concept of “economic man” by focusing on the qualitative aspect. Particular reference is made to the economic concepts of utility, efficiency, and intangibility.

Based on the traditional theory of transient plane source for thermal conductivity measurement, this paper designed and developed a new pattern of heating and temperature sensing probe, presented the study of transient heat conduction of half-infinite plane while being heated, established a modified mathematical model of transient plane source method, and achieved the measurement of thermal conductivity of automotive interior material sample by the data processing method of mathematical iteration and liner regression using the modified transient plane source probe. According to the data of experiments, the instrument which this paper designed has a high precision of 5% and a wide range of 0.003-1W/(mK).This paper provides a practicable way for heat capacity determination of automotive interior materials.

We may discover the basis for a humanistic rhetoric of technical writing by examining managerial theories of human behavior. Complaints about the deficiencies of writers and their work correspond remarkably to complaints about the deficiencies of employees and their work. And both sets of complaints may actually be related to the traditional Theory X of human behavior, held by managers and teachers of writing. An alternative managerial theory proposed by Douglas McGregor, Theory Y, suggests ways to encourage an individual's initiative and to satisfy the organization's goals simultaneously. Since technical writing weds the worlds of writing and working, this managerial theory can provide a sound basis for a rhetorical theory that encourages a writer's initiative and satisfies the goals of writing simultaneously. The letter of application for employment illustrates how Theory Y works.

The discovery that an apparent forward-propagating otoacoustic emission (OAE) induced basilar membrane vibration has created a serious debate in the field of cochlear mechanics. The traditional theory predicts that OAE will propagate to the ear canal via a backward traveling wave on the basilar membrane, while the opponent theory proposed that the OAE will reach the ear canal via a compression wave. Although accepted by most people, the basic phenomenon of the backward traveling wave theory has not been experimentally demonstrated. In this study, for the first time, we showed the backward traveling wave by measuring the phase spectra of the basilar membrane vibration at multiple longitudinal locations of the basal turn of the cochlea. A local vibration source with a unique and precise location on the cochlear partition was created to avoid the ambiguity of the vibration source in most previous studies. We also measured the vibration pattern at different places of a mechanical cochlear model. A slow backward traveling wave pattern was demonstrated by the time-domain sequence of the measured data. In addition to the wave propagation study, a transmission line mathematical model was used to interpret why no tonotopicity was observed in the backward traveling wave.

A kinetic Potts Monte Carlo model was used to investigate the microstructural evolution of a three particles configuration during sintering. The a series of peculiar phenomena was observed and analyzed quantitatively, which indicated that even if the particle shape and the contact area are both completely symmetrical, the asymmetric neck growth will arise due to a special particle arrangement. Although the linear relationship between neck size logarithm and time logarithm was consistent with the traditional theory, a slower neck growth rate comparing with that of the two sphere model displayed a result of the asymmetric neck growth. The analysis of the particle rotation was made to confirm the occurrence of the asymmetric neck growth. It was firstly observed that the morphology of the grain boundaries became bevel, and the reason for this morphology was discussed. All the special phenomena have proved that the asymmetric particle arrangement about the contact area can trigger the unstable neck growth.

This paper is a defense of traditional compatibilism. Traditional compatibilism is, roughly, the view that (a) free will is essential to moral responsibility, (b) free will requires alternative possibilities of action, or alternatives for short, and (c) moral responsibility is compatible with determinism. Traditional compatibilism is a version of the traditional theory of free will. According to the traditional theory, a person S performed an action a freely only if S could have done otherwise, that is, only if S had alternatives. The traditional theory is often contrasted with the source theory: S performed a freely only if S was the source of a (McKenna 2001; Pereboom 2003). One may adopt a combined view of free will that sanctions both the traditional and source theories (Kane 1996, 72-3; van Inwagen 1983). As I use the terms ‘source theorist’ and ‘traditional theorist,’ the former refers to folks who accept the source theory and reject the traditional theory; the latter refers to folks who accept the traditional theory whether or not they accept the source theory.

Purpose The fraud landscape talks about the existence of fraudulent activities and can be assessed with the help of fraud literature. Taking this into consideration, this paper qualitatively revisits the famous fraud triangle theory developed by Donald R. Cressey (1950) which is the most traditional theory to detect a fraud. This paper aims to discuss various fraud models that have been extensions to fraud triangle theory and reviews the factors that drive a corporate fraud. This study is divided into two phases. The first phases discuss the various theories which have been developed to detect and prevent corporate frauds in organisations, and in the second phase the authors recognize “integrity” as a new extension to the basic fraud theory. The integrity model has been introduced as “fraud square” contributing to the development of fraud theory. Integrity plays a very important role in detecting corporate frauds, and this paper will act as a theoretical benchmark for future references. The implication of this study would help future researchers, academicians and practitioners to understand the fourth element of the fraud theory and would help improve the professional standards of organisations and regulators. Design/methodology/approach This paper revisits the literature in detail and reviews the most acknowledged models to explain “why people commit frauds” – the fraud triangle, fraud scale, the fraud diamond, the ABC model, the MICE model and the SCORE model. The authors contend that the traditional models need to be modernized to acclimate to the current developments in the rapidly increasing fraud incidents, both in occurrence and seriousness. Additionally, this paper builds on theoretical background to generate new model so as to improve the understanding behind the major factors which lead to commitment of frauds. Findings The authors identify a major element – integrity – in the research. As per ACFE 2020, “There are more than 3.3 billion people in the global workforce, half of them takes illegal use of gains from the organisation and some are discipled with integrity who does not cause any harm to the organisation.” To prevent fraud, integrity plays a very important role in organisations (Bakri et al., 2017). It has been found that individuals with less integrity are basically specified to a greater level of mismanagement. The organisations that have worked with integrity will improve performance at work and will always promote the best employees to work with less supervision. Originality/value This paper develops the integrity model to contribute to the development of fraud theory by identifying the key factors that play a major role in whether fraud will actually occur and acting as a theoretical benchmark for all future reference.

The improvement of the accuracy and efficiency of microforming process of polymers is of great significance to meet the miniaturization of polymeric components. When the nonuniform deformation is reduced to the microscopic scale, however, the mechanics of polymers shows a strong reinforcement behavior. Traditional theoretical models of polymers which have not considered material feature lengths are difficult to describe the size effect in micron scale, and the process simulation models based on the traditional theory could not provide effective and precise guidance for polymer microfabrication techniques. The work reported here proposed strategies to simulate size effect behaviors of glassy polymers in microforming process. First, the strain gradient elastoviscoplastic model was derived to describe the size affected behaviors of glassy polymers. Based on the proposed constitutive model, an eight-node finite element with the consideration of nodes' rotation was developed. Then, the proposed finite element method was verified by comparisons between experiments and simulations for both uniaxial compression and microbending. Finally, based on the FE model, under the consideration of the effect of rotation gradient, the strain distribution, the deformation energy, and the processing load were discussed. These strategies are immediately applicable to other wide-ranging classes of microforming process of glassy polymers, thereby foreshadowing their use in process optimizations of microfabrication of polymer components.

Based on the traditional theory of the intelligent systems, as well as the present study on intelligent tourism, Tourist Satisfaction Index model of Intelligent Tourism is put out in this paper. With the data collected in Nanjing, statistic materials suggest that two variables, Perceived Quality of the Intelligent Tourism and Intelligent City, play the most important roles in tourist satisfaction of intelligent tourism. The further analysis reveals that the factor under Perceived Quality of Intelligent Tourism, including Intelligent Transportation, Public Service Platform, Intelligent Hotel and Intelligent Travel Agency, as well as the factors under Intelligent City including Intelligent Governance and Intelligent Environment are the most important factors in the model.
