Lookofsky, Copenhagen: Djøf Publishing (2015), 335-362Article 39(2) of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG) imposes a cut-off period on the buyer's remedies for the delivery of non-conforming goods, depriving the buyer of all remedies under the CISG if he has not given notice of non-conformity to the seller within two years after the goods were handed over.Despite the fact that the CISG contains no rules on the limitation of actions (prescription), courts in various jurisdictions have held that Article 39(2) CISG preempts the application of limitation periods under domestic laws that are shorter than two years. The present article challenges this approach and argues that the prevailing interpretation of Article 39(2) CISG misunderstands the provision's purpose. If construed correctly, no conflict exists between the CISG's two-year cut-off rule and shorter domestic limitation periods.

Abstract This article discusses the methods by which damages are calculated in personal injury and wrongful death cases in the state of Michigan. It discusses issues relevant to the economic damages expert that are common to all matters of personal injury and wrongful death damages law in Michigan. The areas that are unique to Michigan in estimating damages are discussed in detail with sources cited from both Michigan's statutes and case law. There is a clear separation between estimating the particular components for normal tort claims for personal injury and wrongful death damages and claims arising from automobile accidents. An assessment of noneconomic damages available, as a matter of law to Michigan plaintiffs, is described within the context of personal injury, wrongful death and no-fault automobile injury litigation. The last section presents matters of admissibility of evidence by the damage expert in the course of trial.

Shift to The Front II Komplek Sukamukti Banjaran Project is one of the projects implemented by one of the companies engaged in telecommunications. In its implementation, each project including Shift to The Front II Komplek Sukamukti Banjaran has a time limit specified in the contract. Project scheduling is an important role in predicting both the cost and time in a project. Every project should be able to complete the project before or just in the time specified in the contract. Delay in a project can be anticipated by accelerating the duration of completion by using the crashing method with the application of linear programming. Linear programming will help iteration in the calculation of crashing because if linear programming not used, iteration will be repeated. The objective function in this scheduling is to minimize the cost. This study aims to find a trade-off between the costs and the minimum time expected to complete this project. The acceleration of the duration of this study was carried out using the addition of 4 hours of overtime work, 3 hours of overtime work, 2 hours of overtime work, and 1 hour of overtime work. The normal time for this project is 35 days with a service fee of Rp. 52,335,690. From the results of the crashing analysis, the alternative chosen is to add 1 hour of overtime to 34 days with a total service cost of Rp. 52,375,492. This acceleration will affect the entire project because there are 33 different locations worked on Shift to The Front II and if all these locations can be accelerated then the duration of completion of the entire project will be effective

Background/Objectives: This study investigated differences in the attitude of users according to type of scarcity message and price discount conditions to compose T-commerce sales messages and search for effective strategic plans. Methods/Statistical analysis: This study empirically verifies the difference in promotion attitude and purchase intention between the type of T-Commerce scarcity message (quantity limit message / time limit message) and the price discount policy (price discount / non-discount) message. For this purpose, 2 (scarcity type: limited quantity, limited time) X 2 (with or without price discount: price discount, no price discount) factor design between subjects was used.
