In his 23 novels featuring character Dave Robicheaux, James Lee Burke poses a fundamentally moral (and unanswerable) question: how does a good man maintain himself in the face of evil? From Neon Rain (1987) to A Private Cathedral (2020), Burke develops Robicheaux as both a detective and a narrator, reminiscent of the pastoral genre, where shepherds spent their leisurely, idyllic summer days in singing contests. Like the classical shepherds/poets double, Robicheaux is cop/storyteller and seeks to redeem criminals in both capacities. Burke ultimately illustrates how good and evil will always, must always, co-exist both within individuals and society.

This chapter poses a complicated philosophic question: Are ecosystems complex, natural wholes that involve interdependent, dynamically interrelated, and interactive parts, or are they abstract conceptions in the human mind, lacking in any independent natural reality? This question is difficult since human beings are creatures with one foot in natural reality and another foot in metaphorical thought. The answer given comes in the form of a story of trout fishing on the Little Snake River and an encounter with a large trout, a wise old survivor that the author calls Big Little Snake. The encounter with Big Little Snake was concrete when it happened, but later in memory and reflection it has become a metaphor for a rich and abundant nature. The unanswerable question becomes a practical insight. Human beings need nature and our fellow living creatures for the metaphoric opportunities that they afford. To impoverish the biological diversity of the natural world is to impoverish our own humanity as well.

This paper critically analyzes the concept of legitimacy as it applies to international criminal law. Using the referral of the situation in Darfur to the International Criminal Court (icc) – and the resultant disagreement between Sudan, the African Union, and the icc – as an entry point, it examines the discourse about the referral as a contest of legitimacy. After placing this specific example in the context of theories of legitimacy, it argues that there are no objective criteria for determining the legitimacy of an international criminal tribunal. Legitimacy as a concrete concept is best understood as a Kantian antinomy – an unanswerable question that borders on the metaphysical. Yet this indeterminacy can be turned to the advantage of the critical theorist, offering pragmatic, normative, and pluralist alternatives for the reconstitution of international criminal tribunals such as the icc.
