Securing the Environmental Water Requirements of Seasonally Ponding Wetlands: Partnering Science and Management Through Benefit Sharing

Although environmental flow regime assessments are becoming increasingly holistic, they rarely provoke water managers to enact the adaptive water reallocation mechanisms required to secure environmental water for wetlands. The conditions that cause science-based environmental flow assessments to succeed or fail in informing the management of environmental water requirements remain unclear. To begin to resolve these conditions, we used process tracing to deconstruct the sequence of activities required to manage environmental water in four case studies of seasonally ponding wetlands in Mediterranean and Mesoamerican watersheds. We hypothesized that, when the flexibility and equitability of the socioeconomic system do not match the complexity of the biophysical system, this leads to a failure of managers to integrate scientific guidance in their allocation of environmental water. Diagnostic evidence gathered indicates that science-management partnerships are essential to align institutional flexibility and socioeconomic equitability with the system’s ecohydrological complexity, and thus move from determination to reallocation of environmental water. These results confirm that institutions e.g., river basin organizations need to be supplemented by motivated actors with experience and skill to negotiate allocation and adaptive management of environmental water. These institutional-actor synergies are likely to be especially important in water scarce regions when the need to accommodate extreme hydrological conditions is not met by national governance capacity. We conclude by focusing on benefit sharing as a means to better describe the conditions for successful science-based environmental flow assessments that realize productive efficiency in environmental water allocation i.e., recognition of multiple values for both people and ecosystems.

Overcoming epistemic injustices in the biomedical study of ayahuasca: Towards ethical and sustainable regulation

After decades of biomedical research on ayahuasca's molecular compounds and their physiological effects, recent clinical trials show evidence of therapeutic potential for depression. However, indigenous peoples have been using ayahuasca therapeutically for a very long time, and thus we question the epistemic authority attributed to scientific studies, proposing that epistemic injustices were committed with practical, cultural, social, and legal consequences. We question epistemic authority based on the double-blind design, the molecularization discourse, and contextual issues about safety. We propose a new approach to foster epistemically fair research, outlining how to enforce indigenous rights, considering the Brazilian, Peruvian, and Colombian cases. Indigenous peoples have the right to maintain, control, protect, and develop their biocultural heritage, traditional knowledge, and cultural expressions, including traditional medicine practices. New regulations about ayahuasca must respect the free, prior, and informed consent of indigenous peoples according to the International Labor Organization Indigenous and Tribal Peoples Convention no. 169. The declaration of the ayahuasca complex as a national cultural heritage may prevent patenting from third parties, fostering the development of traditional medicine. When involving isolated compounds derived from traditional knowledge, benefit-sharing agreements are mandatory according to the United Nations’ Convention on Biological Diversity. Considering the extremely high demand to treat millions of depressed patients, the medicalization of ayahuasca without adequate regulation respectful of indigenous rights can be detrimental to indigenous peoples and their management of local environments, potentially harming the sustainability of the plants and of the Amazon itself, which is approaching its dieback tipping point.

Survival of the Fittest Protection of Indigenous Knowledge

This chapter reflects on numerous protections that are available for indigenous knowledge from those who misappropriate it for personal aggrandizement without regard of the holders of the knowledge. The chapter is underpinned on the Afrocentricity and Sankofa theories. A socio-legal methodology was adopted to ground the work to enable students studying indigenous knowledge systems to have a foundation and be able to follow the interdisciplinarity in the writing. As such, a doctrinal approach and qualitative design were engaged to buttress the philosophical reasoning and capture the rich and unrecorded knowledge of inorganic intellectuals. The chapter's standpoint is that the protection of indigenous knowledge requires African-tailored legislation that resonates with indigenous communities' beliefs and are pragmatic yet innovative to bring benefit sharing. In pursuing this, a normative legal framework that could be utilised in the protection of indigenous knowledge is explored.

Community-Based Tourism and Local People's Perceptions Towards Conservation

Uganda is among the most bio-diverse countries and a competitive wildlife-based tourism destination in the world. Community-based tourism approach has been adopted in the country's conservation areas as a strategy to ensure that local communities benefit and support wildlife conservation. This chapter analyses local communities' perceptions of conservation and the benefits they get from tourism in Queen Elizabeth Conservation Area. The study reveals that local communities were concerned about loss of protected resources and support their conservation irrespective of the benefits they get from tourism in the conservation area. There is need to design conservation programmes that focus on local community-conservation-benefits nexus which take into consideration the perceived conservation values, strategies for benefit sharing and incorporation of indigenous knowledge systems.

A Critical Review of Environmental Governance, Land Restitution, and Tourism in Protected Areas

Natural areas, when protected, conserve the natural environment and function as social spaces in which tourism brings increased income, employment, and financial support for conservation. The inclusion of local community members in the planning and management of protected areas has been on the rise since the early 1900s. Tourism has been advocated as a strategy that can help in achieving economic development, especially in rural areas. However, governance issues and potential negative impacts of tourism development have been under inspection. Conservation efforts in Southern Africa especially in the late 1800s and early 1900s had negative impacts on the local communities since this led to many communities being displaced or having limited access to these protected areas. This has seen the need for ways and efforts to get local community members' despondency and attitudes towards protected areas change such that in the 20th century, there were efforts to use conservation models that included community members in the decision-making and benefit-sharing process to garner their support for protected areas. This paper reviews literature on environmental governance, land restitution in protected areas, tourism in protected areas, co-management, and the importance of community participation. These concepts are reviewed using Manyeleti Game Reserve as a case study.
