Appropriate subject of obtaining evidence of a criminal offense in the opinion of the court

The article considers the collection of evidence by the prosecution, because it is in this order that the evidence base of criminal proceedings is most often formed. Thus, the prosecutor, investigator (investigator) acting under Articles 36, 40, 401 of the Criminal Procedure Code of Ukraine, as well as an employee of the operational unit pursuant to Article 41 of the Criminal Procedure Code of Ukraine on behalf of the investigator or prosecutor have the right to collect evidence. The purpose of the article is to study the affiliation of the subjects of evidence collection as part of the procedural form of the criminal process of Ukraine, taking into account the analysis of court decisions, namely the assessment of the evidence base as a basis for deciding on the merits of criminal proceedings. Cases of involvement of an improper subject in the pre-trial investigation, which are common and typical, are systematized. There are two types of improper subjects within the investigative (search) or procedural actions, namely the subject: 1) is not appointed in the manner prescribed by law, although according to current legislation according to the list of its powers may be appropriate; 2) does not have the authority under the law to make a specific decision or to conduct investigative (search) or procedural actions. An analysis of court decisions according to which courts provide an assessment of the procedural activities of the subjects of evidence collection in criminal proceedings at the stage of pre-trial investigation, including their relevance and admissibility. Thus, attention is paid to the assessment of courts on the legality of the presence of persons during investigative (investigative) or procedural actions; the correctness of fixing such a presence. In addition, the situations of appointment of relevant subjects in criminal proceedings to fulfill their powers are considered. It is proposed to supplement the first part of Article 236 of the Criminal Procedure Code of Ukraine with a provision that clarifies the grounds for the stay and authority of the employee of the operational and investigative service during the search.

Die Proteinausstattung eines einzelnen pflanzlichen Mitochondriums

The structure and function of mitochondria have been characterized with increasing precision. How the protein inventory defines the characteristics of the organelle remains insufficiently understood, however. Recently we devised a quantitative proteomic approach to estimate the copy numbers of proteins in a single plant mitochondrion, as physical operational unit in the cell. We illustrate how such a simple thought experiment can give fascinating insights into how a mitochondrion works.

In search of the recurrent units of translation

Translation memory systems aim to reuse previously translated texts. Be-cause the operational unit of the first-generation translation memory sys-tems is the sentence, such systems are only useful for text types in which full-sentence repetition frequently occurs. Second-generation sub-sentential translation memory systems try to remedy this problem by providing addi-tional translation suggestions for sub-sentential chunks. In this paper, we compare the performance of a sentence-based translation memory system (SDL Trados Translator’s Workbench) with a sub-sentential translation memory system (Similis) on different text types. We demonstrate that some text types (in this case, journalistic texts) are not suited to be translated by means of a translation memory system. We show that Similis offers useful additional translation suggestions for terminology and frequent multiword expressions.

Psychological impact in Healthcare Professionals during emergencies: the Italian experience with COVID-19

The COVID-19 outbreak imposed an overwhelming workload as well as emotional burdens on healthcare professionals (HCPs). In May 2020, an online survey was administered to HCPs in Italy to assess the pandemic’s psychological impact and to investigate possible predictive factors that led to individual differences. Female and younger respondents, especially those operating in northern Italy experienced more frequently negative emotional states such as irritability, anxiety, loneliness, and insecurity. However, positive feelings, first of all solidarity, were also reported especially by female and older workers. The majority of the negative as well as positive emotional states were experienced almost equally by both doctors and nurses, and independently of the operational unit in which they operated. Our findings can provide useful information in planning more tailored psychological interventions to support this category of workers.

Pedagogical component in training operational services employees

The object of pedagogical knowledge are those phenomena of reality that determine the development of an individual in purposeful social activity. Pedagogy tends to penetrate all vocations that impact individuals in the context of their education and education. The author of this article established the role of pedagogy in operational activity, drawing an important conclusion that the influence of the activities of employees of the operational services on Russian citizens is often associated with the council and education of the latter. The author explains the provisions of the current legislation that denote the pedagogical orientation of operational activities, emphasizing its importance not only in the process of training ordinary employees, but in the management of operational services. Pedagogy mobilizes and disciplines the work of an operational unit and the implementation of educational functions.

The Influence of Pay Satisfaction, Job Satisfaction, Competence, and Turnover Intention on the Service Quality of Honorary Employees in the Airport Operational Unit Office of Class III North Kalimantan

The study aims to determine the effect of pay satisfaction, employee job satisfaction, and competence on turnover intention and its impact on the service quality of honorary employees. The research method is quantitative research by the survey through questionnaires. The research sample was honorary employees in the Airport Operational Unit Office of Class III Kol. RA. Bessing Malinau, Tanjung Harapan, and Nunukan who have worked for more than 1 (one) year as many as 85 employees. The sampling technique in this study is a proportionate stratified random sampling technique. This research was conducted in September 2019 to February 2020. Data were analyzed using SEM PLS analysis. The results showed that pay satisfaction and job satisfaction had a significant and positive effect on service quality. Pay satisfaction, job satisfaction, and competence had a significant and negative effect on turnover intention. The turnover intention had a significant and negative effect on service quality. Pay satisfaction had a significant and indirect positive effect on service quality through turnover intention. Job satisfaction and competence did not have a significant indirect effect on service quality through turnover intention. Evaluation of employee satisfaction and competence in the organization is important to be carried out regularly. The most important thing is that this research will contribute to the body of knowledge, especially in human resource management science.

Mental health in migrants contacting the mental health operational unit of the National Institute for Health, Migration and Poverty (NIHMP): preliminary data

Aim Migration can lead to an increase in stress rates and can impact mental health, especially in certain migrant groups. Nonetheless, mental health needs and the importance of public health are not well captured in most studies using national samples. This study aimed to show the correlation between mental disorders, socio-demographic and cultural aspects among migrants. Subject and methods One hundred nineteen migrants, applying for assessment to the Mental Health Operational Unit of the National Institute for Health, Migration and Poverty (NIHMP) in Rome, were recruited. Results Migrants frequently reported mood disorders (mainly women). Men reported PTSD, somatization and adjustment disorders. Conclusions Over time, diverse factors may produce a decline in an initially healthy migrant status. The research unveils a new focus on the psychopathology of migrants accessing the NIHMP, with important implications for migrants’ mental health treatment and prevention.

THE INFLUENCE OF TRAINING, COMPETENCY, AND MOTIVATION ON THE PERFORMANCE OF THE OFFICE OF THE DJALALUDDIN AIRPORT OPERATIONAL UNIT OF GORONTALO

The objectives of this study were: 1) to determine and analyze the effect of training on employee performance in the Office of the Djalaluddin Airport Operational Unit of Gorontalo; 2) to determine and analyze the influence of competence on employee performance in the Office of the Djalaluddin Airport Operational Unit of Gorontalo; 3) to determine and analyze the influence of motivation on employee performance in the Office of the Djalaluddin Airport Operational Unit of Gorontalo; 4) to identify and analyze the effect of training, competence and motivation simultaneously on employee performance in the Office of the Djalaluddin Airport Operational Unit of Gorontalo. This research uses quantitative research methods with observation data collection techniques, interviews, questionnaires, literature study and literature review. The data analysis technique used the SPSS 20 program, namely validity test, reliability test, classical assumption test and multiple linear regression analysis. The results of the research that the researchers conducted show that: 1) there is a positive and significant influence between training variables on employee performance in the office; 2) there is a positive and significant influence between competency variables on employee performance in the Office of the Djalaluddin Airport Operational Unit of Gorontalo; 3) there are positive and significant influence between motivation variables on employee performance in the Office of the Djalaluddin Airport Operational Unit of Gorontalo; 4) there is a positive and significant influence simultaneously between training, competence and motivation on employee performance at the Office of the Djalaluddin Airport Operational Unit of Gorontalo.

JUDICIAL CONTROL IN ENSURING THE LEGALITY AND VALIDITY OF DECISIONS TAKEN BY OPERATIONAL UNITS OF INTERNAL AFFAIRS BODIES

The article examines the features of judicial control in ensuring the legality and va- lidity of decisions made by operational units of internal affairs bodies. The relevance of the work is determined by an attempt to improve the legal mechanisms for the implementation of judicial control in the above-mentioned area based on the study of judicial practice, as well as legal conflicts and gaps in the current operational search legislation. The subject of the study is the system of control powers of the court: 1) verification of the legality and validity of decisions of the operational unit to conduct certain operational search activities by granting permission to the court to conduct them; 2) checking the legality and validity of decisions of the operational unit to conduct certain operational search activities according to their urgent (emergent) conduct; 3) checking the legality and validity of decisions of the operational unit to carry out operational search activities on citizens' complaints. The purpose of this work is to study the essential characteristics of the control powers of the court in ensuring the legality and validity of decisions made by operational divisions of internal affairs bodies. The methodology of the research is based on the General scientific dialectical method of cognition and the scientific methods that follow from it: system, logical, comparative legal analysis, statistical, special legal, and others. The theoretical basis of the research rests on the scientific works of V. V. Abramochkin, V. A. Azarov, Yu. M. Groshevii, S. V. Eskov, N. S. Zheleznyak, V. I. Ivanov, Ch.M. Ismailov, N. A. Kolokolov, E. L. Nkitin, I. A. Odnoshevin, R. H. Rakhimzoda, A. I. Tambovtsev, A. N. Khalikov, I. D. Shatokhin and other authoritative scientists who have made a significant contribution to the solution of doctrinal and applied problems of judicial control in the field of operational search activity. As a result of scientific analysis of judicial practice and legal literature, the author proposes a number of legal tools that affect the court's assessment of the legality and validity of operational search decisions on conducting intrusive OSM, and identifies legal conflicts that require delicate study and technical elimination. In addition, it is argued that amendments to the provisions of the Federal Law On Operational Search Activities aimed at preempting precedents for recognizing evidence obtained during the OSM in cases that cant be delayed and may lead to a serious or particularly serious crime are unacceptable. The results of the study can be used in law enforcement practice of subjects of operational search activity, judges, authorized prosecutors, as well as in scientific work when analyzing problems of judicial control in the field of operational search activity.
