Judicial Khula; theory and practice

Khula is the most practically used component in the judiciary of Pakistan and this requires completely Islamic Jurisprudence but unfortunately, Neither bar nor bench has special competency on this issue, on top of that Dar Ul Ifta is a different system in Pakistan that is not recognized ultimately common peoples face problems. The question arises to examine the theory of Khula in Islamic law along with Pakistani judicial practice in this relevant matter and furthermore to point out contemporary issues with its solutions so comparative study between khula and its practice is mainly focused in this research. This paper is not just an analytical study of the topic, but it is comparing both theoretical and practical aspects of Kula so that reforms could be oriented toward emerging issues. This work has drawn the conduct for the legal fraternity in concern matter furthermore, this writing has shown a way to the public for adopting a just & fair process for canceling the contract of marriage and more importantly the replacement of Civil judges with Muftian-E-Kiram in family courts will overcome the problems in family cases.

Cost Allocation in Integrated Community Energy Systems—Social Acceptance

Integrated community energy systems (ICESs) are a good representative of local energy systems by integrating local distributed energy resources and local communities. It is proposed that costs should be allocated in a socially acceptable manner since there is no regulation in ICESs. In this paper, social acceptance is conceptualized from the dimension of community acceptance considering procedural and distributive justice. A fair process increases the understanding and the acceptance of the cost allocation outcomes, and a fair outcome leads to the acceptance of the cost allocation procedure. This approach adopted the multi-criteria decision-making technique to evaluate social acceptance to select a cost allocation method that was socially acceptable to local community members. The results show that our approach is unique and useful when multiple decision-making groups have to decide together upon the cost allocation method. It is able to provide quantitative results and optimal decisions from a multi-group decision-making perspective. The methodology developed in this research can be applied to any local community energy system to select a cost allocation method. Furthermore, the obtained results can be used by decision-makers to support them in the decision-making process. Based on our approach, policy implications are also analyzed to support the success of cost allocation in ICESs.

The B chromosome of Pseudococcus viburni: a selfish chromosome that exploits whole-genome meiotic drive

Meiosis, the key process underlying sexual reproduction, is generally a fair process: each chromosome has a 50% chance of being included into each gamete. However in some organisms meiosis has become highly aberrant with some chromosomes having a higher chance of making it into gametes than others. Yet why and how such systems evolve remains unclear. Here we study the unusual reproductive genetics of mealybugs, in which only maternal-origin chromosomes are included into the gametes during male meiosis, while paternally-derived chromosomes degrade. This whole genome meiotic drive occurs in all males and is evolutionarily conserved. However one species - the obscure mealybug Pseudococcus viburni - has a segregating B chromosome that increases in frequency by escaping paternal genome elimination. Here we present whole-genome and gene expression data from laboratory lines with and without B chromosomes. These data allow us to identify B-linked sequences including >70 protein-coding genes as well as a B-specific satellite repeat that makes up a significant proportion of the chromosome. We also used these data to investigate the evolutionary origin of the B chromosome. The few paralogs between the B and the core genome are distributed throughout the genome, showing that it is unlikely that the B originated through a simple duplication of one of the autosomes. We also find that while many of the B-linked genes do not have paralogs within the P.viburni genome, but they do show orthology with genes in other hemipteran insects suggesting that the B might have originated from fission of one of the autosomes, possibly followed by further translocations of individual genes. Finally in order to understand the mechanisms by which the B is able to escape elimination when paternally-derived we generated gene expression data for males and females with and without B chromosomes. We find that at the developmental stage when meiosis is taking place only a small number of B-linked genes show significant expression. Only one gene was significantly over-expressed during male meiosis, which is when the drive occurs: a acetyltransferase involved in H3K56Ac, which has a putative role in meiosis and is therefore a promising candidate for further studies. Together, these results form a promising foundation for studying the mechanisms of meiotic drive in a system that is uniquely suited for this approach.

Brand in the system of world economic geopolitics

The place of brand in the system of world economic geopolitics is determined. The causal chain of influence of branding on the formation of the world geoeconomy is traced. The brand is defined as a factor in shaping the system of world economic geopolitics. The scheme of connections between the elements of the system of world economic geopolitics is offered. The time coordinates of the brand functioning in the context of the evolution of the «world order» are determined. The objective strengthening of the influence of branding in the conditions of geophilosophy is substantiated. It is established that the brand provides effective promotion of countries in the world geospace and determines their role in the implementation of world geopolitics and «world order». The object of research is the branding as a factor in shaping the system of world economic geopolitics. The subject of the study is the brand as a tool for managing the economic development of the country. The purpose of this work is to substantiate the place of the brand as a tool for managing the economic development of the country in the system of world economic geopolitics. To achieve this goal were used: system-parametric approach – to the scientific knowledge of brand and geopolitics, which allowed to reveal certain links between these concepts; systematic analysis of the evolution of the «world order», the system of economic geopolitics and branding, which contributed to the definition of the brand as a factor in the formation of the system of economic geopolitics; managerial approach – to the process of brand management, the formation of a «world order», controlling the fair process of distribution of the country's wealth among different segments of the population. The practical significance of the obtained results lies in the possibility of their use to manage the development of branding in Ukraine, which will have positive consequences for changing the role of the country in the world economic geopolitics: from a raw material appendage to an active economic and political actor. Conclusions. The brand, being the bearer of the spiritual component, in the context of the economic factor of formation of both domestic and foreign policy of the country, transmits to the external environment the content of the spiritual sphere of society. Depending on the political course, national interests, economic potential and geographical opportunities, the role of the country in the geopolitical space is formed: subordinate, influential, strategic, leading.

The impact of procedural and distributive justice on satisfaction and manufacturing performance: a replication of Lindquist (1995) with a focus on the importance of common metrics in experimental design

This paper replicates Lindquist’s (Lindquist, Journal of Management Accounting Research 7:122–147, 1995) seminal research introducing the concepts of justice to the accounting literature. We use organizational justice theory, as did he, to replicate his study and, in doing so, question some findings of partial replications and extensions done over the past 25 years. We do this because work built off his study has challenged some of his findings. These challenges, we believe, have resulted from most researchers using different research metrics than did Lindquist. Many of these extensions have also used a mental-based task, instead of a manual-based one, in their experiments. We believe this constrains the ability to draw inferences and conclusions from this subsequent research. We further believe this constraint extends to much of the experimental research in the social sciences.In our research we replicate exactly Lindquist’s (Lindquist, Journal of Management Accounting Research 7:122–147, 1995) operationalizations of voice and vote and measure dependent outcomes for four of the same conditions he investigated. In contrast to most of other follow-up studies, we find, as did Lindquist, that having a voice only leads to significantly enhanced satisfaction with high-stretch targets, as compared to having a vote only or no input. We also corroborate Lindquist’s (Lindquist, Journal of Management Accounting Research 7:122–147, 1995) result that having a voice only leads to significantly greater satisfaction with the experimental task, as compared to participants with a vote only or no input. Additionally, unlike Lindquist (Lindquist, Journal of Management Accounting Research 7:122–147, 1995), we find participants allowed only a voice significantly outperform participants with a vote only and no input. We thus support Lindquist’s findings of a fair process effect for voice and perceptions of pseudo-participation related to vote.

Testing Fairness Principles for Public Environmental Infrastructure Decisions

Public infrastructure decisions affect many stakeholders with various benefits and costs. For public decisions, it is crucial that decision-making processes and outcomes are fair. Fairness concepts have rarely been explored in public infrastructure planning. We close this gap for a global issue of growing importance: replacing sewer-based, centralized by decentralized wastewater systems. We empirically study fairness principles in this policy-relevant context, and identify possible influencing factors in a representative online survey of 472 Swiss German residents. In a transition phase, innovative, decentralized pilot wastewater systems are installed in households. We designed two vignettes for this context to test the adhesion to principles of distributive justice—equality, equity, and need—at individual and community levels. A third vignette tests procedural justice with increasing fulfilment of fair process criteria. The results confirm our hypotheses: equity is perceived as fairer than equality at individual and collective levels. Contrary to expectations and literature, need is perceived as even fairer than equity. Procedural justice results confirm literature, e.g., the majority (92%) of respondents deems a policy fair that includes them in decision-making. Only few demographic and explanatory factors are significantly correlated with respondents’ fairness perceptions. Although unexpected, this is positive, implying that introducing decentralized wastewater technology can be designed for the entire population independent of characteristics of individuals. Generally, our results confirm literature: fairness perceptions depend on the circumstances. Hence, they should be elicited in the exact application context to be able to enter negotiation processes and provide concrete advice to decision makers.

The Wolf We Feed: Democracy, Caste, and Legitimacy

Procedure is central to American public legal discourse. From the soaring rhetoric of the Declaration of Independence to the Due Process Clause of the Fourteenth Amendment, the American legal tradition rests on the principle that law must be both derived and applied according to fair process. Consider that in the 2020 election the Trump Administration resorted to fervent and false allegations of widespread voter fraud—that the election process was fundamentally unfair—in order to weaponize Republican voters’ ostensible commitments to fairness against what was, objectively, one of the least procedurally unfair elections in history. Yet the four-year period of the Trump Administration (2017–2021) also saw the rise of overt and deliberate racist politics and mounting evidence that a universal commitment by all to fairness for all across the United States is a mythical framing of the American creed. One can look from the apparent lack of justice for unarmed Black civilians killed by police officers to a sitting President’s affirmative support for white supremacist groups to observe the doublespeak associated with fascist regimes: claiming to be restoring law and order while backing away from commitments to due process and equal protection. And yet, simultaneously, we have also seen the mainstreaming of a successful oppositional politics, including Black Lives Matter, which in June 2020 enjoyed a peak 67 percent approval rating among American adults in a national survey. Even as white nationalism flourished under the Trump Administration, polls indicate that increasing numbers of Americans acknowledge that our society is unfair to racial minorities. As Americans stand at the perpetual racial crossroads of the twenty-first century, how much does the legitimacy that they accord their government depend on the procedural justice it delivers to all?

The “ironic” fair process effect: A perceived fair naturalization procedure spurs anti-immigration attitudes through increased host national identification among naturalized citizens

A growing body of research has shown that naturalized citizens’ attitudes towards immigration worsen following citizenship acquisition. Accordingly, these socially mobile individuals tend to distance themselves from their former immigrant ingroup. The present contribution explains such self–group distancing coping strategy in terms of an “ironic” procedural fairness effect. Study 1 ( N = 566), a survey conducted among naturalized Swiss citizens, showed that fairness perceptions with respect to the naturalization process were indeed associated with stronger anti-immigration attitudes, and that this relationship was mediated by identification with the host nation. Next, two experiments were conducted to demonstrate the causality of the hypothesized mediation model. In Study 2 (Experiment 1; N = 248), fairness of the admission procedure (accurate vs. inaccurate) increased identification with a desirable group. In Study 3 (Experiment 2; N = 141), administration of a national identity prime evoked stronger anti-immigration attitudes. Taken together, our findings highlight a somewhat “dark side” of procedural fairness.
