Fighting Words: Pro-Choice Cause Lawyering, Legal-Framing Innovations, and Hostile Political-Legal Contexts

Drawing on social-movement and sociolegal theorizing, we investigate legal-framing innovations in the briefs of reproductive-rights cause lawyers in prominent US Supreme Court abortion cases. Our results show that pro-choice activist attorneys engage in innovative women’s-rights framing when the political-legal context is more resistant to abortion rights for women, that is, when the political-legal opportunity structure is generally closed to reproductive-rights activism. We consider reproductive-rights framing in three types of pivotal abortion cases over the last half-century: challenges to limitations on public funding of abortion, challenges to regulations that include multiple restrictions on abortion access, and challenges to bans on second-trimester abortions. Our analysis proceeds both qualitatively and quantitatively, with close reading of the briefs to distill the main women’s-rights frames, a count analysis using text mining to examine use of the frames in the briefs, and assessment of the political-judicial context to discern its influence on cause-lawyer legal framing. We conclude by theorizing the importance of the broader political-legal context in understanding cause-lawyer legal-framing innovations.

Social Movements and the Legal Field: Becoming-Constituent

The relationship between social movements and the legal field is controversial and complex. This paper begins by recognizing that the concept of social movement does not belong to legal doctrine and then synthetically reconstruct the relevance of it for a legal understanding. In fact, even if this concept is not formally taken into account by constitutions or by legal codes, a socio-legal approach underscores the need for the comprehension and inclusion of collective phenomena into legal theory. First, the paper explores the way in which ‘social movement’ has been taken up and translated in the legal field through the concept of social change and constitutional change. Second, this research goes through various cases in which social movements use law strategically, from the phenomenon of cause lawyering to the litigation strategy. Finally, it stands for a theoretical understanding of the role of social movements in legal theory as a lively expression of ‘becoming-constituent’.

Zusammenfassung Der Beitrag stellt bestehende empirische Konzepte vor, die sich für die Untersuchung von sogenannter strategischer Prozessführung eignen. Zunächst wird der Begriff der „strategischen Prozessführung“ kritisch auf Abgrenzbarkeit, analytischen Mehrwert und Präzision geprüft und für eine sozialwissenschaftliche Verwendung verworfen. Die politische Verengung auf einzelne Rechts- und Themengebiete muss kritisch reflektiert werden. Das Hineinwirken-Wollen in außer-rechtliche Bereiche ist keine Besonderheit der Sachverhalte, die als strategische Prozessführung bezeichnet werden, sondern ist auch bei alltäglichen Praxen und bei nicht-offenen Strategien gegeben. Neu sind weniger die rechtlichen Handlungsformen, als vielmehr bestimmte, ideell motivierte nicht-staatliche Akteure. Für eine präzisere Begriffsbildung werden zentrale Befunde der Forschung zu cause lawyering vorgestellt, die eine Differenzierung zwischen Präzedenzfallarbeit und Öffentlichkeitsarbeit nahelegen. Weiterhin ist eine Unterscheidung zwischen ideell und kommerziell motivierten Rechtspraxen nötig, um nicht-offene Formen von strategischem Vorgehen zu erfassen. Der Beitrag schließt mit der Forderung nach einer größeren Distanz zum Untersuchungsgegenstand und mit Forschungsfragen, die u. a. die Frage nach Intentionalität sowie nach kommerziellen Rechtspraxen betreffen.
