In recent decades, civil society organizations (CSOs) have ostensibly attained increased access to the United Nations (UN) and other intergovernmental organizations (IGOs) and, in turn, increased opportunities for collaboration with IGOs. However, in most cases, CSO access to IGOs remains limited and highly regimented. Little scholarship has been undertaken to examine barriers to effective CSO–IGO collaborations. Virtually, no empirical research has examined the degree or nature of the interaction between the UN and international civil society via the dynamic of the flagship programme designed to facilitate such collaborations—the consultative status framework. This exploratory study partially addresses the latter gap in the scholarship by undertaking a qualitative macro-scale examination of CSOs within the UN Economic and Social Council’s (ECOSOC) consultative status programme, the primary vehicle in the UN–civil society dynamic. Specifically, the study sought to identify barriers to UN–civil society collaboration within the consultative status programme as perceived by participating CSOs. Findings of a survey sent to a random sample of 10% of CSOs holding UN–ECOSOC consultative status revealed that barriers to participation in the programme varied with some obstacles far more common than others. The degree of barriers reported by CSOs also strongly reflected the level of accreditation they held within the programme. Additionally, survey respondents offered insight as to how impediments in the collaboration could potentially be addressed.

AbstractThe main vehicle in the UN-NGO dynamic is the consultative status program within the UN Economic and Social Council (ECOSOC). Existing literature addresses UN efforts in facilitating formal collaboration with international civil society, but little research has been undertaken to examine macro-scale patterns of NGOs within such collaborations. This study sought to partly address the latter gap in the literature by examining NGO goals and goal/benefit attainment within the UN-ECOSOC consultative status program. The results of a survey sent to a random sample of 10% of all NGOs holding consultative status revealed that (1) a varied range of both extrinsic and intrinsic considerations motivated NGOs to acquire consultative status; (2) NGOs commonly were not achieving their initial goals or otherwise not deriving benefit from the collaboration; and (3) the degree/sense of goal or benefit attainment correlated strongly with the level of accreditation afforded to NGOs, with lower levels of consultative status usually corresponding to lower reported levels of goal/benefit attainment.

Сформульовано визначення поняття «міжнародна неурядова організація» (МНУО) як організоване об'єднання представників громадськості різних країн, створене відповідно до національного законодавства для досягнення цілей і завдань розвитку громадянського суспільства й міжнародних відносин, що діє відповідно до загальновизнаних принципів Уставу ООН і норм міжнародного права на території двох і більше держав і володіє консультативним статусом. З’ясовано, що видовими ознаками, які містять у собі: цілі й завдання, характер діяльності, форму організації, наявність консультативного статусу тощо визначається відмінність міжнародної НУО від інших суб'єктів міжнародних відносин. Такі родові ознаки (як от: факт об'єднання людей, наявність постійних органів управління, Статуту тощо) є загальними для всього класу (роду) організацій. Обгрунтовано, що МНУО як учасник міжнародних відносин, є суб'єктом міжнародного права, однак їх правосуб'єктність має функціональний характер, тобто обмежений її консультативним статусом. Продемонстровано, що МНУО є неофіційною сполучною ланкою між національними урядами й міжнародним співтовариством, беруть активну участь у розробці міжнародних стандартів, методів, моделей і співвідносять їхню національну значимість з міжнародно-правовою. Зазначається, що у національному законодавстві України спостерігається тенденція оптимальної розробки питань, що стосуються правового статусу МНУО з огляду на міжнародні принципи й стандарти. Водночас, не можна йти шляхом повного їхнього копіювання, оскільки держава, ґрунтуючись на своєму суспільно-історичному досвіді, досвіді функціонування правової системи, на існуючих суспільних відносинах і своїх національних інтересах, сама має право визначати правовий статус МНУО. Пропонується у змінах до закону «Про неурядові організації» відобразити основну ідею, яка полягає в тому, що неурядові організації є ядром громадянського суспільства, найважливішим фактором розвитку демократичної держави й міжнародних відносин, засобом реалізації громадянами своїх прав і свобод. Activities of international nongovernmental organizations in the legislative and legal space of Ukraine The definition of the concept of "international non-governmental organization" (international NGO) as an organized association of representatives of the public of different countries, formulated in accordance with the national legislation for the achievement of the goals and objectives of the development of civil society and international relations acting in accordance with the generally recognized principles of the Charter of the United Nations and the norms of international law on the territory of two or more states and has consultative status. It was found out that the specific features that include: goals and objectives, the nature of activity, the form of organization, the presence of consultative status, etc., is determined by the distinction of the international NGO from other subjects of international relations. Such generic attributes (such as the fact of association of people, the presence of permanent bodies of government, the Statute, etc.) are common to the entire class (kind of) organizations. It is substantiated that international NGO as a participant in international relations is a subject of international law, but their legal personality is functional, that is, limited by its consultative status. It has been demonstrated that the international NGO is an informal link between national governments and the international community and is actively involved in the development of international standards, methods, models and their national relevance with international legal law. It is noted that in the national legislation of Ukraine there is a tendency for the optimal development of issues related to the legal status of the international NGO, taking into account international principles and standards. At the same time, it is impossible to go through the full copying of them, since the state, on the basis of its socio-historical experience, the experience of functioning of the legal system, in existing social relations and its national interests, has the right to determine the legal status of the Ministry of the Interior. The proposed amendments to the law "On Non-Governmental Organizations" reflect the basic idea that non-governmental organizations are the core of civil society, the most important factor in the development of a democratic state and international relations, as a means of citizens' realization of their rights and freedoms.

This chapter first examines the history of Burakumin activism to combat discrimination against them based on their former outcaste status, which by the 1970s had established them as an influential group that had secured some successes. However, social discrimination against Burakumin persisted, and Burakumin activists explored different ways to fight it. Global human rights emerged as a prominent source of legitimacy for their activism and they began engaging with international human rights institutions. Initially intended to advance their own issues, their international engagement developed into a new pillar for their activism that focused on protecting minority rights across the globe, resulting in the establishment of a new international NGO with a UN consultative status, the International Movement against All Forms of Discrimination and Racism (IMADR). Through IMADR, they expanded global human rights by establishing a new rights norm against discrimination based on descent and work.

ABSTRACTPortugal has developed an active Antarctic programme over the past decade. Here, we examine Portuguese Antarctic activity using a variety of bibliometric measures, showing that Portuguese scientific output has grown substantially faster than the field as a whole, with quality remaining broadly constant. Antarctic science made up a growing percentage of overall Portuguese research, up to 0.14% of all papers in 2016—a level comparable to many other nations with well-established research programmes. Alongside this, Portugal has increasingly engaged in policy discussions and produced policy papers for Antarctic Treaty Consultative Meetings, some of which were based on Portuguese environmental science. The Antarctic Treaty reserves decision-making powers to ‘Consultative Parties’—those who have been recognised as demonstrating substantial research activity in the continent. Our data indicates that Portugal is currently the fourth most productive non-Consultative Party, and has similar or greater output than several Parties who have already attained consultative status—its publication record is similar to that of the Czech Republic, which became a Consultative Party in 2014. The rapid growth of Portugal's Antarctic research may make it well placed to consider attaining consultative status to the Antarctic Treaty in the near future.
