On the Effectiveness of the Prosecutors Role in Pre-Trial Proceedings: the Position of the Legislator and the Opinion of the Law Enforcer

The author examines the problems connected with the position of the prosecutor in a criminal process from the standpoint of the effectiveness of the prosecutor’s work. Specifically, using statistical data on the situation with the legality and the quality of preliminary investigations and the results obtained by other Russian scholars who researched this issue, the author shows that the transfer of investigators from the jurisdiction of the prosecutor’s office to a newly created independent Investigation Committee of the Russian Federation, the transfer of the right to the procedural guidance of the investigation from the prosecutor to the head of the investigation body, revoking the prosecutor’s right to coordinate the decision of the investigator, inquirer, or an inquiry body to initiate a criminal case, and in general the right to do it — all of these, in fact, improved the effectiveness of the supervisory function and, consequently, improved the legality and quality of preliminary investigations. At the same time, the author presents his own view on the directions of improving the effectiveness of the role of the prosecutor in the pre-trial proceeding, which should ensure a general sustainable development of Russian criminal procedure legislation.

PERSON NAMES COLLOCATION AS THE DETERMINATION FACTOR OF THEIR REFERENTIAL STATUS (based on English and Tatar languages material)

In the article, the analysis of person names in terms of their collocation with some verbs groups as the determination factor of their referential status is carried out. The empirical base of the research work involves statements from the national corpuses of English and Tatar languages. The study object is English and Tatar statements representing peculiarities of person names collocation and realization of their event nomination function. It is found out that person names can act as the implicit event nomination. This phenomenon can be partially considered as the semantic-syntactic metonymy. The referential status in this case is ambiguous. Language-independent investigation of person names allows defining their specific-referential status. Thanks to their situation representing ability person names can be considered as abstract event nomination and their referential status as interpretative.

Characteristics of the Legislative Regulation of Participation of Representatives and Other Participants in the Civil Process

The relevance of the issues outlined in the article is due to the peculiarities of the legislative regulation of the participation of representatives and other actors in the civil process of Ukraine. In this vein, the purpose of the article is to scientifically prove that procedural representation differs significantly from representation in civil law, among other things, in the object and nature of the relationship that exists between the representative and the principal, thus as well as the legal grounds and consequences of both processes. Furthermore, it is observed that the specialist, unlike the expert, acts as an assistant and consultant to the court and does not carry out an independent investigation aimed at clarifying the relevant circumstances of the case. The main method of research on this topic was modeling, which allowed, among other things, to consider the civil process as the only organizational lawsuit that serves to resolve the life situation. It is concluded that the legislative participation model of representatives and other people aims to improve their professional skills aimed at strengthening the work of the judiciary, while managing and resolving various conflicts of different nature to guarantee social order.

Lecture: “Investigative Committee of Russia: general characteristics activities”

В данной лекции содержится теоретико-практическая характеристика организации и деятельности Следственного комитета Российской Федерации в различных сферах правового регулирования общественных отношений. Автор считает весьма позитивным разделение функций прокурорского надзора и производства следствия, что позволило достигнуть необходимого баланса полномочий. Это состояние весьма эффективно отразилось на системе защиты прав и интересов личности на стадии досудебного производства. В целом такая глобальная реорганизация следственных органов проведена впервые. Исторически идея создания «независимого следствия» возникла еще во времена императора Петра Великого, когда была сформулирована концепция вневедомственного предварительного следствия, а реализована она была только в XXI веке. This lecture contains a theoretical and practical description of the organization and activities of the Investigative Committee of the Russian Federation in various spheres of legal regulation of public relations. The author considers the separation of the functions of prosecutor's supervision and investigation proceedings to be very positive, which made it possible to achieve the neces- sary balance of powers. This condition was very effectively reflected in the system of protecting the rights and interests of the individual at the stage of pre-trial proceedings. In general, this is the first time such a global reorganization of the investigative bodies has been carried out. Historically, the idea of creating an "independent investigation" arose back in the days of Emperor Peter the Great, when the concept of a nondepartmental preliminary investigation was formulated, and it was realized only in the 21st century.

Model-independent investigation of the RJ/ψ,ηc and ratios of decay widths of semileptonic Bc decays into a P-wave charmonium

Experimental measurements of decay branching fractions of semitaunic and semimuonic [Formula: see text] into [Formula: see text] have challenged the lepton flavor universality in standard models with about two standard deviations. In this paper, we first investigate the unitary constraint on form factors of [Formula: see text] meson into [Formula: see text]-wave and [Formula: see text]-wave charmonium. Such constraint leads to the exploration of the [Formula: see text] and other ratios [Formula: see text], [Formula: see text], and [Formula: see text] in a model-independent way. These results together with future experimental measurements can be used to explore the lepton flavor universality in a more systematic way. In addition, we point out that the helicity-dependent ratios [Formula: see text] and [Formula: see text] can also provide complementary information.
