ABSTRAK Bantuan hukum yang berjudul penerapan pasal 56 KUHAP tentang bantuan hukum ditiap tingkat pemeriksaan tersangka (studi kasus pada penyidikan Polres Metro Tangerang Kota). Dengan rumusan masalah bagaimana penerapan pasal 56 KUHAP tentang bantuan hukum pada tingkat pemeriksaan di Polres Metro Tangerang Kota serta menganalisis upaya Polres Metro Tangerang Kota dalam sosialisasi pasal 56 KUHAP kepada masyarakat kurang mampu. pendekatan metode penelitian dilakukan secara normatif empiris dengan subjek penelitian direskrimum Polres Metro Tangerang Kota dan ketua Pusat Bantuan Hukum Peradi Tangerang, bantuan hukum merupakan suatu hak yang harus diperoleh tersangka sebagai suatu implementasi Negara hukum untuk menjamin hak asasi warga negaranya dalam mencapai suatu keadilan dan bantuan hukum merupakan hal fundamental yang harus di dapatkan oleh tersangka melihat banyak nya realitas ketimpangan hukum bagi seorang tersangka utnuk mendapatkan haknya. Bantuan hukum di upayakan secara optimal dibuktikan dengan adanya penurunan jumlah jenis tindak pidana pada periode tahun 2016 sampai 2018 yang terdiri dari 10 jenis tindak pidana, upaya Polres Metro Tangerang Kota dalam penerapan dan sosialisasi nya dengan memberikan informasi kepada tersangka, keluarga tersangka dengan cara mengedukasi pentingnya bantuan hukum pada tingkat pemeriksaan tersangka serta upaya pemberian papan informasi tentang hak tersangka yang wajib untuk mendapatkan bantuan hukum di tingkat kepolisian sehingga dalam pelaksanaannya bisa berjalan dengan baik untuk mencapai suatu keadilan. Kata kunci: Bantuan Hukum, penerapan, Jenis tindak pidana. With the formulation of the problem of how the application of article 56 of the Criminal Procedure Code on legal assistance at the level of inspection in the Tangerang City Metro Police as well as analyzing the efforts of the Jakarta Metro City Police in the socialization of article 56 Criminal Procedure Code to underprivileged people. approach to the research method is carried out empirically normatively with research subjects reskrimum Tangerang City Police Precinct and chairman of the Peradi Tangerang Legal Aid Center, legal aid is a right that must be obtained by the suspect as an implementation of the rule of law to guarantee the rights of its citizens in achieving justice and legal assistance is a fundamental thing that must be obtained by the suspect seeing the many reality of legal inequality for a suspect to get his rights. Legal assistance is optimally sought as evidenced by a decrease in the number of types of criminal acts in the period 2016 to 2018 consisting of 10 types of criminal acts, the efforts of the Metro Tangerang City Police in its application and outreach by providing information to suspects, suspects' families by educating the importance legal assistance at the suspect's investigation level and efforts to provide information boards about the rights of suspects who are required to obtain legal assistance at the police level so that in its implementation it can go well to achieve justice.Keywords: Legal Aid, application, type of crime

<p>The purpose of this paper is to conduct a critical study of the application of the presumption of innocence to the perpetrators of criminal acts (suspects) investigated by the police. Implementation of the principle is important to study because the suspect must not be considered guilty before the criminal act is proven. A review of this case was carried out at the Kendal Police Department in mid-2019-2020. Writing texts are written with a normative-empirical approach. The non-doctrinal approach was chosen because it can clearly examine the application of the principle of presumption of innocence in more depth. Therefore, the author considers it necessary to carefully examine the application of these principles in the process of law enforcement at the police level. The results showed that the application of the principle of presumption of innocence in the Kendal Police Department was not optimal, because some of its applications were colored by threats and acts of violence. The suboptimal application of this principle is influenced by various factors, including the lack of legal knowledge of suspects and threats and acts of violence that are not reported. As we know the presumption of innocence is a fundamental principle in the criminal justice system, where a person must be positioned innocent before his guilt is proven in an honest and open trial.</p>

Indonesia is a country of law that upholds justice and guaranteeing all citizens equal before the law in its position without any exceptions. In the opening text of the Constitution of the Republic of Indonesia in 1945 and the first paragraph of the fifth principle of Pancasila prove that Indonesia is a country that upholds the sense of social justice for all Indonesian people, independent country, united, sovereign, just and prosperous. Indonesia received the law as the state ideology to create order, security, justice and prosperity for its citizens. One of the state apparatus that perform the function of the law is the police, one of the actions of the national police is investigating. The process of investigation is the examination process in criminal cases in order to obtain enough information to find and collect evidence on the matter and to find the suspects. Nowadays many cases of wrongful arrests in the investigation process at the police level causing adverse effects on the morale and psychological. How the legal protection for victims of wrongful arrests made by the police of the Republic of Indonesia. The method used in this study is adalahYuridis Normative that is based on the Principles of Law, the rules of law and Regulation Legislation relating to criminal law. In the legal protection as stipulated in the Regulation Legislation that the suspect, defendant or convict is entitled to sue for damages because of being arrested, detained, charged and prosecuted or subjected to other measures, without reason under the Act or in error about the person or the applicable law , Paragraph (2) compensation claim by the suspect or his heirs for the arrest or detention and other measures without reason under the Act or in error about the person or the applicable law as referred to in paragraph (1) that its case was not submitted to the district court, disconnected at a pretrial hearing.Negara Indonesia adalah negara hukum yang menjunjung tinggi rasa keadilan dan menjamin semua warga negara, sama dalam kedudukannya dimata hukum tanpa ada perkecualian. Dalam teks pembukaan Undang Undang Dasar Negara Republik Indonesia 1945 alinea pertama dan Pancasila sila kelima membuktikan bahwa Indonesia adalah negara yang menjunjung tinggi rasa keadilan sosial bagi seluruh rakyat Indonesia, negara yang merdeka, bersatu, berdaulat, adil dan makmur. Indonesia menerima hukum sebagai ideologi negara untuk menciptakan ketertiban, keamanan, keadilan serta kesejahteraan bagi warga negaranya. Salah satu aparatur negara yang menjalankan fungsi hukum adalah Polri, Salah satu tindakan polri adalah penyidikan. Proses penyidikan adalah proses pemeriksaan dalam perkara pidana guna mendapatkan informasi yang cukup, menemukan dan mengumpulkan bukti-bukti mengenai perkara tersebut dan guna menemukan tersangkanya. Sekarang ini banyak kasus salah tangkap dalam proses penyidikan pada tingkat kepolisian menyebabkan kerugian yang berdampak pada moril dan psikis. Bagaimana perlindungan hukum terhadap korban salah tangkap yang dilakukan oleh kepolisian Negara Republik Indonesia. Metode yang digunakan dalam penelitian ini ini adalahYuridis Normatif yaitu berdasarkan Asas-Asas Hukum, kaidah-kaidah hukum dan Peraturan Perundang-Undangan yang berkaitan dengan hukum pidana. Dalam perlindungan hukum sebagaimana diatur di dalam Peraturan Perundang-Undangan bahwa tersangka, terdakwa atau terpidana berhak menuntut ganti kerugian karena ditangkap, ditahan, dituntut dan diadili atau dikenakan tindakan lain, tanpa alasan yang berdasarkan Undang-Undang atau karena kekeliruan mengenai orangnya atau hukum yang diterapkan. Ayat (2) tuntutan ganti kerugian oleh tersangka atau ahli warisnya atas penangkapan atau penahanan serta tindakan lain tanpa alasan yang berdasarkan Undang-Undang atau karena kekeliruan mengenai orang atau hukum yang diterapkan sebagaimana dimaksud dalam ayat (1) yang perkaranya tidak diajukan ke pengadilan negeri,diputus di sidang praperadilan.

The formulation of the problem in this study is how the authority of investigators to handle cases of land use crime without permission from the rightful or legal authority and how to enforce the law against the land user without the permission of the rightful or authorized attorney in the North Sumatra Regional Police jurisdiction and its obstacles . Then the research method used is descriptive with normative juridical approach. The results of the research at the Directorate of Criminal Investigation of the North Sumatra Regional Police that, who conduct investigations into criminal cases of land users without the permission of the rightful or authorized attorney only at the Directorate of Criminal Investigation of the North Sumatra Police. Based on Article 166 paragraph (3) letter f of the National Police Chief Regulation Number 22 Year 2010 Concerning Organizational Structure and Work Procedures at the Regional Police Level (Polda), Ditsabhara carries out the technical fostering function of maintaining public order in the form of law enforcement of minor criminal offenses and TPTKP. As a result, the case settlement rate is low each year, ranging from 17.56% to 48.7%. This condition can lead to embezzlement of cases (quo vadis) and loss of public confidence in the performance of the North Sumatra Regional Police Directorate General Criminal Investigation.

<p class="IABSSS">Children are vulnerable groups when dealing with the criminal justice system based on various analyzes. Therefore a special mechanism is needed to protect the interests of children facing the law. It is affirmed in the UN Regulations for the Protection of Children Who Lost their Freedom that the child court system must uphold rights and safety and promote the physical and mental well-being of children. Prison sentences must be used as a last resort. Children who are in conflict with the law, will get a label or stigmatization from the community from the moment the case processes at the police level until the court ruling is even possible forever. This article will discuss the implications of inconsistencies in prison sanctions for children and the purpose of criminal prosecution in RKHUP, that children who proceed in criminal justice, the label will be inherent indefinitely, so it is likely that children tend to commit criminal acts again. Prison sentences will bring children to learn more about their environment.</p>

<p>Penanggulangan perkara pidana yang terjadi di tengah masyarakat dapat diselesaikan dengan dua metode, yaitu penal dan non penal. Penyelesaian secara non penal salah satunya merupakan Mediasi Penal. Mediasi penal sendiri lahir dari budaya yang ada di dalam masyarakat sehingga kandungan nilai-nilainya sesuai dengan karakteristik Bangsa Indonesia. Namun penerapan mediasi penal ini belum memiliki landasan yuridis yang kuat sehingga perlu diteliti lebih lanjut apa model mediasi yang digunakan serta bagaimana peran aparat penegak hukum. Dalam artikel ini akan dipaparkan proses penyelesaian perkara pidana melalui mediasi penal di tingkat penyidikan dan peran aparat penegak hukum dalam proses mediasi penal. Data pendukung artikel ini menggunakan hasil penelitian dengan jenis kualitatif dan metode pendekatan yuridis sosiologis yang mendasarkan pada data primer dan data sekunder. Pada dasarnya, mediasi penal telah familiar dilaksanakan ditingkat kepolisian didasarkan pada Surat Kapolri No Pol: B/3022/XII/2009/SDEOPS tanggal 14 Desember 2009 tentang Penanganan Kasus Melalui <em>Alternatif Dispute Resolution</em> dengan bentuk mediasi penal yang digunakan adalah <em>victim offender mediation</em>. Model VOM ini dianggap paling layak untuk diterapkan karena mempertemukan antara kedua belah pihak sehingga mengakomodir kepentingan para pihak demi terwujudnya keadilan restoratif.</p><p><strong> </strong></p><p>Overcoming criminal cases that occur in the middle of society can be solved by two methods, namely reasoning and non-punishment. Non-reasoning settlement is one of them is Penal Mediation. The reasoning mediation itself is born from the culture that exists in society so that the content of its values is in accordance with the characteristics of the Indonesian Nation. However, the application of this reasoning mediation does not yet have a strong juridical basis so it needs to be investigated further what the mediation model is used and how the role of law enforcement officers is. In this article will be presented the process of solving criminal cases through reasoning mediation at the level of investigation and the role of law enforcement officers in the process of judicial mediation. Supporting data for this article uses the results of research with qualitative types and sociological juridical approaches that base on primary data and secondary data. Basically, the reasoning mediation is familiar is carried out at the police level based on National Police Chief No Pol: B / 3022 / XII / 2009 / SDEOPS dated December 14, 2009 concerning Case Handling through Dispute Resolution Alternatives with the form of reasoning mediation that is victim offender mediation. This VOM model is considered the most feasible to implement because it brings together the two parties so that it accommodates the interests of the parties in order to realize restorative justice.</p><p> </p>

The enforcement of criminal law starts from the legislative body that is the legislative body that makes the law and determines the norms in the form of orders and prohibitions. The legislation made by this legislative body can reflect the existence of the values of justice desired by the principle of Pancasila that is civilized or dignified justice. Criminal law enforcement is also done by the judiciary. That is the application of criminal law in the form of law by law enforcement officers either ranging from the police level to the courts. They are concrete justice enforcers. And the last is related to facilities and infrastructure that support the policy for criminal law enforcement. The process of criminal law enforcement can be effective if there is a harmony relationship starting from the investigation / investigation process at the police, prosecutor / prosecutor level until the court process and ending with the judges verdict. The present analysis is a reframing of an earlier study conducted by the author to compensate for perceived deficiencies in previous studies on police decisions in sexual assault complaints. Specifically, qualitative comparative analysis was employed at the micro-social level to reveal justification scenarios, employed by investigating officers, which resulted in attrition at the police level. It was found that police employed the legal model in justifying “unfounded” designations while police employed both legal and extralegal models in justifying designations of “departmental discretion.” Further rese arch, expanding the database through interview s and participant observation, is necessary to fully explore justification scenarios for police designations of sexual assault complaints
