Abstract The profound changes in both everyday life and the legal system over the last hundred years have transformed civil law as well. While the notion that civil law concerns relationships of private persons still prevails, the traditional public law–civil law division now seems questionable. This paper points out some of the key changes in civil law within the framework of the transformation of the legal system as a whole, and seeks to outline a different approach that may help better to understand the present situation.

This article takes the legal rules of digital civil proceedings with foreign participants in China as the research object, and studies the structure and content of the civil digital litigation rule system from the present situation of the foreign-related civil digital litigation rules. The purpose of this article is to study how China constructs the foreign-related civil litigation legal system under the Internet thinking, and how to establish a digital judicial system centred on the litigants. This article discusses from two aspects: the use of digital technology to promote the settlement of foreign-related civil litigation cases, and the characteristics of new foreign-related civil litigation cases produced by digital technology.

Taking Hangzhou as an example, this paper analyzes the present situation and problems of low-rent housing exit, and developed countries and regions’ practice and experience as well. It proposes the countermeasures to optimize low-rent housing exit mechanism, including the building of information sharing mechanism, the legal system perfection and the establishment of gravity mechanism, etc.

“Justice delayed is justice denied” and “justice hurried is justice buried” are oft quoted proverbs in legal studies. While the latter is rarely prevalent in India, the former has maligned the image of the Indian legal system considerably. Delay in disposal of cases, pendency of cases, especially those of civil and commercial nature, and inducing unnecessary procedural complexities in litigation process are hindrances that come in the way of access to justice. Several reports of the Law Commission of India have pointed out that the present situation is very grim with escalating number of pending cases in the courts in India. To add to this compelling situation, the COVID-19 pandemic has further disrupted the court proceedings by increasing burden, moving the hearings from physical to virtual courtrooms. The endeavour of the authors in this chapter has been to search for convincing reasons that have led to inordinate delays in disposal of civil cases and to find out possible solutions to this problem plaguing the Indian legal system.

Abstrak Diskriminasi adalah fakta yang masih menjadi permasalahan serius di Indonesia. Baik pada ranah politik, hukum maupun sosial. Diskriminasi masih terus terjadi meskipun berbagai upaya telah dilakukan untuk mengatasinya mulai dari penguatan perangkat hukum, advokasi hingga pendidikan di masyarakat. Hal ini melahirkan dugaan kuat bahwa diskriminasi sulit hilang karena telah mengakar dalam sistem dan budaya hukum kita. Dengan pendekatan sejarah dan hukum, kajian ini memaparkan berbagai produk hukum mulai dari konstitusi negara, Undang-undang hingga peraturan-peraturan hukum yang paling rendah, menyangkut kehidupan beragama sejak masa Hindia Belanda, proklamasi kemerdekaan hingga era reformasi sekarang ini. Berbagai produk hukum tersebut akan dipaparkan secara kronologis untuk mencari keterkaitan satu sama lain sehingga terbangun peta pemikiran yang komprehensif mengenai kebijakan diskriminatif yang masih terjadi saat ini. Kajian ini menemukan bahwa diskriminasi ternyata memiliki latar historis, di mana munculnya berbagai kebijakan diskriminatif negara terhadap kelompok-kelompok minoritas agama di Indonesia adalah buah dari politik kolonial yang masih bertahan hingga kini. Abstract Discrimination has still become a serious problem in Indonesia. Discrimination continues to occur in some aspects such as in the political, legal and social levels despite various efforts have been made to overcome it by strengthening the legal norms, advocacy and education in the community. This problem has triggered a strong presumption that it has been entrenched in our legal system and culture. By historical and law approach, the study investiagates some regulations regarding religious life since colonial era to the recent reformation era, including Constitution, laws and policies in the lower level. Those regulations will be elaborated in chronoliga order to find out some correlations among each other, so that we have a comprehensive map of thinking about the discriminatory policies that still occurs today.  This study reveals that discrimination has a historical root to the colonial politics that remain influencial to the state policies in the present situation.
