The penal protection of property in French law based on texts dating back to the nineteenth century has been largely renewed in recent years. This intervention is intended to shed light on the relationship that may exist between property in the civil sense and the penal protection it enjoys. Concept, object and means of this protection then draw a model of property in the penal sense which is not always in agreement with its civilistic conception.

Recent contributions to this journal have taken various approaches to travelers's accounts as sources of African history. Elizabeth de Veer and Ann O'Hear use the travel accounts of Gerhard Rohlfs to reconstruct nineteenth-century political and economic history of West African groups who have escaped scholarly attention. But essentially they use Rohlfs' work as he intended it to be used. Gary W. Clendennen examines David Livingstone's work to find the history under the propaganda. He argues that, overlooking its obvious problems, the work reveals a wealth of information on nineteenth-century cultures in the Zambezi and Tchiri valleys. Unfortunately, Clendennen does not use this source for these reasons. He uses it instead to shed light on the relationship between Livingstone and his brother.John Hanson registers a basic distrust of European mediated oral histories recorded and written in the African past. He draws attention to the fact that what were thought to be “generally agreed upon accounts” may actually reflect partisan interests. Hanson dramatically demonstrates how chunks of history, often the history of the losers, are lost, as the history of the winners is made to appear universal. Richard Mohun can be seen to represent the winners in turn-of-the-century Central Africa. His account is certainly about himself. I attempt, though, to use his account to recover some of the history of the losers, the Africans, which Mohun may have inadvertently recorded.My question is double; its two parts—one historical, one methodological—are inextricably interdependent. The first concerns the experience of the people from Zanzibar who accompanied, carried, and worked for Richard Dorsey Mohun on a three-year (1898-1901) expedition into Central Africa to lay telegraph wire. The second wonders how and how well the first question can be answered using, primarily, the only sources available to me right now: those written by Mohun himself.

AbstractFrom the mid-nineteenth century, seamen were increasingly identified as vectors of epidemic diseases such as cholera. The rising acceptance of the germ theories of disease and contagion and the transition from sail to steam at this time increased the fear of the rapid spread of contagious diseases through these mobile people. This article examines how the British naval authorities, ship surgeons and the medical and municipal authorities in the Calcutta sailortown sought to improve maritime health and hygiene to prevent the spread of cholera among and by British seamen. Nineteenth century Calcutta is an ideal context for this study on account of its epidemiological notoriety as a disease entrepot and the sea route between Calcutta and British ports was one of the most closely monitored for disease in the Empire. The article argues that a study of cholera among British seamen can generate important insights into the relationship among disease, medicine and colonialism and in doing so shed light into a neglected aspect of the history of nineteenth century cholera, the British anxiety regarding disease dispersion, practice of hygiene and sanitation and British seamen’s health.

In 1875 the distinguished Unitarian minister and local historian Henry Wilder Foote preached a eulogy for his late colleague, the Reverend James Walker, philosopher and former president of Harvard University. It was an appropriate occasion to characterize the achievement of the antebellum generation of Harvard Unitarian leaders that Walker represented. “They were much more than mere denominationalists or founders of a sect,” Foote declared. “The whole tone of their teaching was profoundly positive in its moral and religious quality. Trained at our American Cambridge, they were really the legitimate heirs of that noble group of men nurtured at the Cambridge of England–the Latitude Men, as they were called–who blended culture and piety and rational thought in their teaching.” Building upon Foote's perceptive characterization, this article will explore the significance of the seventeenth-century Cambridge Platonists for the Harvard Unitarians of the mid-nineteenth century. In so doing it may illuminate other forms of New England religious thought that also drew upon Platonic or Neoplatonic sources, including Edwardseanism, Hopkinsianism, and the progressive orthodoxy of Horace Bushnell. In particular, I hope to shed light on the relationship between Unitarianism and Transcendentalism.

This article analyses the initial encounter with epidemic cholera in the Italian cities of Florence, Ferrara and Modena. The large body of scholarship that explores themes related to medical theory, urban infrastructure, and political and social change across the nineteenth century demonstrates the importance of the historical evaluation of cholera epidemics. There is, however, minimal scholarship exploring the relationship between dominant social structures and minority groups. This article illuminates previously unexplored connections between Jews and Christians in relation to urban disease management efforts. Scapegoating Jewish population groups during times of crisis has a long tradition in Europe. A traditional ‘outsider’ subjected to highly institutionalized segregation, the Jews of Italy were readily identifiable. As such, societal anxiety surrounding the horrors of cholera could have easily found release in violence against the Jews. Yet this did not happen during the 1830s. This article seeks to determine why this was the case. Bureaucratic records contained in the municipal archives of these cities shed light on the dynamics of both urban disease management in the early nineteenth century and the interactions between Jews and Christians during this relatively understudied period of Italian history. Analysing the traditional understanding of both disease origin and transmission, in conjunction with the realities of the urban environment, this article concludes that both of these factors mitigated the potential for scapegoating Italian Jews. Jews had been resident ‘outsiders’ in these cities for centuries. However, the quotidian realities of urban life created strong administrative connections between the Jews and the Christian authorities that ultimately overruled the confessional divisions expressed in the walls and gates of the ghettos.

Through an examination of the extensive papers, manuscripts and correspondence of American physician Benjamin Rush and his friends, this article argues that it is possible to map a network of Scottish-trained physicians in the late eighteenth and early nineteenth-century Atlantic world. These physicians, whose members included Benjamin Rush, John Redman, John Morgan, Adam Kuhn, and others, not only brought the Edinburgh model for medical pedagogy across the Atlantic, but also disseminated Scottish stadial theories of development, which they applied to their study of the natural history and medical practices of Native Americans and slaves. In doing so, these physicians developed theories about the relationship between civilization, historical progress and the practice of medicine. Exploring this network deepens our understanding of the transnational intellectual geography of the eighteenth and early nineteenth century British World. This article develops, in relation to Scotland, a current strand of scholarship that maps the colonial and global contexts of Enlightenment thought.

This book aims to shed light on core questions relating to language and society, language and conflict, and language and politics, in relation to a changing Middle East. While the book focuses on Arabic, it goes way beyond a purely linguistic analysis by bringing to the fore a set of pressing questions about the relationship between Arabic and society. For example, it touches on the development of language policy via an examination of administrative mandates (top-down) in contrast to grassroots initiatives (bottom-up); the deeper layers of the linguistic landscape that highlight the connection between politics, conflict, identity, road signs and street names; Arabic studies and Arabic identity and the myriad ways countries deal simultaneously with globalisation while also seeking to strengthen local and national identity, and more.

In 2009, Damian Walford Davies called for a counterfactual turn in Romantic studies, a move reflective of a wider growth of critical interest in the relationship between Romanticism and counterfactual historiography. In contrast to these more recent developments, the lives of the Romantics have provided a consistent source of speculation for authors of popular alternate history since the nineteenth century. Yet the aims of alternate history as a genre differ markedly from those of its more scholarly cousin, counterfactual historiography. How, then, might such works fit in to the proposed counterfactual turn? This article makes a case for the critical as well as the creative value of alternate histories featuring the Romantics. By exploring how these narratives differ from works of counterfactual historiography, it seeks to explain why the Romantics continue to inspire authors of alternate history and to illuminate the forking paths that Davies's counterfactual turn might take.

Walter Pater's late-nineteenth-century literary genre of the imaginary portrait has received relatively little critical attention. Conceived of as something of a continuum between his role as an art critic and his fictional pursuits, this essay probes the liminal space of the imaginary portraits, focusing on the role of the parergon, or frame, in his portraits. Guided by Pater's reading of Kant, who distinguishes between the work (ergon) and that which lies outside of the work (the parergon), between inside and outside, and contextualised alongside the analysis of Derrida, who shows how such distinctions have always already deconstructed themselves, I demonstrate a similar operation at work in the portraits. By closely analysing the parerga of two of Pater's portraits, ‘Duke Carl of Rosenmold’ (1887) and ‘Apollo in Picardy’ (1893), focusing on his partial quotation of Goethe in the former, and his playful autocitation and impersonation of Heine in the latter, I argue that Pater's parerga seek to destabilise the relationship between text and context so that the parerga do not lie outside the text but are implicated throughout in their reading, changing the portraits constitutively. As such, the formal structure of the parergon in Pater's portraits is also a theoretical fulcrum in his aesthetic criticism and marks that space where the limits of, and distinctions between, art and life become blurred.

The editors are proud to present the first issue of the fourth volume of the Journal of Indian Ocean World Studies. This issue contains three articles, by James Francis Warren (Murdoch University), Kelsey McFaul (University of California, Santa Cruz), and Marek Pawelczak (University of Warsaw), respectively. Warren’s and McFaul’s articles take different approaches to the growing body of work that discusses pirates in the Indian Ocean World, past and present. Warren’s article is historical, exploring the life and times of Julano Taupan in the nineteenth-century Philippines. He invites us to question the meaning of the word ‘pirate’ and the several ways in which Taupan’s life has been interpreted by different European colonists and by anti-colonial movements from the mid-nineteenth century to the present day. McFaul’s article, meanwhile, takes a literary approach to discuss the much more recent phenomenon of Somali Piracy, which reached its apex in the last decade. Its contribution is to analyse the works of authors based in the region, challenging paradigms that have mostly been developed from analysis of works written in the West. Finally, Pawelczak’s article is a legal history of British jurisdiction in mid-late nineteenth-century Zanzibar. It examines one of the facets that underpinned European influence in the western Indian Ocean World before the establishment of colonial rule. In sum, this issue uses two key threads to shed light on the complex relationships between European and other Western powers and the Indian Ocean World.
