Objective: This article aims to discuss the enforcement of customary law in North Maluku, the deliberation value in the BMA Sultanate of Ternate, and the implementation of customary criminal sanctions by the Badan Musyawarah Adat.Methodology: The methodology used in this study was legal research conducted in a non-doctrinal qualitative approach. In this study, the law is not only conceptualized as all the principles and rules that regulate human life in society but also includes institutions and processes that actualize the validity of these rules in society.Findings: Law enforcement of fisheries crimes is based on the provisions of Indonesian Law No. 45 of 2009 concerning Fisheries. Criminal provisions are regulated by Articles 84 to 104. One of them is about sinking the ship used to commit fishing crimes. Sanctions given to the fish theft (illegal fishing) perpetrators in territorial waters that have been determined by the local customary head are 1) warning; (2) monetary charges according to the agreement of the local customary community; and (3) boat (pajeko in Ternate) or motorboat seized by the sultanate to be used by the community through profit sharing.Utility: Customary Institute of Ternate Sultanate in 2018 has decided on three cases in the Kao bay area concerning fish catching. Besides the traditional law enforcement that is implemented by the Sultanate, North Maluku recognizes Sasi Customs (Adat Sasi), which is regulation of tradition that limits people for catching fish or taking other sources in a certain type and particular period. Thus, the ecological balance is still maintained.Novelty/Originality: The concept of transcendental law enforcement is substantially in line with the values in the Segulaha tradition that has been applied for a long time in North Maluku. In Segulaha customary law, there is a traditional element in a person who has the same soul with transcendental values by positioning revelation as the source of the law. Keywords: Law Enforcement, Fisheries Crimes, Transcendental Approach

Speaking of corruption is being aggressively reviled by various circles of society , people no longer trust law enforcement corruption . With a variety of reasons escape corruption charges. Is this making people more amused components against corruption . Born as a result of the impact of corruption is very dangerous , one of which the decline of the national economy . Anti-corruption efforts solely through the prosecution of corruption , whereas the present moment awareness need everyone to obey the law of corruption .The perpetrators of corruption in Samarinda always hide behind the policies and provisions contained in the legislation governing the authority of an agency or official , so as though everything is a discretionary authority .This type of research used in this paper is an empirical legal research methods with qualitative approach to analyze the data that refers to the rules and regulations perudang . So as to obtain an overview of the impact of corruption in public life , analyze and formulate on law enforcement corruption , and to analyze the factors that affect the law enforcement corruption in the city of Samarinda

Adultery that in terms of customary criminal law known as drati karma a deviant act and violates decency offense under customary law. It is considered a serious offense and is a destructive act of moral and behavior that damages the harmony and balance, causing impure state (cuntaka). From the description that has been proposed, as for the formulation of the problem that arises in this paper is: "Does Crime Decency act in the field of ethics (Adultery) who had been sentenced to criminal sanctions in accordance with the Criminal Code may also be subject to criminal sanctions custom?" This type of research used in this research is the research journal of law by using the approach of normative aspect in this case means that the laws of science research using normative legal research. Normative legal research done through the inventory of positive law as a basic introduction before conducting research activities. The study results showed that the process of law enforcement by law enforcement officers in the enforcement of national legislation (the Criminal Code) and village that enforce local village who was born based on local wisdom each more attention and importance of concepts of justice. Legal certainty is applied based on the Law and the Constitution of the Pancasila. Law enforcement does not mean sanctions but tends to give priority to justice (Restorative Justice) so that the public at large can understand, be aware of and comply with applicable norms.

Land in human life has a very important role because it is a source of welfare, prosperity and life. In addition, land has a close relationship with humans because land has economic value for human life and can produce natural resources for many people. There are 2 (two) rights to land in customary law, namely the right to land controlled by individuals and the right to land controlled by customary law communities or customary land. Based on this, the formulation of the problem can be taken as follows: (1) How is the existence of the village yard land in the awig-awig of Sulahan Traditional Village, Susut District, Bangli Regency? (2) How is the settlement of a village yard land dispute case in the Sulahan Traditional Village, Susut District, Bangli Regency? The research method used is empirical legal research, namely legal research which functions to see the law in a real sense and to examine how the law works in society. The approach to the problem used is in the form of a sociology of law approach, which is a legal research that examines legal facts that exist in society. The results showed that the settlement of village yard land disputes in the Sulahan Traditional Village was usually resolved by kinship with Bendesa Adat acting as the mediator. Mediation carried out by Prajuru of Sulahan Traditional Village in resolving village yard land disputes that occurred in Sulahan Traditional Village was carried out at Pura Desa Sulahan. The purpose of the mediation was carried out at the Sulahan Village Temple because of its strategic location. Before conducting mediation, the Prajuru Desa Adat and the disputing parties will hold a prayer first so that the mediation can run smoothly so that there are no disputes.

The number of corruption cases in Indonesia that are not appropriately resolved is the cause of the emergence of progressive laws. Public trust in the law began to fade because the applicable law did not determine many problems. The law is not seen as a solution provider, and it becomes a particular problem for law enforcement. This article aims to analyze the concept of recovering state losses due to corruption through the implementation of progressive law. The method used is normative legal research using a qualitative approach. This article concludes that progressive law enforcement to eradicate criminal acts of corruption lies in harmonizing the values contained in society and then realizing those values into reality, where their application is influenced by several factors, including legal substance, legal structure, culture law, professionalism, and leadership. The development of the modus operandi of corruption in hiding assets resulting from corruption encourages the urgency of implementing a progressive law enforcement strategy by implementing 2 (two) strategic steps, namely: a) Taking rule-breaking actions in the form of seizure of the defendant's assets to guarantee payment of state losses; b) The judge gives a contra legem decision in the form of an obligation to pay replacement money without a subsidiary which is preceded by confiscation of the guarantee so that it will close the defendant's room to escape from paying replacement money

Ketuhanan Yang Maha Esa ditempatkan sebagai sila pertama Pancasila. Implikasinya, pembaharuan, pembentukan, dan penegakan hukum di Indonesia harus bersumber pada nilai yang terkandung di dalam sila pertama tersebut. Penelitian ini bertujuan untuk secara filosofis menganalisis ontologi, epistemologi, dan aksiologi ilmu hukum berketuhanan. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan filosofis dan konseptual. Hasil penelitian ini mengungkap bahwa hakikat ilmu hukum berketuhanan adalah ilmu hukum yang dikembangkan berbasis pada nilai-nilai ketuhanan. Ia bukanlah ilmu hukum yang sekuler yakni ilmu hukum yang melepaskan diri nilai-nilai moral dan agama, melainkan ilmu hukum yang menjadikan nilai-nilai moral dan agama sebagai fondasi dalam pembaharuan, pembentukan, dan penegakan hukum. Kebenaran pengetahuan menurut ilmu hukum berketuhanan beranjak dari kebenaran firman Tuhan yang diwujudkan dalam bentuk nilai-nilai Pancasila yang selaras dengan nilai-nilai budaya bangsa Indonesia. Kebenaran di sini tidak hanya mengacu kepada kebenaran korespondensi, kebenaran koherensi, dan kebenaran pragmatis, tapi juga menjadikan ketiganya menyatu di bawah payung kebenaran ilahiah. Sedangkan nilai yang hendak diwujudkan oleh ilmu hukum berketuhanan sedemikian komperensif yang memuat semua nilai-nilai bangsa Indonesia baik yang religius maupun yang kultural. Nilai-nilai ini sudah dipraktikkan sejak lama oleh bangsa Indonesia sebelum merdeka. Meskipun nilai-nilai itu universal dan abstrak, tapi ia sudah mendarah daging dan menjiwai kehidupan sehari-hari bangsa Indonesia.Believing in the only and one God is set as the first pillar of Pancasila. This will have an implicate that the law reform, law making, and law enforcement must refer to the values. This article is aimed at analysing the ontology, epistemology, and axiology of God law. This research is normative legal research, white the approach used is both philosopical and conceptual. This article reveals that the essence of God law is the law founded by the values of God. It combines the values of morality and religion. The truth of knowledge stands from the truth of Gods sayings and is manifested in the form of values of Pancasila which are in accordance with the cultural values of Indonesia. The absolute truth of Gods sayings is a combination of correspondence, coherence, and pragmatic rightness. Finally, the value directed by the Gods law is so comprehensive consisting all Indonesian values religiously and culturally which have been practised at long time. Although these values are universal dan abstract, they have been embedded in the soul and daily life of Indonesian people.

This article discusses the law enforcement against illegal fishing by foreign-flagged vessels in Indonesia’s exclusive economic zone. Because the criminal sanctions in the form of fines are very low and there is no threat of imprisonment, the current laws carry little weight with illegal fishermen. This study makes the case for increasing the fines substantially to act as a deterrent. Using the established legal method (involving a statute approach and a conceptual approach), this study makes the case for increasing the fines substantially to act as a deterrent. شهد تاريخ الأمة الإسلامية حضارة ونهضة عالمية في جميع مجالات الحياة الإنسانية، ومما كان له كبير الأثر في ذلك هو الأوقاف التي بدأت مع سيد البشرية محمد صلى الله عليه وسلم واستمرت بتنوع وشمولية إلى عصرنا الحالي؛ ولكن ما تعرضت إليه الأوقاف من إهمال وإقصاء وضياع يرجع لأسباب عديدة من أهمها غياب التوثيق الوقفي. تقوم الدراسة على تتبع مفهوم الوقف والتوثيق، والوقف في الإمارات العربية المتحدة ول سيما في إمارة الشارقة. توصلت الدراسة إلى نتائج منها: أن الأوقاف قائمة منذ زمن بعيد، وأن رغبة الواقف بالوقف وإقدامه عليها لم ينقصها سوى وثيقة، وأنه لا وثائق لها ولا مستندات، كما أن العرض الموجز لنشأة دائرة الأوقاف بالشارقة وسعيها لإحياء سنة الوقف ونشر ثقافته نراه يتضح شيئاً فشيئاً من خلال تفعيل مواد القانون والبحث حول الأنسب والأصح لحماية الأوقاف، ولم يكن هذا الاهتمام بالوقف إلا انعكاساً لتوجه الواقفين وتماشياً لرؤية الحكام وامتثالاً لنهج خير الأنام ورغبة في تكافل الأرواح وحباً للسلام. الكلمات المفتاحيّة: الوقف، التوثيق، المقارنة، الشارقة. Abstract The history of Islamic nation has witnessed a global civilization and it has had a great impact in all areas of human life, including the endowments that began with the master of humankind; Muhammad S.A.W. and it was continuing in diversity and comprehensively until our epoch. However, there are some problems related to endowment management such as negligence, exclusion and loss that due to many reasons. Among the most important reasons is the absence of endowment documentations. Therefore, the study aims to discuss the concept of endowment and documentation, as well as the endowment in United Arabic Emirates, especially in the Emirate of Sharjah. The study concluded that the practice of endowment has been existed for a long time, yet there are in need of endowment documentations. This study also found that the information related to the establishment of institution of endowment in Sharjah and its role has   spread widely to the people through the enforcement of the law and the implementation of the research related to the practice of endowment in order to sustain them in a good way. This documentation system was only a reflection of what has  stated in Shariah laws regarding the practice of endowment among the donors, so that it will be in line with the approach of good intentions and love of peace. This research aimed to: (a) obtain the forms of copyright infringement of songs and/or music (with or without lyrics); (b) understand the role of the police, in this case the Police Precinct, in the law enforcement; (c) identify the factors that influenced the law enforcement. The research method used the normative-empirical legal research, with the initial stages of specifying norms in order to get the proper picture, and then specifying empirical events in order to get the real picture. The research results showed several matters: 1) The forms of copyright infringement of songs and/or music (with or without lyrics) found included: the distribution of the works or the copies, the performances of the works, and the announcements of the works; 2) Police Precinct did notultimately carry out their role as a law enforcer for the copyright infringement of songs and/or music (with or without lyrics); and 3) The factors that influenced the law enforcement on the copyright infringement of songs and/or music (with or without lyrics), namely: legislation factor, in the matter of complaint offenses; law enforcement factor, in terms of the capacity of members; less supportive factor of facilities and infrastructure; legal awareness factor, in the problem of the lack of legal counseling; and cultural factor, related to the differences in norms in the copyright law between those in society and those in regulations.

Customary law is the law of life (living low) that grow and develop in the midst of the community in accordancewith the development of society. Customary law who live in midst of ethnic Indonesia is very strategic to be knownand understood by law enforcement officials, legal observers and guidance in applying the appropriate legal andfair for Indonesian society. The common law does not give the right role and the same degree between men andwomen in life, social, culture, political, economic and domestic life and marriage property and inheritance.Landing directly above the law would cause problems among indigenous peoples, especially the indigenous peopleembrace patrilinieal or matrilineal kinship system, such as that experienced by the Batak people who mbracepatrilineal kindship systems knows in Toba Batak society is patrilineal system, which through the male lineage andis the next generation of his parents while girls not the generation of their parents, as a result of this system is veryinfluential on the position of girls in matters of inheritance.
