Philip Jessup’s life was richly varied. Scholar, practitioner, teacher, administrator, diplomat, judge, prolific writer—he moved from role to role, displaying in each his abundant gifts of character and intellect. Every new job, each fresh subject was a challenge met with zest and high spirits. As a scholar, he was drawn to the issues of the day. He never hesitated to take sides when he felt he had good grounds to do so. In his classes and writings, he was as concerned with practical action as with new ideas. Endowed with a commanding presence, a remarkably resonant voice and a talent for lucid and lively expression, Jessup had no difficulty in getting the attention of an audience. He used concepts sparingly, but effectively, and he avoided windy rhetoric. On the whole, he favored narrative exposition, particularly highlighting the aims and predicaments of the individual actors. People, it seems clear, were more real to him than the abstractions of law or political theory. He was a stickler for thorough and detailed research, as his judicial opinions and books show. Concrete, unique facts were important to him; he had to get them right. Historical detail and revealing quotations were used by him with telling effect.

This article uses the constructivist political theory to explain individual, state and non-state actors’ relationships with a warming Arctic. At the individual level, constructivism explains why the author studies the Arctic, even though there is no apparent, rational interest to do so. At the State level, constructivism can explain the different behaviours adopted by the States towards the fast-warming Arctic, which constantly adapt to specific social context and norms. Finally, constructivism thus highlights that non-State actors play a substantial role in international relations, because they influence social norms and meanings.

The communication of moral reasoning in medicine can be understood as a means of showing respect for patients and colleagues through the giving of moral reasons for actions. This communication is especially important when disagreements arise. While moral reasoning should strive for impartiality, it also needs to acknowledge the individual moral beliefs and values that distinguish each person (moral particularity) and give rise to the challenge of contrasting moral frameworks (moral pluralism). Efforts to communicate moral reasoning should move beyond common approaches to principles-based reasoning in medical ethics by addressing the underlying beliefs and values that define our moral frameworks and guide our interpretations and applications of principles. Communicating about underlying beliefs and values requires a willingness to grapple with challenges of accessibility (the degree to which particular beliefs and values are intelligible between persons) and translatability (the degree to which particular beliefs and values can be transposed from one moral framework to another) as words and concepts are used to communicate beliefs and values. Moral dialogues between professionals and patients and among professionals themselves need to be handled carefully, and sometimes these dialogues invite reference to underlying beliefs and values. When professionals choose to articulate such beliefs and values, they can do so as an expression of respectful patient care and collaboration and as a means of promoting their own moral integrity by signalling the need for consistency between their own beliefs, words and actions.

Other People’s Struggles is the first attempt in over forty years to explain the place of “conscience constituents” in social movements. Conscience constituents are people who participate in a movement but do not stand to benefit if it succeeds. Why do such people participate when they do not stand to benefit? Why are they sometimes present and sometimes absent in social movements? Why and when is their participation welcome to those who do stand to benefit, and why and when is it not? The work proposes an original theory to answer these questions, crossing discipline boundaries to draw on the findings of social psychology, philosophy, and normative political theory, in search of explanations of why people act altruistically and what it means to others when they do so. The theory is illustrated by examples from British history, including the antislavery movement, the women’s suffrage and liberation movements, labor and socialist movements, anticolonial movements, antipoverty movements, and movements for global justice. Other People’s Struggles also contributes to new debates concerning the rights and wrongs of “speaking for others.” Debates concerning the limits of solidarity—who can be an “ally” and on what terms—have become very topical in contemporary politics, especially in identity politics and in the new “populist” movements. The book provides a theoretical and empirical account of how these questions have been addressed in the past and how they might be framed today.

The purpose of the concluding chapter is to review and draw some conclusions from all that has been covered in previous chapters. To do so, it first summarizes the MacIntyrean virtue ethics approach, particularly at the individual level. It then reconsiders the organizational and managerial implications, drawing out some of the themes which have emerged from the various studies which have been explored particularly in Chapters 8 and 9. In doing so, the chapter considers a question which has been implicit in the discussions to this point: how feasible is all of this, particularly for organizations? In the light of that, it revisits the earlier critique of current approaches to organizational ethics (Corporate Social Responsibility and the stakeholder approach), before concluding.

This chapter presents a reading of Plato’s Republic. The Republic is among Plato’s most complex works. From its title, the first-time reader will expect a dialogue about political theory, yet the work starts from the perspective of the individual, coming to focus on the question of how, if at all, justice contributes to an agent’s happiness. Only after this question has been fully set out does the work evolve into an investigation of politics—of the ideal state and of the institutions that sustain it, especially those having to do with education. But the interest in individual justice and happiness is never left behind. Rather, the work weaves in and out of the two perspectives, individual and political, right through to its conclusion. All this may leave one wondering about the unity of the work. The chapter shows that, despite the enormous range of topics discussed, the Republic fits together as a coherent whole.

AbstractIn his most recent work, John Rawls argues that political theory must recognize and accomodate the ‘fact of pluralism’, including the fact of religious diversity. He believes that the liberal commitment to individual rights provides the only feasible model for accomodating religious pluralism. In the paper, I discuss a second form of tolerance, based on group rights rather than individual rights. Drawing on historical examples, I argue that this is is also a feasible model for accomodating religious pluralism. While both models ensure tolerance between groups, only the former tolerates individual dissent within groups. To defend the individual rights model, therefore, liberals must appeal not only to the fact of social pluralism, but also to the value of individual autonomy. This may require abandoning Rawls’s belief that liberalism can and should be defended on purely ‘political’, rather than ‘comprehensive’ grounds.

AbstractModern mobile devices place a wide variety of sensors and services within the personal space of their users. As a result, these devices are capable of transparently monitoring many sensitive aspects of these users’ lives (e.g., location, health, or correspondences). Users typically trade access to this data for convenient applications and features, in many cases without a full appreciation of the nature and extent of the information that they are exposing to a variety of third parties. Nevertheless, studies show that users remain concerned about their privacy and vendors have similarly been increasing their utilization of privacy-preserving technologies in these devices. Still, despite significant efforts, these technologies continue to fail in fundamental ways, leaving users’ private data exposed.In this work, we survey the numerous components of mobile devices, giving particular attention to those that collect, process, or protect users’ private data. Whereas the individual components have been generally well studied and understood, examining the entire mobile device ecosystem provides significant insights into its overwhelming complexity. The numerous components of this complex ecosystem are frequently built and controlled by different parties with varying interests and incentives. Moreover, most of these parties are unknown to the typical user. The technologies that are employed to protect the users’ privacy typically only do so within a small slice of this ecosystem, abstracting away the greater complexity of the system. Our analysis suggests that this abstracted complexity is the major cause of many privacy-related vulnerabilities, and that a fundamentally new, holistic, approach to privacy is needed going forward. We thus highlight various existing technology gaps and propose several promising research directions for addressing and reducing this complexity.

This article explores the relation between ownership and sustainability on a conceptual level. It specifically examines different imaginaries of sustainable property by asking how private property rights and their restrictions are conceptualized as instruments for sustainability. To do so, conflicting notions of property that underlie Western jurisprudence and political theory are contrasted. This brings us to the identification of two major traditions in property thought that build on atomist or relational conceptions of society and property, respectively. Property might be conceived as an owner’s exclusive control over an object, or as a ‘bundle of rights’ that comprises entitlements, restrictions, and obligations to various actors. Largely within the paradigm of modernization as a trajectory of sustainability, these two fundamental traditions in property theory relate to different approaches to encode sustainability into property law: i) propertization, i.e. the extension of private property forms, as in the case of carbon emissions trading schemes; ii) the acknowledgment of social and environmental obligations inherent to property, illustrated by the social obligation norm in German law.

During the mid-nineteenth century American physicians were greatly troubled by what they thought were the evils of excessive academic demands placed on children in our public schools. The editorial below, published in 1854 in the Boston Medical and Surgical Journal, is typical of many of a similar nature. Our city prides itself on the superiority of its public schools; and we think Boston is justly entitled to take the highest rank among the cities of the civilized world for the facilities afforded by its citizens for the education of youth. But notwithstanding the large expenditure of money for the erection of beautiful and commodious school-houses, for mathematical and other instruments, for teachers, &c., all which give a character to our Boston schools, there exists an evil in the present system of educating, which seriously demands attention, and, if possible, a remedy. It is the ambition of the teachers of our schools, to have their scholars thoroughly instructed, and that they may appear well before the committees at examinations; and for that purpose, lessons in great numbers and requiring toilsome study, are imposed upon them. No discrimination is made, as regards the mental or physical capacity of the individual members of the class, but all are required to be perfect in their answers, or else they lose their position in the class and school. Not one fifth of the time devoted to school hours is allowed for study, being occupied in recitations; and the severe tasks the poor children have in getting their lessons must be apparent, when it is known that so long a time is required in reciting them. The scholars of the second class, for instance, have to commit to memory from twelve to twenty-five pages of geography, three to six pages of arithmetic, the same of grammar, three pages in spelling, besides exercises in reading, writing, &c. Now these lessons must be studied out of school, at the time which should be devoted to exercise and recreation. The imposition of such severe tasks upon the young and growing children, must enfeeble their constutions, and often incapacitates them, if they arrive at maturity, for enjoying life. We have seen many children who were ambitious to accomplish all that was required of them by teachers; and to do so, the greatest portion of the twenty-four hours was necessarily devoted to their books, scarcely allowing any time for taking their meals. It must be obvious to every one, that such close application to study, produces, in their turn, a train of diseases which cannot always be eradicated. Aching heads, loss of appetite, sleepless nights, inflamed eyes, with other deviations from health, are the accompaniments and the consequences of excessive mental exertion.

The main purpose of the study is to investigate the possible effect of school teachers’ collaborative networks on their individual innovativeness and the innovative school climate. In addition, 174 Greek primary school teachers’ views were explored about their collaboration networks (three collaboration types), their perceived individual innovativeness, the possible existence of innovative school climate, and the support they received in order to promote and/or produce new ideas and practices. Results showed that most of the participant school teachers belong to two categories of the five in the individual innovativeness scale, the early adopters and the early majority, although 20% belongs to innovators. Teachers’ collaboration network types affect innovative school climate and their individual innovativeness, but there were not found correlation between innovative school climate and perceived teachers’ innovativeness. However, collaborative networks within school have a higher effect on teachers’ innovativeness, and innovative school climate can be predicted by the network within school and among schools, as well as by the support that school teachers receive. <p> </p><p><strong> Article visualizations:</strong></p><p><img src="/-counters-/edu_01/0671/a.php" alt="Hit counter" /></p>
