The draconic character of German National Socialist legislation on political crime has been brought forcibly to public attention by the recent activity of the People’s Court (Volksgericht), which was established last year for the purpose of assuring a more effective repression of treason and espionage. The subject is one of international concern, since the court has jurisdiction over aliens for acts committed abroad as well as upon German territory, and applies a law which is almost unparalleled at the present time in its severity and comprehensiveness. The safeguards commonly deemed essential to the protection of the accused are absent from the proceedings of the Volksgericht, which are secret as to indictment, investigation and trial.

The law concerning misrepresentations inducing contracts has been the subject of criticism for some years, and in 1959, the then Lord Chancellor, Viscount Kilmuir, referred the matter to the Law Reform Committee. Their Report, published in 1962, had a mixed reception. A learned commentator, writing in this journal, gave it a rather chilly welcome, on the ground that it went too far; on the other hand, Mr. Diamond, writing in the pages ofLaw Reform Now, complained that the Report did not go far enough, and suggested that the subtle distinction between a mere representation and a term of the contract should be abolished. In 1967 the Misrepresentation Act was passed, to give effect, with certain modifications, to such of the recommendations of the Law Reform Committee as had not yet been implemented.

As I believe I was the first to draw public attention to the absence of all contemporaneous authority for the derivation of the badge and motto of the Prince of Wales from the personal insignia of John King of Bohemia, slain at the battle of Cressy, and to express my doubts in consequence respecting such an origin, I read with much pleasure the interesting paper of Sir N. Harris Nicolas, in the last published part of the Archæologia, and now venture to offer a few remarks in further illustration of the subject.

The appalling loss of life and property resulting from the sinking of the Titanic served to direct public attention both here and abroad not only to the laws which should provide the safeguards of navigation, but also to the incidence of liability for accidents upon the high seas. The former subject has been dealt with in an interesting paper published in this Journal. We here propose to discuss the application to foreign ships, of the United States rule of the limitation of the shipowner’s liability, the foreign law upon the subject and the significance of the international movement for reform through identic legislation in many countries.

The provisions at issue in the draft Restatement of Copyright Law on which ALI membership will vote at ALI’s upcoming annual meeting are central to copyright doctrine and have been the subject of numerous court decisions over the past several decades of technological and industry change: originality, fixation, categories of copyrightable subject matter, the idea-expression distinction, and authorship and ownership.  This abundance of legal activity on copyright law demonstrates the value to the profession of this project retelling copyright.  In contrast to the dramatic criticism of this Restatement project alleging political capture or illegitimate law reform, the draft’s provisions are routine and straightforward.  They will surprise no one and are almost boring in their adherence to and synthesis of the copyright statute and judicial interpretations of it. Far from being radical or ill-advised, the Restatement of Copyright Law is a reasonable and welcome addition to the work of the ALI. Part I of this Article situates the current Restatement of Copyright Law in the historical context of other ALI projects, drawing parallels in their purposes, processes, and political tensions. Part II describes the controversy over a “retelling” of copyright law as misguided insofar as it fails to account for the practice of interpretation as part of the practice of law that is constrained by professional standards.  Part III describes the analysis and exposition of the provisions of the draft portions of the Restatement of Copyright Law presented to the ALI membership for discussion and vote this year as unremarkable but also beneficial, achieving the ALI’s goals of clarification and simplification of the sprawling federal case law interpreting and applying the 1976 Copyright Act.

Straipsnyje apžvelgiamos Lenkijos Respublikos bau­džiamosios teisės mokslininkų pozicijos dėl nevei­kimo sąvokos ir esmės, nurodoma neveikimo sam­prata, remiantis kauzaline, socialine, finaline veikos teorijomis, taip pat neveikimo sampratos, atskaitos tašku laikant teisinio draudimo charakteristikas, be to, neveikimą analizuojant pagal jo lingvistinę ana­lizę.Autorė straipsnyje analizuoja 1997 m. priim­to Lenkijos Respublikos baudžiamojo kodekso 2 straipsnio nuostatas, reglamentuojančias baudžia­mąją atsakomybę už neveikimu padarytas nusikals­tamas veikas, taip pat pateikia specialiojo nusikalsta­mos veikos subjekto teisinius požymius, remdamasi konkrečiais pavyzdžiais pagal Lenkijos Respublikos baudžiamąjį kodeksą. Straipsnyje daug dėmesio ski­riama ir specialiojo subjekto pareigą veikti reglamen­tuojantiems šaltiniams: įstatymams, sutartims, anks­tesniam asmens veikimui. The following article discuss question of penal liability for omissive offences and concentrates on the subject of a status of a guarantor of not-occurrence the result. In the first part of the article it brings closer an overview of opinions of polish penal law researchers on the nature and definition of an omission. Than the article presents polish regulation of penal liability for omissive offences enclosed in article 2 of Penal Code. After that it describes status of a guarantor in polish penal law. In the end the following paper indicates and describes sources of guarantor’s duty to act, and problems connected with that ca­talogue.

The article analyzes the philosophical category “measure”, which due to its universality and comprehensiveness finds expression in law, since subjective law and legal obligation are always a measure of the possible or necessary behavior of the subjects of legal relations. The relationship of the category “measure” with the institutions of criminal and criminal procedural law is shown. The article examines the demonstrations of this category in the institutions of the penal law, which makes it possible to formulate the definition of a measure in the penal law and systematize the existing ones. There is revealed the need to change the subject of the penal law as a branch of law in connection with the empowerment of criminal executive inspectorates with the authority to implement measures of procedural coercion, provided for by the Criminal Procedure Code of the Russian Federation.

Norwegian museums have been the subject of a great deal of public attention in recent years. Unfortunately, this is not because of their interesting, compelling and thought-provoking exhibitions, but because of poor preservation practices and deteriorating collections. Previous reports have highlighted numerous failings in the management of these collections. A large portion of the collections has suffered through decades of poor storage. Some objects have even been damaged as a result of unacceptable storage conditions. Proper management of the collections has been hampered still further by the lack of common management systems. In the past ten to fifteen years, several projects have been launched in order to enhance collection management and to make the collections more accessible to the public. In this paper, we give a brief outline of the history of collections. We also provide a critical review of the projects and offer some suggestions as to what museums can do to further improve access to and the preservation of collections.

The development and current state of the linguistic landscape – the case of the Wymysorys languageWymysorys is a micro-language with Germanic roots spoken by the residents of Wilamowice, a small Silesian town located between Oświęcim and Bielsko-Biała, where it was brought by settlers from Western Europe in the thirteenth century. It has been the subject of scholarly interest among specialists in a number of fields, not only linguistics and ethnology, since the early twentieth century. Following a ban issued by local authorities in 1945, the use of Wymysorys was prohibited and public manifestations of local culture were severely punished. This policy resulted in a drastic decline of the number of its users. The recent interest of researchers is focused not only on the documentation of Wymysorys or its sociolinguistic situation in the past and today, but also on the effects of its revitalization in the last decade. Despite the lack of institutional support, the users’ community has been engaged in grass-roots initiatives leading to the emergence of Wymysorys in the cultural landscape. Recent activity of its users indicates that the language has already spread beyond the circles of local activists and, after years of persecution, functions again in society, evolving and taking new forms. Rozwój i stan krajobrazu językowego – przypadek języka wilamowskiegoJęzyk wilamowski, którym posługują się mieszkańcy Wilamowic (wym. Wymysoü), od początku XX wieku interesuje naukowców wielu dziedzin – nie tylko lingwistów i etnologów. Został on przywieziony przez osadników z Europy Zachodniej w XIII wieku na teren obecnych Wilamowic – małego miasteczka na Śląsku leżącego między Oświęcimiem a Bielskiem-Białą. Na skutek zakazu wydanego przez władze lokalne w 1945 roku używanie wilamowskiego było zabronione, a wszelkie publiczne przejawy odmiennej kultury ostro karane, w związku z czym liczba użytkowników wilamowskiego zaczęła drastycznie maleć. Zainteresowanie badaczy ostatnimi czasy wzbudza nie tylko kwestia dokumentacji tego mikrojęzyka o germańskich korzeniach czy stan etnolingwistyczny. Obserwacji podlegają również obecne efekty zaaplikowanych w ostatniej dekadzie procesów rewitalizacji językowej i zmiany lokalnej, a także państwowej polityki językowej. Mimo braku instytucjonalnego wsparcia, społeczeństwo użytkowników oddolnie podejmuje inicjatywy, których efektem jest między innymi pojawianie się wilamowskiego w krajobrazie kulturowym. Ostatnie działania użytkowników języka świadczą o tym, że opuścił już kręgi lokalnych aktywistów i ponownie, po latach zakazu, funkcjonuje samodzielnie w społeczeństwie, ewoluując i przybierając nowe formy.
