During the sixteenth, seventeenth and eighteenth centuries, when absolute monarchy was the prevailing governmental type in Europe, the principle was very generally held by the rulers, and not infrequently acted upon, that the people of a state, together with their lands and other goods and chattels, were, in a very real sense, the property of their king and constituted his patrimonium. That this view should have prevailed, is historically explainable. The entire feudal system, out of which the modern monarchy had evolved, was founded upon the idea that the ownership of land carried with it, as one of its incidents, the right of political rulership. When, then, by a process of development, the king had obtained a supremacy over his feudal lords, when his “peace” had become higher than theirs, and had extended over the whole country, and when these lords and those who in turn held of them were forced to concede that they held their lands by a conditional grant from the king, their liege lord, the idea that the monarch was the owner of the entire realm was complete. In him lay the final legal title to all land. All other persons had “tenures” rather than rights of ownership. And, as for the people themselves, the idea that one person might be another person's “man” or “woman” was universal. The influence of these ideas on recent political conceptions may be indicated by recalling that serfdom did not disappear from Germany until well into the nineteenth century.This patrimonial conception of monarchy explains the accepted idea that the throne might be inherited, or willed away by testament, like a piece of property, and that it might be bought and sold, and acquired by marriage. It explains also the recognized right of the king to requisition, upon occasion, the goods of his subjects, and even to sell those subjects themselves to foreign powers, as, for example, was done when the Hessian soldiers were sold by their ruler to England for use against the Americans in the Revolutionary War.

The Sadgapas and the Tilis, two Bengali castes broke with their parent castes. They formed themselves into new castes which gained higher social status than their parent castes in terms of the local caste hierarchy in Bangal. The emergence of the Sadgopa caste, as distinct from the Tilis, occurred at a period when none of the technological, political, and intellectual developments had yet occurred in Bengal that are generally used to characterize modernization. They were established as a caste by the second decade of the nineteenth century while the history of their growth and development goes back to the second half of the sixteenth century. On the other hand, the Tili movement took an extensive form in the second half of the nineteenth century. The Tilis receives wider social recognition as a caste during the third and fourth decades of the twentieth century. The Tili movement was accelerated by modern conditions. Apparently the external factors helping social mobility varied from the case of the Sadgopas to that of the Tilis. But there are certain common features of development in both cases. Both the Sadgopas and the Tilis had collectively abandoned their traditional occupation to switch over to comparatively more lucrative and prestigious occupations, and became landowners. Complete dissociation from the traditional occupations which identified them with lower social ranks made it easier for the Sadgopas and the Tilis to aspire for better social status. But the crucial factor in their movements for mobility was ownership of land, which enabled them to have direct control over the life of the people in their respective areas and enhance their social prestige and power. This was the source of their strength as distinct groups and die source of their collective power to bargain successfully with the rest of the society for higher status. The incentive of corporate social mobility originated, both under traditional, pre-modern circumstances and under the circumstances of modernization, from the achievement of each group of a sense of corporate solidarity, regarding internal as well as external prestige. This enabled the groups to break away from the parent castes and to form new castes with higher social status. Previous writing on the subject has made this corporate solidarity a function of response to external forces, which are identified with only factors of modernization. It is the contention of this paper that corporate solidarity could have had its genesis in prcmodern times as well and that modernization marked only its acceleration.

This article aims to analyse the “per viam instantiae” cases in the matrimonial jurisdiction of the Reformed Church in Transylvania. Until the introduction of civil marriages in 1895, denominations had the right to declare the marriage of their members in Transylvania in the second half of the nineteenth century. All this time, in the motherland, these cases fell under the jurisdiction of civil courts, and the canon law did not recognise the dissolution of marriage. Therefore, it was easier to get divorced in Transylvania than in the other parts of the Austro-Hungarian Empire. Due to this difference between the rules in the field of matrimonial law, the matrimonial courts of the protestant churches were the goal and an opportunity for the people who wanted to get divorced.

This article focuses on Michel Maxwell Philip’s mid-nineteenth-century novel Emmanuel Appadocca (1854), which draws upon the cultural institution of carnival to critique British colonialism and advocate for the right of free people of colour to hold positions of power in Trinidad’s government. Philip enhances his characters’ protests against British colonialism and preserves the carnival revellers’ spirit of resistance and rebellion through allusions to the pirate, Red Indian, and military masques of early Trinidad carnival. This is particularly evident in one radical scene in which a pirate ship known as the Black Schooner masquerades as an English wreck in front of an actual English man-of-war, confronting England with an image of its own vulnerability and future defeat. Applying Mikhail Bakhtin’s theory of utopian carnival, I argue that the image of the triumphant Black Schooner bursting forth from its disguise figuratively represents a united Trinidad replacing England as a world power. However, when Philip uses the diverse pirate crew rather than the pirate ship to symbolize Trinidad, the path to unification and power becomes far less utopic. The second half of this article suggests that Philip presents the pirate captain as a strong brown leader capable of ruling the people, in part through his strategic use of carnivalistic “days of pleasure”. Using the safety-valve theory of carnival, I suggest that the days of pleasure aboard the Black Schooner actually reproduce contemporary social and racial inequalities. Thus, Philip harnesses the disruptive power of carnival to construct a powerful critique of British colonialism, but also, in a far less liberating way, views the “days of pleasure” as a mechanism to control and subdue the people.

Purpose. The purpose of the article is to analyze and systematize the views of social and political thinkers of Galicia in the 19th - beginning of the 20th centuries. on the right and manner of organizing a nation-state as a cathedral. Method. The methodology includes a set of general scientific, special legal, special historical and philosophical methods of scientific knowledge, as well as the principles of objectivity, historicism, systematic and comprehensive. The problem-chronological approach made it possible to identify the main stages of the evolution of the content of the idea of catholicity in Galicia's legal thought of the 19th century. Results. It is established that the idea of catholicity, which was borrowed from church terminology, during the nineteenth century. acquired clear legal and philosophical features that turned it into an effective principle of achieving state unity and integrity. For the Ukrainian statesmen of the 19th century. the idea of catholicity became fundamental in view of the separation of Ukrainians between the Russian and Austro-Hungarian empires. The idea of unity of Ukrainians of Galicia and the Dnieper region, formulated for the first time by the members of the Russian Trinity, underwent a long evolution and received theoretical reflection in the work of Bachynsky's «Ukraine irredenta». It is established that catholicity should be understood as a legal principle, according to which decisions are made in dialogue, by consensus, and thus able to satisfy the absolute majority of citizens of the state. For Galician Ukrainians, the principle of unity in the nineteenth century. implemented through the prism of «state» and «international» approaches. Scientific novelty. The main stages of formation and development of the idea of catholicity in the views of social and political figures of Halychyna of the XIX – beginning of the XX centuries are highlighted in the work. and highlighting the distinctive features of «national statehood» that they promoted and understood as possible in the process of unification of Ukrainian lands into one state. Practical significance. The results of the study can be used in further historical and legal studies, preparation of special courses.


This research article focuses on the theme of violence and its representation by the characters of the novel “This Savage Song” by Victoria Schwab. How violence is transmitted through genes to next generations and to what extent socio- psycho factors are involved in it, has also been discussed. Similarly, in what manner violent events and deeds by the parents affect the psychology of children and how it inculcates aggressive behaviour in their minds has been studied. What role is played by the parents in grooming the personality of children and ultimately their decisions to choose the right or wrong way has been argued. In the light of the theory of Judith Harris, this research paper highlights all the phenomena involved: How the social hierarchy controls the behaviour. In addition, the aggressive approach of the people in their lives has been analyzed in the light of the study of second theorist Thomas W Blume. As the novel is a unique representation of supernatural characters, the monsters, which are the products of some cruel deeds, this research paper brings out different dimensions of human sufferings with respect to these supernatural beings. Moreover, the researcher also discusses that, in what manner the curse of violence creates an inevitable vicious cycle of cruel monsters that makes the life of the characters turbulent and miserable.

The article examines the main forms and methods of agitation and propagandistic activities of monarchic parties in Russia in the beginning of the 20th century. Among them the author singles out such ones as periodical press, publication of books, brochures and flyers, organization of manifestations, religious processions, public prayers and funeral services, sending deputations to the monarch, organization of public lectures and readings for the people, as well as various philanthropic events. Using various forms of propagandistic activities the monarchists aspired to embrace all social groups and classes of the population in order to organize all-class and all-estate political movement in support of the autocracy. While they gained certain success in promoting their ideology, the Rights, nevertheless, lost to their adversaries from the radical opposition camp, as the monarchists constrained by their conservative ideology, could not promise immediate social and political changes to the population, and that fact was excessively used by their opponents. Moreover, the ideological paradigm of the Right camp expressed in the “Orthodoxy, Autocracy, Nationality” formula no longer agreed with the social and economic realities of Russia due to modernization processes that were underway in the country from the middle of the 19th century.

This article aims to find out the developmentidea or paradigm through village financial management based on Law Number 6 of 2014 concerning Villages. In this study, the researcher used a normative research methodby examining the village regulations in depth. Primary legal materials are authoritatuve legal materials in the form of laws and regulations. Village dependence is the most obvious violence against village income or financial sources. Various financial assistance from the government has made the village dependent on financial sources from the government. The use of regional development funds is intended to support activities in the management of Regional Development organizations. Therefore, development funds should be managed properly and smoothly, as well as can be used effectively to increase the people economy in the regions. This research shows that the law was made to regulate and support the development of local economic potential as well as the sustainable use of natural resources and the environment, and that the village community has the right to obtain information and monitor the planning and implementation of village development.

This paper examines the development of modern vaccination programme of Cooch Behar state, a district of West Bengal of India during the nineteenth century. The study has critically analysed the modern vaccination system, which was the only preventive method against various diseases like small pox, cholera but due to neglect, superstation and religious obstacles the people of Cooch Behar state were not interested about modern vaccination. It also examines the sex wise and castes wise vaccinators of the state during the study period. The study will help us to growing conciseness about modern vaccination among the peoples of Cooch Behar district.

Justice that has not existed and is apparent among the disabilities in Indonesia is very large and spread in the archipelago is very large, making the issue of equality is a very important thing especially with the publication of the Disability Act No. 8 of 2016 at the beginning of that year. Only a few provinces that understand properly and well on open and potential issues and issues will affect other areas including the increasingly growing number of elderly people in Indonesia due to the increasing welfare of the people. The government of DKI Jakarta, including the most concerned with disability, from the beginning has set a bold step to defend things related to disability, including local governments in Solo, Bali, Makassar and several other areas. Leprosy belonging to the disability community has a very tough marginalization, the disability that arises from leprosy quite a lot, reaches ten percent more and covers the poor areas of Indonesia, such as Nusa Tenggara Timur, Papua, South Sulawesi Provinces and even East Java and West Java and Central Java Provinces. If we compare again with the ASEAN countries we also do not miss the moment in ratifying the CRPD (Convention of Rights for People with Disability) into the Law of Disability No. 8 of 2016 which, although already published but still get rejections in some sections because do not provide proper empowerment and rights equality. The struggle is long and must be continued to build equal rights in all areas, not only health and welfare but also in the right of the right to receive continuous inclusive education.
