Abstract Brazil has become the epicenter of the COVID-19 pandemic in the Global South-a pandemic that disproportionately affects vulnerable populations, especially those detained and imprisoned. Legal institutions are struggling to respond. In this paper, we focus on the National Council of Justice’s Recommendation 62, issued March 17, 2020, which recommends that judges take several measures to reduce the risk of COVID-19 infection in prisons. We test this recommendation’s impact by looking at habeas corpus decisions in the São Paulo Court of Justice. The exploratory findings presented here indicate that Recommendation 62 has little impact on habeas decisions. In general, citing the recommendation does not lead the Court to grant early release or house arrest to those detained, and most habeas actions are decided against petitioners. This is true even when petitioners claim to be part of a risk group, or their alleged offense did not involve violence or serious threat-factors that should favor habeas relief under Recommendation 62.

Abstract The article aims to advance the understanding of the successive circumvention of regulations by organizations, to determine whether it is possible to characterize them as purposeful actions, while the institutional literature analyzes decoupling and circumvention as sporadic activities. It analyzes the responses adopted by health plan companies to favor their interests, responses that often fail to comply with the rules of the institutional context, and which boosted the phenomenon known as ‘judicialization’. The study analyzed 158 lawsuits collected from the electronic archives of the Court of Justice of São Paulo, where beneficiaries sue health plan companies because of treatment coverage denial. Using correspondence and thematic analysis, some associations between denials and allegations showed to be significant, suggesting companies’ strategic patterns. It was possible to identify different strategic practices adopted by companies to avoid complying with institutional guidelines, and to observe that certain regulatory features can contribute to non-compliance strategies. The article contributes to the institutional literature by identifying organizational practices meant to successively circumvent and confront institutional prescriptions, indicating that health plan companies apparently design specific strategies to respond to beneficiaries’ demands.

O presente artigo é fruto da pesquisa “Maternidades encarceradas e mães livres: “Acesso à justiça e direitos das mulheres presas” e teve por objetivo refletir acerca do acesso à justiça a partir das percepções e experiências  da mãe presa no estado de São Paulo após o implemento do Marco Legal da Primeira Infância (Lei 13.257/16) e Habeas Corpus Coletivo (HC 143641). Foi analisado por método qualitativo entrevistas produzidas pelo IDDD com mulheres que tem a bagagem de exercerem a maternidade enquanto passam pelo sistema de justiça. Com a observação das experiencias buscou-se desprender como a mulher vem sendo tratada pela justiça no que diz respeito a um tratamento que contemple o acesso à justiça e está em conformidade com o Marco Legal da Primeira Infância e o Habeas Corpus Coletivo. A análise das entrevistas permitiu a conclusão de que estamos em um momento de ampliação da proteção do exercício da maternidade por mulheres em situação de prisão, porém o caminho do acesso a esses direitos não foi pavimentado. Ao contrário, subsistem discursos e práticas no sistema de justiça que, paradoxalmente, obstaculizam o próprio acesso à justiça, em um cenário de descaracterização das especificidades da mulher, afastando-as dos seus direitos.

Este artigo explora a diversidade de carreiras no Tribunal de Justiça do Estado de São Paulo (TJSP) para abordar o papel das carreiras jurídicas na resposta das decisões judiciais à reforma do sistema de medidas cautelares penais introduzida pela Lei no 12.403 de 2011. O diploma restringiu as prisões cautelares, exigindo fundamentação e impondo a aplicação prioritária de medidas cautelares alternativas. Sua intenção era frear as crescentes taxas de encarceramento, tema de grande saliência entre os juristas. A constituição brasileira reserva 80% dos assentos em tribunais de apelação para juízes de carreira, 10% para advogados e 10% para promotores. Na prática, porém, as vagas em painéis juntamente com atrasos aumentaram significativamente a participação de juízes substitutos de segundo grau em painéis de apelação – que atuaram como relatores em até 14% de todos os recursos criminais em São Paulo entre 2009 e 2013. Os ex-advogados e procuradores são nomeados pelo governador do estado após processos de nomeação na Ordem dos Advogados do Brasil (OAB) e no Ministério Público (MP). Tais juízes são escolhidos a critério do conselho superior do tribunal, não retêm as prerrogativas dos juízes de recurso efetivos e normalmente são contratados com o objetivo de reduzir atrasos. Seu desempenho afeta suas chances de ser promovidos ao tribunal de apelações, relativamente a juízes semelhantes que não foram designados. Com base em um grande conjunto de dados de recursos criminais relacionados a crimes de roubo no estado de São Paulo, este estudo explora a atribuição exógena de casos a relatores para identificar os impactos da reforma penal contingentes ao tipo de desembargador. Com base em um modelo de escolha discreta que contempla efeitos fixos de órgão julgador e de tempo, analisa-se a probabilidade de decisões favoráveis ao réu em recursos criminais, especialmente nas classes de recurso em sentido estrito, habeas corpus e agravos de execução penal. Busca-se aliviar o problema da seleção de casos excluindo da amostra os recursos distribuídos por prevenção ao magistrado. Os resultados indicam que, a despeito da clara intenção do legislador em reduzir as taxas de encarceramento de réus não julgados, relatores que são juízes substitutos em segundo grau ou que têm origem no MP (quinto constitucional) apresentam resposta à reforma das cautelares fortemente contrária aos interesses dos réus. Discute-se o significado dos resultados à luz de elementos relativos às preferências dos juízes (modelo atitudinal) e também a influência política sobre a justiça, em prol de política criminal vigente.

Background: In light of the few reports from intertropical latitudes and their conflicting results, we aimed to replicate and update the investigation of seasonal patterns of suicide occurrences in the city of São Paulo, Brazil. Methods: Data relating to male and female suicides were extracted from the Mortality Information Enhancement Program (PRO-AIM), the official health statistics of the municipality of São Paulo. Seasonality was assessed by studying distribution of suicides over time using cosinor analyses. Results: There were 6,916 registered suicides (76.7% men), with an average of 39.0 ± 7.0 observed suicides per month. For the total sample and for both sexes, cosinor analysis estimated a significant seasonal pattern. For the total sample and for males suicide peaked in November (late spring) with a trough in May–June (late autumn). For females, the estimated peak occurred in January, and the trough in June–July. Conclusions: A seasonal pattern of suicides was found for both males and females, peaking in spring/summer and dipping in fall/winter. The scarcity of reports from intertropical latitudes warrants promoting more studies in this area.
