A 'Stick' in the World of 'Sunshine and Carrots': Using Binding Arbitration in Global Framework Agreements to Regulate Labour Standards and Multinational Corporations in Global Supply Chains

With the globalisation of supply chains, the respect for human rights and labour standards in procurement practices has become a crucial priority also in the domestic regulation of public procurement. This paper focuses on two specific characteristics of the use of public procurement regulation for the enforcement of human rights and labour standards: its extraterritorial effects on companies and firms across different jurisdictions and its reliance on private certifications and labels. Both of these new aspects are evident within the new 2014 EU Procurement Directives, which includes a number of far-reaching regulatory features that facilitate the monitoring of the respect for human rights and labour standards of contractors and subcontractors across borders. However, this new dimension of public procurement has the potential to create tension within the framework of multilateral trade governance, specifically, the World Trade Organization (WTO) trade regime.

While governance and regulation are a first step in addressing worsening working conditions in global supply chains, improving implementation is also key to reversing this trend. In this article, after examining the nature of the existing governance and implementation gaps in labour standards in global supply chains, we explore how Viet Labor, an emerging grass-roots organization, has developed practices to help close them. This involves playing brokering roles between different workers and between workers and existing governance mechanisms. We identify an initial typology of six such roles: educating, organizing, supporting, collective action, whistle-blowing and documenting. This marks a significant shift in the way action to improve labour standards along the supply chain is analysed. Our case explores how predominantly top-down approaches can be supplemented by bottom-up ones centred on workers’ agency.

This article explores the role that technology plays in creating and fostering transparency in global supply chains. Transparency is deemed vital in the creation of sustainable and resilient supply chains and overall effective corporate governance. There are two distinct orientations toward the use of technology by multinational corporations (MNCs) in creating sustainability transparency within their global supply chains: control and relational. A control orientation views technology as a tool to gather the ever-increasing levels of sustainability data on supplier practices in an efficient, secure, and progressively automated manner. A relational orientation adopts a view where technology is a tool to help build social relations and improve dialogue and collaboration on sustainability throughout the supply chain. A key difference in the two orientations lies in the mindset of the MNC manager toward the development of supply chain sustainability transparency. The article illustrates the effective application of both approaches and offers advice to managers on the design choices they need to consider in choosing technologies.

The COVID-19 pandemic has had a tremendous impact on the business and global investment community. This pandemic differs from the previous ones in that it occurs in the digital age; the epidemiological situation around the world is recorded daily, this allows the one to model the forecasts quite accurately; most companies have the ability to continue working, but to organize it in a remote format. However, one of the devastating factors is that a pandemic destroys global supply chains, disrupts production and can lead to a significant loss of company revenue and adversely affect the global economy. The ability to adapt to these conditions, as well as the speed of this process are important factors for the survival of companies. Corporate governance plays an important role in this process. This article describes the main trends in the organization of corporate governance in a pandemic.

What if those translations across difference that characterize global supply chains were to inspire a model of power and struggle in the contemporary political economy? In contrast to the unified Empire offered by Hardt and Negri, supply chains show us how attention to diversity-and the transformative collaborations it inspires-is key to both identifying what is wrong with the world today and imagining what we can do about it. This article describes a politics in which transformative collaborations across difference form the radical heart of possibility. Nonhumans are involved, as well as people with starkly different backgrounds and agendas. Love might be transformed.

State lockdowns and travel restrictions introduced in response to COVID-19 have limited the ability of frontline responders to conduct on-site visits and inhibited their efforts to assess working conditions and monitor for labour exploitation within global supply chains. These challenges have increased multinational corporations’ reliance on remote technologies to assist in their supply chain due diligence processes. Our research investigates the use of one such example, Apprise Audit, which is a digital solution used for worker interviews in social compliance auditing that was modified to enable remote data collection. Based on a series of interviews with implementing partners and industry experts, our research finds that Apprise Audit Remote helps to overcome the difficulties of gathering worker feedback in the presence of COVID related constraints. Using this work as a case study, we then further elaborate on the practical opportunities and limitations associated with ICT-enabled remote auditing.
