Problems of standardization in the implementation of the provisions of the Technical regulations of the Russian Federation

The book provides the results of a study of standardization in the implementation of national technical regulations of the Russian Federation "About fire safety", "On safety of buildings and structures", "On safety of gas distribution networks and gas consumption, On the safety of marine transport", "On safety of inland water transport" and the Technical regulations on tobacco products. The study was the analysis and correlation of the objects and requirements of technical regulations, the approved lists of documents for standardization adopted in 2016-2020 codes of practice, national, intergovernmental, international and regional standards, codes, national standards, the collection of information on enforcement practices and suggestions from industry stakeholders and generalization of the obtained data. According to the results of the study, the key and organizational and methodological problems of standardization in the field of technical regulation are identified, and current directions for improving standardization and national technical regulations are identified. It is of interest to a wide range of specialists in the field of standardization, technical regulation and public administration, and can be used in the preparation of training programs and manuals for bachelor's, master's, additional professional education and MBA programs.

Inclusive education of people with disabilities today is a fairly popular object of research among a wide range of specialists (sociologists, psychologists, social workers); however, disabilities are far from the only factor of social exclusion, and education is not the only process aimed at increasing the inclusiveness of society. The multidimensionality of social inclusion makes it possible, in the framework of this study, to single out the aspect of inclusive living. This aspect is revealed in the ideas of inclusive design of dwellings themselves and the urban space in general, is ensured by the construction of inclusive housing, and is supported by the inclusive housing policy of the state. Thus, the aim of this study is to identify and conceptualize inclusive living as an aspect of multidimensional social inclusion in the context of the transformation of social and legal institutions in Russia. During the study, the general scientific methods of analysis, synthesis, generalization, comparison, and analogy were used. The theoretical basis of the study was the works of Russian and mainly foreign researchers in the field of inclusive housing policy, inclusive housing, inclusive design, etc. The legal framework for the study was the Constitution of the Russian Federation, the Convention on the Rights of Persons with Disabilities, federal laws of the Russian Federation, resolutions of the Government of the Russian Federation, orders of ministries, national standards, etc. As a result of the study, the authors' definition of the concept of inclusive living is proposed: it is a living socially autonomous from the helping subject, in which each person, regardless of the physical, intellectual and other characteristics, is provided with a socioeconomic opportunity to choose the place of residence (a specific house or apartment) and roommates (regardless of gender and age) they like, and freely interact with neighbors (for example, at general meetings). In the course of the study, some assessment is also given to the transformation of social and legal institutions in Russia aimed at increasing the inclusiveness of the residence of certain social groups (disabled people, elderly people, etc.). In addition, the authors suggest that the inclusiveness of living can be considered as one of the indicators of the quality of life of the population of a particular state, which requires further research on the institutional factors that determine social inclusion or exclusion in this context.

Introduction. At present, there are a large number of obsolete regulatory requirements, including those dating back to the USSR. The President and the Government of the Russian Federation decided to implement the “regulatory guillotine”, within the framework of which, by 1 January 2021, the totality of regulations imposing mandatory requirements must be replaced by new ones, including in the field of education. This goal requires the monitoring of existing laws, identifying their particularities, possible conflicts and gaps. Monitoring Tools. The authors of the paper applied methods of analysis, scientific and regulatory material analysis and synthesis as well as formal and legal, systemic and structural, functional, specific and sociological methods and the method of interpreting legal norms. The object of the study was the decrees of the President of the Russian Federation, decrees of the Government of the Russian Federation, orders of the Ministry of Education and Science and the Ministry of Education of Russia as well as regulatory legal acts of other federal executive bodies adopted on the basis of the federal law on education. Results. The system of legal regulation of education is a structured system of acts of varying legal force, regulating a wide range of public relations. The monitoring results of this legal framework are systematised and presented in a table. Based on the analysis of the data obtained, the following suggestions are made: 1) to merge Order No. 462 of the Russian Ministry of Education and Science dated 14 June 2013 and Order No. 1324 of the Russian Ministry of Education and Science dated 10 December 2013 regulating the field of self-evaluation of educational organisations; 2) to merge Order No. 844 of the Ministry of Education and Science of Russia dated 28 July 2014 and Order No. 1304 of the Ministry of Education and Science of Russia dated 3 October 2014 regulating public relations in the field of granting foreign citizens and stateless persons the right to obtain various levels of education; 3) in terms of defining the measures of state support for students and postgraduate students in higher professional education institutions – to incorporate Presidential Decree No. 1556 of 16 November 1996 into Presidential Decree No. 443 of 12 April 1993; 4) to merge Presidential Decree No. 1198 of 14 September 2011 and Presidential Decree No. 181 of 13 February 2012 establishing scholarships for undergraduate and postgraduate students; to create a new act regulating the procedure for granting state academic scholarships and/or state social scholarships to students. Conclusion. Improvement of the abovementioned specific laws will qualitatively improve the legal regulation of certain aspects of education in the Russian Federation, which will contribute to better legal regulation of the education sector as a whole. The results of the study will also be helpful to lawyers and academics who apply the legislation governing the education system in their professional or academic work.


Currently, the professional construction community information field is largely filled with the topic of creating a comfortable living environment. However, architectural and engineering design that corresponds to the concept of sustainable development is currently hindered due to the lack of a formed conceptual framework that reveals the meaning of the term "comfort", as well as a criteria list that determines the indoor environment quality in the Russian Federation regulatory and technical framework. The article offers some components of a comfortable living environment, within which the parameters of designing the internal environment of premises are highlighted. A comparative analysis of the national standards of the Russian Federation regulating the design of the internal space of residential and public buildings, with international "green" standards for a number of parameters was carried out. It is concluded that it is necessary to update the Russian regulatory and technical base taking into account the international experience of "green" standards.

The existing legislation determines the education as "an integral and focused process of teaching and upbringing, which represents a socially important value and shall be implemented so as to meet the interests of the individual, the family, the society and the state". However, even in this part, the meaning of the notion ‘socially significant benefit is not specified and allows for a wide range of interpretation [2]. Yet the more inconcrete is the answer to the question – "who and how should determine the interests of the individual, the family and even the state?" The national doctrine of education in the Russian Federation, which determined the goals of teaching and upbringing, the ways to attain them by means of the state policy regulating the field of education, the target achievements of the development of the educational system for the period up to 2025, approved by the Decree of the Government of the Russian Federation of October 4, 2000 #751, was abrogated by the Decree of the Government of the Russian Federation of March 29, 2014 #245 [7]. The new doctrine has not been developed so far. The RAE Academician A.B. Khutorsky believes that the absence of the national doctrine of education presents a threat to national security and a violation of the right of citizens to quality education. Accordingly, the teacher has to solve the problem of achieving the harmony of interests of the individual, the family, the society and the government on their own, which, however, judging by the officially published results, is the task that exceeds the abilities of the participants of the educational process.  The particular concern about the results of the patriotic upbringing served as a basis for the legislative initiative of the RF President V. V. Putin, who introduced the project of an amendment to the Law of RF "About Education of the Russian Federation" to the State Duma in 2020, regarding the quality of patriotic upbringing [3]. Patriotism, considered by the President of RF V. V. Putin as the only possible idea to unite the nation is "THE FEELING OF LOVE OF THE MOTHERLAND" and the readiness for every sacrifice and heroic deed for the sake of the interests of your Motherland. However, the practicing educators experience shortfalls in efficient methodologies of patriotic upbringing, which should let them bring up citizens, loving their Motherland more than themselves. The article is dedicated to solution to this problem based on the Value-sense paradigm of upbringing educational dynasty of the Kurbatovs [15].

The article discusses the issues of improving the examination system of competitive applications for state support in the form of grants of the President of the Russian Federation on the basis of an integrated information system that includes the information support system of the Grants Council of the President of the Russian Federation and the information system of the Federal Roster of Scientific and Technological Experts and containing information about experts, applications and expert examination results. In order to improve the principles of transparency and openness of support programs and competition winners, to ensure the objectivity of the competitive selection of projects, a number of organizational and technical solutions are proposed in the application examination system based on an integrated information system. The new and proposed new approaches to the organizational and technical support of the examination of competitive applications for state support in the form of grants of the President of the Russian Federation to young Russian scientists made it possible, by attracting a wide range of scientific and technological communities, to conduct examination of more than five thousand applications with high quality and deadlines set by the Ministry of Education and Science of Russia.

Discussed is the problem of upbringing activities in the system of vocational education. In recent years this problem has not received much attention. To correct this situation, in July 2020 amendments were made to the law “On Education in the Russian Federation” about the problem of upbringing of students. Approved that it is necessary to include a working program of upbringing of students in educational programs. It is proposed that at the beginning the educational organization should develop a generalized program of upbringing of students and a calendar plan of upbringing activities. A variant of the program of upbringing of students at the university is given.

The article deals with the problem of improving the quality of professional training of cadets of military educational institutions of higher professional education of the National Guard troops of the Russian Federation (hereinafter referred to as military universities of the VNG RF), the solution of which determines the level of security of the Russian Federation. In connection with the changes that have occurred in the educational process on the basis of the requirements of the Federal State Educational Standard of Higher Education 3 ++, as well as in the structure of the troops, the need to revise the content of military education, as well as the choice of more effective methods for its implementation, has been identified. After analyzing the current state of affairs, the possibilities of frame methods were studied, the main advantage of which is the intensification of the educational process through the structuring of educational information. The authors have developed frame schemes, the effectiveness of which has been tested experimentally. All this made it possible for the teacher to devote more time to explaining the educational material of a lesson, eliminating the excessive amount of information, and for the cadets - to study the subject in more detail, to comprehend the information received, and then apply these methods in their future professional activities when training the personnel of their unit in the army.
