Securing Pipeline Approvals in a Tough Regulatory Environment

The Regional Municipality of York is located immediately north of the City of Toronto. It is the fastest growing municipality in Ontario. The rapid expansion of residential, industrial and commercial development in the municipality has led to a weakness in the electrical and gas infrastructure. The Ontario Power Authority (the agency responsible for managing the power requirements in the Province of Ontario) has recognized this weakness and has developed plans calling for a new gas-fired generating station and improvements to the electrical grid. The shortages of gas supply and electricity have not developed overnight. Hydro One, which runs the electrical grid, initiated a supply study in 2002. The study recommended upgrading a 115 kV transmission line to a double circuit 230 kV transmission line on the existing corridor. The ensuing public outcry resulted in the municipality passing a resolution against the upgrade. Similarly, a large gas-fired generating station proposal was abandoned as the result of citizen opposition. In 2003, the Ontario Energy Board approved new Environmental Guidelines for the Location, Construction and Operation of Hydrocarbon Pipelines and Facilities in Ontario. The guidelines include specific new requirements for planning pipelines in urban areas. Among other things, these requirements involve the identification of indirectly affected landowners and a more detailed analysis of public issues and how they were resolved. It became clear that in order to achieve regulatory success, not only would the public have to become actively engaged in the decision-making early in the process, the technical reviewers (federal, provincial and municipal agencies) would likewise have to be actively involved. Through the use of two case studies of proposed large-diameter natural gas pipelines initiated in York Region in 2005, this paper describes the techniques used to engage the public and the regulators. It also describes how the public involvement requirements contained in the Ontario Energy Board’s new guidelines were incorporated into the planning process. The case studies begin with a rationale for the study area selected. A description of issues follows. The techniques used to address these issues and the success of the program are documented. Techniques include face-to-face project initiation meetings, use of technical and citizens’ advisory committees, sub-committee meetings to resolve specific issues and site-specific field work. The study results illustrate that it is possible to plan a right-of-way in such a manner as to satisfy the general public and regulators, be compatible with existing development, conform to the new Ontario Energy Board guidelines and minimize the amount of remedial work required to mitigate the impacts occurring on and adjacent to the right-of-way.

The lack of foresight by municipalities and others in preserving corridors for utilities means that there are increasingly fewer opportunities to locate linear facilities in large urban centers such as the City of Toronto. In those corridors that do exist, there are competing land uses that make it difficult to accommodate any new use. Many of these land uses are directly related to the people living adjacent to and in the vicinity of the corridors. In 2003, the Ontario Energy Board approved new “Environmental Guidelines for the Location, Construction and Operation of Hydrocarbon Pipelines and Facilities in Ontario”. The Guidelines include specific new requirements for planning pipelines in urban areas. Among other things, these new requirements involve the identification of indirectly affected landowners and a more detailed analysis of public issues and how they were resolved. Through the use of a case study, this paper identifies the public issues that were encountered in planning the location of a NPS 36 (Nominal Pipe Size 914 mm or 36 inch diameter) natural gas pipeline through residential neighbourhoods in the City of Toronto and the Town of Markham. It also describes how the public involvement requirements contained in the Ontario Energy Board’s new guidelines were incorporated into the planning process. The case study begins with a rationale for the study area selected. A description of the public issues follows. The techniques used to address these issues and the success of the public involvement program that identified 180 directly affected and 3,200 indirectly affected landowners is documented. The study results illustrate that it is possible to plan a right-of-way through an urban corridor in such a manner as to satisfy the general public, be compatible with existing development, conform to the new Ontario Energy Board Guidelines and minimize the amount of remedial work required to mitigate the impacts occurring on and adjacent to the right-of-way.

In this study the involvement of the community during expropriation and the utilization of the compensation money of the expropriated farmers are investigated taking Bahir Dar and Debre Markos peri-urban areas as case studies. Survey research methods were applied for data collection. The data were analyzed by means of descriptive statistics. According to the results, there is high land tenure transformation in both study areas. Even though the majority of the expropriated farmers got compensation payments, most farmers did not use their compensation money to found alternative income generating businesses. Just payment of compensation shall not be an end by itself. Technical and administrative supports for farmers are essential for the proper utilization of the compensation money. Communities affected by expropriation should participate effectively in the processes of expropriation and compensation in order to reduce the externalities of the process. For this to happen, the public authorities should prepare open public consultation meetings prior to expropriation and must exercise smart democracy during the whole period of the process.

The form of Japanese residential architecture throughout its history shows its own uniqueness. The success of the Japanese government to provide housing for its citizens supports the study to know how Japanese residential architecture for the public society happened until today. The study of Japanese residential architecture for the public society was conducted by the descriptive approach. Data were collected through literature study from the history and development of Japanese residential architecture for public society and also done by field observations in Tokyo and surrounding cities. The study results the knowledge about many forms of residential architecture to public society since before the world war until now and provides knowledge relating to the successful provision of public housing so that it can be accepted by the occupants. The study is expected to provide inputs for the development of programs for public housing provision in urban areas in Indonesia.

This study aims to determine the effect of TOD on the phenomenon of gentrification, the phenomenon of urban development and its influence in accelerating the distribution of development. The Maja area in Banten will be used as a case study where in accordance with the 2015-2019 RPJMN the area was also selected as one of the Public New Economic Zones in order to create a city that is safe, comfortable and livable and is expected to break down urban density so that equitable development can be realized. To achieve the objectives of this study, the analytical method that is used is descriptive analysis by comparing the precedents of the TOD concept in existing case studies with the case studies raised, namely the Citra Maja Development Project, in the Maja Region. After that, the validation of the results of the analysis is done so that a conclusion is that the Citra Maja Development Project is a good case to be used as a model for regional development with the TOD concept with the support of other licensing and administrative facilities by the government, thus indirectly suppressing the phenomenon of gentrification occurs in sub-urban areas

Abstract This paper is focused on the role of cultural and creative industries in the regeneration of the inner city of Ostrava. The first part outlines the basic relationship of cultural and creative industries and urban areas in market economies, with emphasis on industrial cities. Ostrava is a post-socialist city, therefore essential characteristics of one are briefly given. The empirical part presents three case studies demonstrating the impact of cultural and creative industries on the regeneration of the inner city of Ostrava. In the conclusion, the case studies are discussed in a comparative perspective with special accent on the role of the public sector as an actor of culture-led regeneration in Ostrava.

One of the environmental problems in urban areas is the pollution caused by garbage. The waste problem is caused by various factors such as population growth, living standards changes, lifestyles and behavior, as well as how the waste management system. This study aims to determine how the role of society to levy payments garbage in Samarinda. This research was descriptive; where the data is collected then compiled, described and analyzed used relative frequency analysis. The participation of the public to pay a "levy junk", which stated to pay 96.67%, for each month and the rates stated society cheap, moderate and fairly, respectively 46.08%, 21.21%, 21.04%. Base on the data , the role of the community to pay "levy junk" quite high.

The increase of population in Kathmandu valley is bringing a considerable change in cropping system. Rapid urbanization and introduction of new agriculture technology have encouraged the valley’s farmers to change their cropping patterns from traditional (low value crops) to new crops (high value crops). According to numerous studies made in Nepal, the change is seen considerably in winter crops than in summer crops and the land under cultivation of green leafy vegetables is increasing rapidly in the urban and semi-urban areas. An average growth of population at 3 % in the valley during the period 1951-2001 has resulted in the rapid expansion of area under urban coverage (24.6 % growth per year from 1984 - 2000) has made agriculture land of Katmandu valley to decline per year by 2.04 % (836.27 ha per year). If this trend of decline in agriculture land in Kathmandu valley continues in future too, it is expected that there will be no agriculture land left over by two and half decades in the valley. The planners should take note of this fact that if fertile land of Katmandu valley is to be preserved for agriculture necessary planning is urgently needed. <i>Nepal Journal of Science and Technology</i> Vol. 7, 2006

Abstract: Based on Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest, the Openness Principle is one of the ten principles as the basis of the implementation of development. This principle is significant because its complex role can lead to conflicts and disputes. In this paper, discussions are divided into two parts: 1) how the implementation is expected to be applied according to the acquisition procedure in theory; and 2) the reality that occurs in the field. The first discussion was conducted by reviewing the applicable regulations and the methods or concepts of development of the openness principle. Meanwhile, the second discussion about the reality on the field was conducted by elaborating case studies regarding problems in land acquisition. The results of this study indicate that there are gaps in the implementation of the openness principle between theory and reality in regards of land scarcity, economic inequality, and information asymmetry among the involved parties. In conclusion, the implementation of the openness principle is significant with the role of information in land acquisition.Intisari: Berdasarkan Undang Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, Asas Keterbukaan adalah salah satu dari sepuluh asas yang menjadi dasar pelaksanaannya. Asas ini menjadi signifikan karena perannya yang kompleks dapat menimbulkan konflik dan sengketa. Artikel ini akan membagi pembahasan menjadi dua bagian: pertama, bagaimana implementasi yang seharusnya diterapkan pada prosedur pengadaan secara harapan, dan kedua, membahas mengenai realita yang terjadi di lapangan. Secara harapan pembahasan dilakukan dengan melakukan library research atau studi terhadap peraturan yang berlaku dan metode-metode atau prinsip perkembangan dari asas keterbukaan. Realitas di lapangan akan dielaborasi dari studi kasus mengenai permasalahan dalam pengadaan tanah. Hasil dari penelitian ini menunjukkan ada gap dalam implementasi asas keterbukaan antara harapan dan realitas di lapangan yang bersumber dari kelangkaan sumber daya/tanah, ketimpangan ekonomi dan asimetri informasi di antara para pihak yang terlibat. Tulisan ini menyimpulkan bahwa implementasi asas keterbukaan signifikan dengan peran informasi dalam pengadaan tanah.

Background: HIV/AIDS is still a dangerous infection in Vietnam and in the world. Studying of HIV infection and related factors in high risk groups, including female massage therapists is therefore very important. Aims: 1. To study the HIV infection in female massage therapists in Quang Ngai province. 2. To fine some related factors to HIV infection. Patients and methods: Female massage therapists working in Quang Ngai province. Cross-sectional, descriptive study. Results: The rate of HIV infection was 0.99%. Group older than 22 years old had higher rate of infection than group under 22 years old (1.80% vs 0.69%). The girls from urban areas or not using condom had higher rate of infection than group from rural or not using condom (1.57% vs 0.47% and 7.32% vs. 0.57%). Most of HIV infected belong to single or divorce groups. Conclusions: The rate of HIV infection in female massage therapists in Quang Ngai province was 0.99%. The HIV infection related factor was not using condom in sexual contact. Keywords: HIV, female massage therapists, Quang Ngai
