The purpose of this chapter is to explain, in the context of telecommunications law and regulation, the regulation by EU and UK law of audiovisual and radio media services. Overarching principles are found in the Audiovisual Media Services Directive, which takes an approach described as technologically neutral, but established two top-level categories of regulation, for television (or linear) services and on-demand (or non-linear) services. In the case of television services, a wide range of standalone works and comprehensive Sections or chapters on the regulation of broadcasting are available. As such, the focus here (with a view to the interests of readers) is on licensing of content and multiplex services by Ofcom and the handling of complaints about those services, with a bias towards the standard licences for services on cable, satellite, internet, and digital terrestrial platforms, and the regulation of DTT multiplexes and of on-demand services, as opposed to detailed description of the BBC and the commercial public service broadcasters. Indeed, the European Court of Human Rights has regularly found that the regulation of communications infrastructure can have a real impact on the receiving and imparting of information.

In a scenario of abundance of digital contents, audiovisual works need to be easily discovered to be consumed. Prominence, therefore, becomes essential. In Europe, the idea of giving prominence became key to address how works can be promoted after the adoption of the Audiovisual Media Services Directive in 2007. In light of the amendment of this norm, this article provides an overview of the regulation regarding prominence of Video on Demand (VoD) services at the European Union (EU) level. The aim is to analyse its transposition into national provisions to identify different approaches and characterize them according to their implications for the general interest. It is concluded that to guarantee and justify that certain contents are easy to discover by citizens in an overwhelming digital world, the formulation of principles-based rules can be an appropriate solution.

The present chapter investigates content authentication strategies and their use in media practice. Remarkable research progress has been conducted on media veracity methods and algorithms, however, without providing that much straightforward tools to users involved in real-world applications. Hence, there is an urgent need for further supporting content verification by exploiting all the available methods in properly integrated online environments, forming a Media Authentication Network. On-demand training (and feedback) on these technologies is considered of major importance, enabling users to collaborate with media and forgery experts towards adoption, refinement and widespread dissemination of best practices. Better comprehension of the involved tools and algorithms would propel their broad exploitation in practice, gaining valuable feedback for further improvements. Thus, a continuously updated online repository, containing documented examples, learning resources and media veracity tools, could be adaptively accommodated, better supporting various users and applications needs.

The overlay networks composed of residential gateways (i.e. home-box) leverage their storage and upload capacity to achieve scalable and cost-efficient content distribution. In this chapter, we present the architecture of the home-box overlay for video on demand services, with the network-aware request redirection and content caching strategy that optimizes the resource usage at both network and client side, for reducing the overall distribution cost. The proposed system is compared with existing solutions through comprehensive simulations. The results demonstrate the advantage of network-aware and popularity-based caching strategy, with reduced the overall cost of the VoD services.

The markets for audiovisual content are subject to dynamic change. Where once “traditional” television was dominating, i.e. linear audiovisual media services, markets display nowadays the strong growth of different types of video-on-demand (VoD), i.e. nonlinear audiovisual media services including paid-for VoD such as Netflix and advertised-financed VoD like YouTube. This article aims at providing insights into the VoD market in general and the competitive environment in particular. For doing so, the authors first present recent developments in the German VoD market. In the second part of this article, the authors focus on the (perhaps special) role of YouTube in the market for audiovisual (online) services. Thereby arguments for and against YouTube exerting competitive pressure on i) other non-linear audiovisual media services (e.g. Netflix) as well as ii) on other linear audiovisual media service providers (TV stations) are discussed. The article concludes that there are numerous pros and cons speaking for a relevant role of YouTube for both markets.
