Integrating the Ecosystem Services Paradigm into Environmental Law: A Mechanism to Protect Mangrove Ecosystems?

Abstract The ecosystem services paradigm is a widely recognised concept in ecology and environmental management, but one that is not uniformly incorporated into environmental law. This article argues that the integration of this paradigm into law can assist with protection of critical environmental resources, using mangrove ecosystems as an example. This article commences with a defence of the ecosystem services paradigm, followed by a discussion of the ecosystem services provided by mangroves. It argues that a comprehensive analysis of existing laws is a necessary first step towards legal reform, and to this end, it proposes a rubric for assessment of laws and legal frameworks. This rubric is applied to laws in Queensland, Australia, as a case study. It concludes by identifying major deficiencies in the recognition of mangrove ecosystem services in existing laws, and calling for reform in this area.

A reflexão sobre as práticas ambientais, em um contexto marcado pela degradação permanente do meio ambiente e do seu ecossistema, tem exigido novas posturas das organizações. Contudo, adotar a gestão ambiental como estratégia de desenvolvimento, contempla as necessidades das organizações em aliar crescimento econômico e sustentabilidade. Neste sentido, este artigo tem como objetivo identificar se existe a preocupação com as questões ambientais por parte das organizações da região da Quarta Colônia e se as mesmas adotam programas de gestão ambiental, analisando fatores que podem influenciar nas diferentes abordagens dadas ao tema. Para atingir o objetivo proposto, utilizou-se uma abordagem qualitativa em um estudo considerado exploratório e compreendido como estudo de caso. A amostra foi de cinco organizações da Região da Quarta Colônia onde foram realizadas visitas técnicas e entrevistas semi-estruturadas. Como resultado significativo do estudo, pôde se constatar que as organizações estudadas limitam-se apenas às exigências da legislação ambiental em vigor. Assim as organizações necessitam adotar novas posturas e um processo de atualização contínua que pode ser viabilizado pela gestão ambiental. Abstract The reflection about environmental practices, in a context marked by permanent degradation of the environment and its ecosystem, has required new strategies from the organizations. However, adopting environmental management as a development strategy satisfies the organizations needs to gather economic growth and sustainability. Thus, this paper aims on identifying whether the organizations from the Quarta Colonia Region are concerned about environmental issues and whether they adopt environmental management programs, analyzing aspects which can influence the different approaches applied to this issue. In order to reach such aim, a qualitative approach was used in a study considered exploratory and comprised as a case study. The sample consisted of five organizations from the Quarta Colonia Region where there were technical visits and semi-structured interviews. A relevant result of the study was that it was possible to observe that the studied organizations are restricted only to the operative environmental law requirements. Thus, organizations ought to adopt new emplacements and a continuous updating process, which can become viable through the environmental management. On behalf of the IUCN Environmental Law Centre, the IUCN Academy of Environmental Law and the IUCN Commission on Environmental Law, I would like to introduce you to the topic of this Journal "Towards the legal recognition and governance of ecosystem services." First of all, I would like to thank the Co-Chairs of the Academy´s Research Committee and the Deputy Chair of the IUCN Commission on Environmental Law for this initiative and I am most happy to see that, throughout its organisation, collaboration between the three organisations has continued to grow. We organised our first joint-workshop in 2011 in Ghent, Belgium, just before the IUCN Academy´s 8th annual colloquium. The feeling that we all had as the successful event came to an end, was that this collaboration should be repeated on an annual basis. The 2011 Mpekweni Workshop revolved around legal frameworks for the recognition and governance of ecosystem services. Maintaining healthy ecosystems and the continuing provision of services such as water supply or climate regulation is key to ensuring present and future human livelihoods, the fulfillment of the Millennium Development Goals and for any form of poverty alleviation strategy.

Mangrove ecosystems become an important ecosystem for the community of Mandah district, this is because the community uses the mangrove ecosystem as a producer of mangrove wood, as well as a place to catch fish, shrimp, and crabs. Therefore, it is important to maintain the sustainability of mangrove ecosystems in multiple ways; one option is by providing an economic report regarding the mangrove ecosystem. The purpose of this study is to estimate the economic value of mangrove ecosystems. This research was conducted in Mandah District using the survey method. Data analysis using economic valuation by calculating the total economic value of mangrove ecosystem services, comprising: supporting services, provisioning services, regulating services, and cultural services. The results showed that the total economic value of mangrove ecosystem services which has an area of 31,007 Ha amounting to IDR 6,100,130,675,685/year or IDR 196,733,985/Ha/year consisting of the value of supporting services amounting to IDR 2,843,521,034,280/year, the value of provisioning services IDR 120,274,922,887/year, the cost of regulatory services is IDR 3,132,894,718,518/year, and the value of cultural services is IDR 3,440,000,000/year. The high economic value of regulating and supporting services indicates that the mangrove ecosystem has a high value of environmental services, so it needs to be preserved and the sustainability of the mangrove ecosystem to remain of high economic value.

Contributing to the cultural ecosystem services literature, this paper draws on the in-depth place narratives of two coastal case-study sites in Wales (UK) to explore how people experience and understand landscape change in relation to their sense of place, and what this means for their wellbeing. Our place narratives reveal that participants understand coastal/intertidal landscapes as complex socio-ecological systems filled with competing legitimate claims that are difficult to manage. Such insights suggest that a focus on diachronic integrity (Holland and O’Neill 1996) within place narratives might offer a route to more socially and culturally acceptable environmental management strategies.

The mangrove ecosystems on the coast of Sayung Sub-District provide huge benefits to the community. However, this region experienced a very severe coastal erosion during the last few decades. Also, information about mangrove ecosystem services is still very limited in this region. The purpose of this study, therefore, was to map the balance of mangrove ecosystem services on the coast of Sayung Sub-District, Demak District. Data were collected from three coastal villages, namely Bedono, Timbulsloko, and Surodadi, through in-depth interviews, questionnaires, and field observations. The data analysis was carried out using the Burkhard model approach, which involved an ecosystem service matrix, made up of a matrix of capacity, demand, and availability. The results showed that in all components of provisioning service, there was a surplus of availability. In regulating services, there were low surpluses in the components of carbon sequestration and water bioremediation services, while low deficits were found in the service components of reduce wave and current damage, and protecting from sea water intrusion. Then, in cultural services, the two components, shelter for rest area and recreation, experienced a surplus of availability. Mangrove rehabilitation needs to be continued to increase mangrove cover, given the availability of regulating services on components related to erosion prevention in the balace sheet tends to be deficit. Guarantee legal certainty and economic stability is very important to keep the movement of the economy of a country. The formulation of the problem formulated a point of issue is how the environmental law enforcement in Indonesia on a case study of forest fires in Indonesia and How to influence environmental law enforcement to economic growth in Indonesia. The purpose of this study was to determine the environmental law enforcement in Indonesia on a case study of forest fires in Indonesia and How to influence environmental law enforcement to economic growth in Indonesia. This research could be useful in a practical and theoretical. The method used by the researchers are using a normative juridical approach. The results of the study Enforcement of Environmental Law in relation to the Criminal Law which is related substance of Law in Article 69 paragraph (1) letter H Law No. 32 of 2009 on the Protection and Environmental Management includes about a ban on land clearing by burning and action against the perpetrators for enforce the law and environmental law enforcement to economic growth in Indonesia affected by three (3) aspects, namely Products of law, justice system and political risks are always changing. Conclusions of law enforcement carried out by the legislation in force and the factors that influence economic growth is necessary to be noticed is the commitment of the highest officials responsible to the reciprocation of a country. Recommendation law enforcement must be carried out according the legislation without seeing the background of the company or individual that legal certainty to invest guaranteed and the reformulation of Article 69 paragraph (1) letter H Law No. 32 of 2009 on the Protection and Environmental Management.

Mangrove ecosystems are prone to die due to both anthropogenic and natural effects. The present study is a case study of how the formation of sand bars affects the natural mangrove ecosystem and becoming a threat to its rich biodiversity of flora and fauna. The Kadalundi – Vallikkunnu Community Reserve located in Kozhikode and Malappuram Districts in Kerala State is the first community reserve of Kerala, declared in 2007 which spread across 1.5 sq. km. andthis area includes Kadalundi bird sanctuary, mangroves and estuarine. These area mainly affected by numerous biotic interferences like over fishing, collection of oyster and mussels, mining of sand and lime and also retting of coconut. The formation of sand bars at the mouth of the river has resulted in the massive die back of the mangrove vegetation, especially that of Avicennia Marina which is one of the five species of mangroves found in the Kadalundi – Vallikunnu community reserve. The illegal utilization of land for coconut plantation, urbanization and dumping of urban waste near the mouth of the river had made the problem highly complicated. The present study highlights the need for urgent measures to be adopted from the authorities to ensure community participation for restoration of community reserve.

Local indigenous strategy to rehabilitate and conserve mangrove ecosystem in the southeastern Gulf of Kupang, East Nusa Tenggara, Indonesia. Biodiversitas 21: 1250-1257.  The existence of local communities around mangrove ecosystems plays essential role to support the effort of conservation programs in this area. This study is aimed to investigate a set of situation faced by local communities in the southeastern Gulf of Kupang (SGK), East Nusa Tenggara Province which led to the rehabilitation of once degraded mangrove forests in SGK and the strategies to conserve the recovered mangrove forests. A case study approach was developed using purposive sampling to collect information regarding the historical situation of mangrove forests in SGK. Further, remote sensing method using multi-temporal observation data was used to investigate the changes in mangrove cover from 1994 to 2019. This study revealed that a series of situations became the fundamental of the success in retaining the existence of mangrove ecosystems in SGK. First, the negative impacts of mangrove degradation affected the communities badly in relation to their livelihoods in fisheries and marine sector as well as other environmental services. Then, this situation led to the emergent of a local champion to initiate mangrove rehabilitation efforts which firstly did not get attention from most of the communities. After some initial successes, the efforts of the local champion was then followed by other members of communities, triggering a bigger scale of mangrove rehabilitation. Having the mangrove recovered, the communities set of highly strict local indigenous rules in which every indigenous people who conducting illegal logging in the mangroves would be expelled from the village, while a large fine was given for outside people who did the similar action. Currently, more than 90% of respondents have understood the benefits of mangroves and derived advantages from it, particularly in improving their prosperity and security. The results of the success of mangrove rehabilitation and conservation in SGK was confirmed by the increasing extent of mangrove vegetation using remote sensing data. The case study of rehabilitation and conservation in SGK provided valuable learning for communities in other areas.
