Measures to detect fraud and fraudsters have been developed in the article, including the definition of common "red flags" for a person who commits typical and accidental abuse. The main organizational control structures used to prevent fraud are identified. Evidence was analyzed in both paper and electronic formats, including big data, to form a classification of fraudsters and fraudulent activities. Possible solutions for effective fraud management and its prevention within the company by the help of ASP approach were developed. В статье изложен обзор современного состояния теории и практики предупреждения мошенничеств, совершаемых осужденными с помощью средств мобильной связи из учреждений уголовно-исполнительной системы России. Исследованы и оценены изменения законодательства, регулирующего рассматриваемую сферу правоотношений, предложения ученых относительно повышения эффективности борьбы с указанным видом мошенничеств, практические материалы. Обозначена проблема, связанная с отсутствием в данных официальной статистики о состоянии преступности в России сведений о количестве мошенничеств, совершаемых осужденными с помощью средств мобильной связи, что бывает необходимо для проведения научных и прикладных исследований, выработки мер по предупреждению и оценки их эффективности в борьбе с анализируемым противоправным деянием. Сформулированы рекомендации, направленные на повышение эффективности предупреждения «телефонных» мошенничеств, совершаемых осужденными в период отбывания наказания в исправительных учреждениях, в частности предложение правового характера, регулирующее сферу индивидуальной профилактики правонарушений, совершаемых осужденными, и предложение в области статистического учета преступлений и отчетности.The article presents an overview of the current state of the theory and practice of fraud prevention committed by convicts using mobile communications from institutions of the criminal Executive system of Russia. The changes in the legislation regulating the sphere of legal relations, the proposals of scientists on improving the effectiveness of combating this type of fraud, practical materials are studied and evaluated. There is a problem related to the lack of information in the official statistics on the state of crime in Russia on the number of frauds committed by convicts by means of mobile communication, which is necessary for scientific and applied research, the development of measures to prevent and assess their effectiveness in combating the illegal act in question. Recommendations have been made to improve the prevention of «telephone» fraud committed by convicted persons while serving their sentences in correctional institutions, in particular a legal proposal regulating the scope of individual prevention of offences committed by convicted persons and a proposal in the field of crime statistics and reporting.

Статья посвящена рассмотрению особенностей формирования неформальных групп в пенитенциарном учреждении и характеру их влияния на процесс исправления осужденных, являющихся членами этих групп. Приводятся статистические данные о преступности в исправительных учреждениях за последние годы, а также действиях, дезорганизующих работу исправительных учреждений. Рассматриваются причины влияния криминальной субкультуры на личность осужденного и особенности формирования неформальных групп различной направленности (положительной, отрицательной и нейтральной). Особое внимание уделяется взаимообусловленному процессу влияния на личность осужденного неформальной группы и администрации пенитенциарного учреждения, от которого во многом зависит возможность его исправления. Анализируются психологические механизмы, лежащие в основе приобщения осужденного к неформальным группам отрицательной направленности. Описываются психолого-педагогические особенности воспитательной работы с осужденными в неформальных группах. Характеризуется выбор средств, форм и мер воздействия на личность осужденного в неформальных группах. Указываются особенности воспитательных воздействий на личность осужденного, приводящие к тем или иным изменениям в личностной сфере. Рассматриваются обстоятельства для наибольшего положительного эффекта от воспитательной работы и указываются социально-психологические явления, которые наиболее эффективны, а также разнообразные методы профилактического и пресекающего воздействия. В заключение рассматривается важность изменений в управленческих и воспитательных структурах исправительных учреждений, в стилях воздействия и режима содержания осужденных, а также необходимость повышения уровня психолого-педагогической подготовки сотрудников, расширения знаний о специфике индивидуального и группового поведения осужденных. The article is devoted to the consideration of the peculiarities of the formation of informal groups in a penitentiary institution and the nature of their influence on the process of correction of convicts who are members of these groups. Statistics on crime in correctional institutions over the past year sare provided as well as actions that disrupt the work of correctional institutions. The reasons for the influence of the criminal subculture on the personality of the convict and the peculiarities of the formation of informal groups of various orientations (positive, negative and neutral) are considered. Particular attention is paid to the interdependent process of influence on the personality of the convict by the informal group and the administration of the penitentiary institution, on which the possibility of his correction largely depends. The psychological mechanisms underlying the introduction of a convict to informal groups of a negative orientation are analyzed. Psychological and pedagogical features of educational work with convicts in informal groups are described. The choice of meansis characterized as well as forms and measures of influence on the personality of the convicted person in informal groups. Specific features of educational influences on the personality of the convicted person, leading to certain changes in the personal sphere are examined. The circumstances for the most positive effect of educational work are considered, and the socio-psychological phenomena that are most effective are indicated, as well as various methods of preventive and intersecting influence. At the end of the article the importance of changes in the management and educational structures of correctional institutionsis discussed as well as changes in the styles of influence and the regime of detention of prisoners and the need to improve the level of psychological and pedagogical training of employees, expanding knowledge about the specifics of individual and group behavior.

Статья посвящена рассмотрению проблем профилактики преступлений оперативными подразделениями исправительных учреждений (далее - ИУ). Автор, раскрывая роль оперативных отделов ИУ в общей профилактике правонарушений, указывает на ее двоякость, поскольку, с одной стороны, рассматриваемые подразделения обладают значительным преимуществом перед другими службами учреждения в выявлении негативных факторов (негласный метод получения оперативно значимой информации), с другой стороны - далеко не все условия, которые способствуют совершению преступлений в ИУ, можно устранить оперативным путем. Изучение специальной литературы позволило выявить в деятельности начальников ИУ определенные проблемы, связанные с оценкой состояния оперативной обстановки в ИУ, сложившейся ситуации; с отсутствием прогноза развития криминогенной ситуации в ИУ, а также с профессиональной некомпетентностью руководителей, неумением объективно оценивать результаты деятельности структурных подразделений. Автор особое внимание уделяет анализу статистических данных о совершенных и предотвращенных преступлениях лицами, находящимися в местах лишения свободы. The article is devoted to the consideration of problems of crime prevention by operational units of correctional institutions (hereinafter referred to as IA). The author, revealing the role of the operational departments of the IA in the general prevention of offences, points to its twofold. On the one hand, the units under consideration have significant advantages over other services of the institution in identifying negative factors (these are tacit methods of obtaining promptly meaningful information). On the other hand, not all conditions conducive to the commission of crimes in IA can be eliminated by operational means: For example, shortcomings in the activities of other departments and services (security department, duty shift, etc.). The study of special literature has made it possible to identify problems in the activities of heads of correctional institutions in the sphere of implementation of solutions in case of lack of objective and complete information on the state of the operational situation in IA, the current situation, the results of the activities of structural subdivisions; No forecast of the development of the crime situation in IE; Professional incompetence of managers, inability to objectively assess the results of activities of structural subdivisions. The author pays particular attention to the analysis of statistics on crimes committed and prevented by persons in detention.
