<p>This thesis investigates the scope for compact development to accommodate population growth in Wellington, New Zealand. The topic is particularly significant for New Zealand as the great majority of the population lives in urban areas, historical development has been dominated by low density urban form, and transport and urban form are two of the main domains in which the country can reduce its carbon emissions. The influence of urban planning and residents’ preferences on achieving sustainable outcomes is investigated.  Historical and current planning rules and transport policies in the City are analysed to determine their influence on the provision of compact development. Wellington’s transport policy shows a pattern of path dependency: historical decisions to favour car oriented investment have driven subsequent transport investments and influenced the ease of using different transport modes. Planning policies show a similar pattern of path dependency: planning rules enacted in the 1960s endure in present planning despite being packaged with different justifications and regulatory regime. Current planning rules severely restrict infill development in most existing neighbourhoods, which reduces the availability of housing in accessible medium density neighbourhoods and likely increases the cost of this type of housing.  A stated choice survey was conducted of 454 residents of Wellington City to investigate the extent to which there is an unmet demand for compact development and alternatives to car travel. The survey held presentation mode constant across two completion modes (internet and door to door with tablet completion), allowing the impacts of recruitment and completion mode to be examined. Survey recruitment mode appeared to influence both response rates and the representativeness of the survey, while completion mode appeared to have little or no impact on survey responses.  Using the stated choice survey results, a latent class model was developed to examine the preferences of residents and the trade-offs they are willing to make when choosing where to live. This type of model allows for the identification of preference groups as a means of understanding the diversity of preferences across the population. The study found that there is an unmet demand for medium density, accessible housing, but that affordability is a barrier for households to choose this type of housing. There was also an unmet demand for walking and cycling, with more residents currently driving than would prefer to use this mode, and more residents preferring to walk and cycle to work than currently use these modes. The ability to use a desired travel mode appears to be related to the neighbourhood in which a person lives, with residents of medium and high density neighbourhoods being more likely to use their preferred travel mode.  This study also modelled future development trajectories for Wellington based on demand for housing, neighbourhood and transport attributes. This preference based growth model was contrasted with the City’s plan for development over the next 30 years. Comparing the two scenarios, the planning based trajectory performed better than the demand based scenario in terms of both carbon emissions and achieving compact development.</p>

The 2010-11 Canterbury Earthquake Sequence inflicted seismic losses worth more than $40B, which is about 25% of the GDP of New Zealand (as per 2011 data). More than 80% of these losses were insured, which comprised of more than $10B covered by the Earthquake Commission (a New Zealand crown entity providing insurance to residential property owners) and more than $22B (comprising of roughly equal split between domestic and commercial claims) by private insurers [1]. The scale of financial impact has been perceived to be disproportionately large given the building regulatory regime in New Zealand is relatively stringent and the earthquakes and aftershocks were of moderate magnitude. As it is well known that some of the major faults spread in the Wellington region and the subduction boundary passing through the centre of New Zealand can generate much bigger earthquakes (upwards of magnitude 8), people are left pondering whether New Zealand is able to cope with the financial impact of larger earthquakes. This fearful realisation gradually led to people being dissatisfied with merely life-safe buildings and demanding more resilient buildings that meet the objectives of performance based design; i.e. suffer less damage, incur less loss, and can remain functional after earthquakes. In light of the extensive building damage resulting in high financial loss in recent earthquakes, practicing engineers and researchers in New Zealand have been advocating for revising the current design approach to improve performance of new structures and infrastructure in future earthquakes [2-5]. As a result, large proportion of buildings constructed in the last decade (including those built to replace earthquake-damaged buildings) have shied away from the traditional damage-friendly ductile structural systems and instead adopted one of the new and emerging structural systems claimed to be “low-damage”. In many cases, the adopted structural systems are not covered by existing design standards and are approved as alternate solutions through expert peer review. The “low-damage” attribute of most structural systems has been validated by component (or sub-assembly) level experimental tests, but their interactions with other building components and implications of their use in buildings have not been rigorously scrutinised. Hence, the rushed adoption of some of these systems in buildings can surprise the engineering community in future earthquakes with mismatch between the expected and real performances of the buildings; akin to what New Zealand engineering fraternity is currently going through due to realisation of poor seismic performance of precast hollow-core flooring system that has been widely used in New Zealand buildings without rigorous scrutiny. One such “low-damage” structural system is precast post-tensioned rocking frames with supplemental energy dissipaters. This paper summarises the development of this structural system, critically reviews the literature reporting the seismic performance of this system, and qualitatively evaluates system-level implications of its use in buildings. This paper is intended to better inform engineers of the likely seismic performance of buildings with this structural system so that they can optimise its benefits by giving due consideration to its effect on other building components.

New Zealand offers a through-provoking case study of the effects of different competition and regulatory policies on broadband diffusion rates. Despite having one of the highest rates of Internet connection and usage in the OECD, widely available broadband infrastructure, and low broadband prices, broadband uptake per capita languishes in the bottom third of the OECD. While low uptake has typically been attributed to competition and regulatory factors associated with New Zealand’s ‘light-handed’ regulatory regime, this chapter proposes that a more credible explanation lies in a combination of New Zealand’s legacy of demand-side regulations, in particular the retail tariff options for voice telephony, and the limited value being derived by New Zealand residential consumers from the small range and narrow adoption of applications used currently that necessitate broadband connections. The New Zealand case illustrates the effect that legacy regulations can have on both the diffusion of new technologies per se and the choices made by consumers between different generational variants within that technology. The case indicates a need for more research on the effect of telecommunications industry regulations on demand-side uptake factors.

The recent history of planning for the transport sector in New Zealand offers interesting comparisons with parallel developments in the United States under the Intermodal Surface Transportation Efficiency Act of 1991. Over the past decade, both nations have undergone a major reconstruction of the legal and political apparatus of transportation planning. In each case, this restructuring reflected two potentially contradictory sets of goals: (a) to rationalize and improve the efficiency of transportation planning, thereby enhancing economic development and (b) to systematically mitigate transport-related externalities and formally recognize environmental and fiscal limits to the expansion of transportation infrastructure. New Zealand is described from a historical and geopolitical perspective and the legislative and political framework of transport is outlined, focusing on key changes in the regulatory regime. New Zealand is shown to have followed policies that strongly favor privatization and market-style means and measures, with central government moving from an operational to a strategic stance. Examples of deregulation and privatization programs are discussed, including ports, safety regulation, and environmental regulation. The future requirements of transport policy planning are speculated on.

Despite recent legislative amendments to address areas of highest risk to the welfare of calves (Bos taurus) in New Zealand, there are prevailing concerns that animal welfare science knowledge has not been adopted in practice. As a part of a larger, nationwide study investigating the perceptions of veterinarians towards calf welfare, the aim of the current work was to investigate the perceptions of veterinarians towards the level of welfare protection afforded to young “bobby” calves in New Zealand. This study also explored concerns for welfare compromise and identified barriers to welfare-related change for calves more generally. An electronic mixed-methods survey was completed by 104 veterinarians registered with the Veterinary Council of New Zealand. The findings revealed that veterinarians strongly disagreed with the specifications of certain calf welfare regulations. Veterinarians also identified areas at highest risk of calf welfare compromise across the production chain and barriers to welfare-related change. These findings demonstrate considerable support among veterinarians for improving the level of welfare protection afforded to calves. Given the discrepancies that exist between the current regulatory regime and veterinary perspectives, the knowledge gained from this study can be used in support of regulatory reform to strengthen calf welfare in practice and policy in New Zealand.

<p>In recent decades, intellectual property law (in particular patent law) has had to face new challenges due to the accelerating development of technology. Patents can have a negative effect on a country's economy if too many invalid or overly broad patents are granted. Such patents have the potential to impose high costs on society without providing substantial benefits. If a patent regime cannot avoid the grant of such patents, or does not provide instruments to remove them from the register, the negative effect may stifle innovation instead of encouraging it. In 2008, in consideration of these problems, the government of New Zealand introduced a Patents Bill. This Bill is the culmination of the government's review process, which started in the late 1980s. The aim of the Bill is to update New Zealand's patent law in order to bring it in line with international practise and to reduce the costs to society arising from invalid and overly broad patents. The provisions of the Bill cover all principal aspects of the patent regime: standards of examination and procedures, challenges on the grant of a patent, and provisions for updating the regulatory regime for patent attorneys. This dissertation focuses on analysing how the quality of New Zealand's patents could be enhanced using the knowledge and experience of third parties. Because the current examination standards may allow the grant of overly broad patents, this dissertation analyses specifically which changes in the examination procedure could help prevent the grant of "bad" patents without overburdening the resources of the IPONZ. In the next step, the dissertation analyses third-party instruments under the current patent system and under the Patents Bill 2008, proving that neither approach by itself would be sufficient to bring about an effective patent reviewing system for New Zealand. The approach under the current system is too expensive and has the potential to delay the granting procedure, whereas the approach proposed by the Patents Bill 2008 limits the influence of third parties before the grant of a patent to such an extent that most patents may remain in the register. The overall aim of this dissertation is to suggest a new approach that includes aspects of both of the others in order to find a balanced solution and an optimal fit for the specific needs of New Zealand.</p>
