Los principios constitucionales en materia económica se desprenden hoy, no solo de la Constitución italiana, sino también y sobre todo de los Tratados europeos. La adhesión de Italia, primero al Tratado CE y más tarde al Tratado UE, ha reclamado en un primer momento nuevas interpretaciones de la constitución económica coherentes con el planteamiento liberal de los Tratados, y ha propiciado a continuación la reforma constitucional de 2001 e incluso posteriormente la formulación de proposiciones legislativas que tutelan el mercado para llegar, en fin, a la expresa mención de la competencia en la Constitución. Pero también los Tratados europeos han sido modificados e interpretados para hacerlos coherentes con los principios constitucionales y, en particular, con los valores sociales.Nowadays economic constitutional principles are not only in the Italian Constitution but also, and specially, in European Treaties. Italian adhesion to the EEC Treaty and then to the UE Treaty has demanded: a new interpretation of economic constitutional rules, due to the liberal conception of European Treaties; then, the 2001 constitutional reform; afterwards, the elaboration of parliament acts in order to protect free markets; and, last, the amendment to include «free competition» in the constitutional text. On the other hand, European Treaties have been reformed and interpretated according to the constitutional order and particularly to the welfare State principle.

AbstrakPenelitian ini berjudul BKR (Badan Kemanan Rakyat):Cikal Bakal Tentara Indonesia?!. Penelitian ini merupakan interpretasi baru tentang cikal bakal TNI, yang umumnya banyak merujuk pada PETA (Pembela Tanah Air). Metode penelitian yang digunakan adalah Metode Sejarah.Metode Sejarah memiliki empat tahapan yaitu Heuristik, Kritik, Interpretasi dan Historiografi.Sumber-sumber penelitian ini menggunakan koran-koran sezaman, majalah sezaman, dan buku. BKR dianggap sebagai cikal bakal TNI didasarkan beberapa sebab. Pertama, atas dasar legalitas formal, PETA telah dibubarkan sehingga BKR adalah satuan militer yang pertama kali dibentuk setelah Indonesia merdeka. BKR selanjutnya melahirkan pembentukan TKR (Tentara Keamanan Rakyat), TKR (Tentara Keselamatan Rakyat), TRI (Tentara Republik Indonesia) dan TNI (Tentara Nasional Indonesia). Kedua, jika PETA dianggap sebagai cikal bakal TNI, maka KNIL dan beberapa satuan keprajuritan diabaikan. Padahal, beberapa bekas perwira KNIL memiliki peran penting di tubuh BKR hingga TNI.Kata kunci: BKR, Tentara, TNIAbstractThe main subject this study is BKR – Indonesian civil defense corps – as origin of Indonesian Military. This study is new interpretation about the origin of TNI (Indonesian National Armed Forces) now. Many opinion refer to PETA as civil defense corps in Japanese occupation era. Study emlpoys a Historical Method, which consists of four stage: Heuristic, Critic, Interpretation, Historiography. The study utilize some sources such as newspaper, magazine, and book. Main finding of this study is PETA had dispersed as legality and formally and BKR was formed as the firts corps after Independence of Indonesia. Futhermore, BKR changed to TKR (Tentara Keamanan Rakyat), TKR (Tentara Keselamatan Rakyat), TRI (Tentara Republik Indonesia) until TNI (Tentara Nasional Indonesia). If PETA is considered as origins of Indonesian Military, then it ignore KNIL – a colonial armed forces – and the other defence corps. Even though the eks KNIL’s officer have important role in military managenment of BKR until TNI.Keywords: BKR, Military, TNI

This article sheds new light on the political history of legal-constitutional developments in Palestine in the fourteen years following the Oslo Accord. It examines the relationship between the unfolding social, political, and economic context in which they arose, on the one hand, and PA law-making and legal praxis, on the other. Focusing on the evolution of the Palestinian Basic Law and constitutional regime, the author argues that the “Palestinian constitutional process” was a major “battlefield” for the actors of the Palestinian-Israeli conflict. Thus, changes in the actors' political strategies at various junctures were mirrored in legal-constitutional forms, specifically in the political structure of the PA. In that sense, the constitutional order can be understood as a sort of “metaphoric representation” of Palestinian politics, reflecting, among other things, the colonial nature of the Palestinian context that the Oslo process only rearticulated. This perspective is also essential for understanding the evolution of the Palestinian-Israeli conflict after Oslo.

This thesis seeks to answer the question 'when, how, and why the Danish asylum system become more restrictive than the Swedish one between 1989 and 2001'. In the analysis of these reasons, a particular emphasis is placed on the different political perceptions of both countries’ welfare philosophies on the one hand, and their political culture on the other. The influence of anti-immigration parties on mainstream political culture is an important part of this analysis. Through a distinction between border and integration policy, it becomes clear that the Danish asylum policy becomes more restrictive in the second half of the 1990s, because of its focus on cultural integration as a duty to the welfare state. The thesis concludes with a discussion regarding the impact of (neoliberal) economic changes on solidarity within political culture.

Studying the touch as a sense developed by contact, and the necessity to redefine it, due to the global pandemic and social dissonance that occurred is the topic of this text. Questioning the approach to drawing under the influence of remoteness addresses the need to look closely, to get personal with the drawing, a manifestation of experience. Drawing of intimacy, evaluate concepts of encounter and isolation posing the question of whether we can experience the closeness of the other through the embodiment of the experience in the drawing. Re-examining tactile sensation observed through the obstacle of corporeal distance, a reflection of intimate experiences and spaces opens up for a new interpretation - of touch without the touch. Can this obstacle transform touch into gaze; and can an image in its making, construct a tactile sensation? Intertwining theoretical and practical approach, this text witness drawing and its visual consumption in space of violated closeness.

Resumen: En el Reglamento (UE) 650/2012 no existe una norma específica que regule la competencia en materia de expedición de certificados sucesorios nacionales, incluso no se utiliza nunca la expresión “certificado sucesorio nacional” como tal, sino que los denomina “documentos internos empleados en los Estados miembros para fines similares” a los de los certificados sucesorios europeos. Sin embargo, dicho instrumento internacional sí que contempla una regulación específica relativa a la competencia en materia de expedición de certificados sucesorios europeos (art. 64 Reglamento (UE) 650/2012). Pues bien, ante la “aparente laguna legal” en relación con los certificados sucesorios nacionales, se debe determinar, si dentro del concepto de “totalidad de la sucesión” -que indica el ámbito de aplicación del Reglamento-, se encuentran dichos certificados. En cuyo caso, las normas de competencia del capítulo II del Reglamento sucesorio serían de aplicación a la expedición de los certificados sucesorios nacionales y a los procedimientos relativos a ellos. En este sentido, la Sentencia del TJUE 21 junio 2018, Vincent Pierre Oberle, C-20/17 y, sobre todo, las Conclusiones del Abogado General Sr. M. Szpunar, han venido a solucionar esta “laguna legal”, así como otras cuestiones planteadas de gran importancia, en relación con el asunto concreto que se estaba dirimiendo. Se debe destacar que, con el fallo de la sentencia, se resuelve una cuestión que puede ser relevante para todos los Estados miembros en los que se contempla la posibilidad de que los órganos judiciales expidan certificados sucesorios nacionales.Palabras clave: Reglamento (UE) 650/2012, certificado sucesorio nacional, certificado sucesorio europeo, competencia internacional, tribunal, notario, resolución, totalidad de la sucesión.Abstract: In Regulation (EU) 650/2012 there is no specific provision that regulates the competence in the issue of national certificates of succession, even the term “national succession of certificate” is never used as such, but rather calls them “internal documents used for similar purposes in the Member States” to those of European Certificates of Succession. However, this international instrument contemplates a specific regulation governing the competence in the issue of European Certificate of Succession (art. 64 Regulation (EU) 650/2012). Well, given the “apparent legal loophole” in relation to national certificates of succession, it must be determined, if within the concept “succession as a whole” -which indicates the scope of the Regulation-, such certificates are found. In which case, the jurisdiction rules of Chapter II of this Regulation would apply to the issuance of national certificates of succession and the procedures related to them. In this regard, the CJEU Judgement of 21st June 2018, Vincent Pierre Oberle, C-20/17, and, above all, the Conclusions of the Advocate General Mr. M. Szpunar, have come to solve this “legal loophole”, as well as others issues raised of great importance, in relation to the specific issue that was being settled. In one sense, Sweden follows the general pattern of constitution-making. The major shifts in the constitutional history have occurred in the aftermath of great crises. Constitutions have been important as descriptions and justifications of the prevailing forces of power. On the other hand, the constitutions of Sweden have been relatively insignificant as norms regulating political and public life. Constitutions have been important as history writing but relatively unimportant as normative principles shaping society, and, indeed, profound changes such as the introduction of parliamentary government have taken place without constitutional reform. The Swedish welfare state was built upon negotiations and practical trade-offs rather than constitutional arguments.

The article explores the central role of the entrepreneur in neoliberalism. It demonstrates how a displacement and a broadening of the concept of the entrepreneur occur in the neoliberal interpretation of the entrepreneur compared to Schumpeter’s economic innovation theory. From being a specific economic figure with a particular delimited function the entrepreneur is reinterpreted as, on the one hand, a particular type of subject, the entrepreneur of the self, and on the other, an ism, entrepreneurialism, which permeates individuals, society, and institutions. Entrepreneurialism is discussed as a movement of the economic into previously non-economic domains, such as the welfare state and society. Social entrepreneurship is an example of this in relation to solutions to social welfare problems. This can, on the one hand, be understood as an extension of the neoliberal understanding of the entrepreneur, but it also, in certain interpretations, resists the neoliberal understanding of economy and society.

The Introduction begins to outline a literary prehistory of the welfare state in Britain around 1900 by turning to a period that forces us to look beyond the connotations associated with the terms reform and revolution today. The chapter presents the book’s two intertwined goals, one reconstructive and literary-historical, the other conceptual and theoretical. First, British Literature and the Life of Institutions reconstructs the emergence of a reformist literary mode around 1900 by exploring how literary texts responded and adapted to the elongated rhythms of institutional change that characterized the emergence of new state structures in this period. But the book also, secondly, aims to make visible a reformist idiom which pervades literary, philosophical, political, and social writing of the period, and which insists that we need to think about the state as an idea, as a speculative figure, rather than as a set of administrative procedures and bureaucratic processes.
