The potential benefits, risks and costs of genetic use restriction technologies

Genetic use restriction technologies (GURTs) are designed to restrict access to genetic materials and their associated phenotypic traits. Originally GURTs were developed to ensure that new crop varieties could be protected against unauthorized use, but recently there has been interest in the use of GURTs to facilitate novel trait confinement. There is controversy over the potential use of GURTs in food and feed plant varieties. Considerable discourse exists amongst many groups representing both public and private, and government and non-government interests, about whether GURTs should be adopted based on the potential benefits versus the potential risks and costs. Potential benefits include intellectual property rights protection, stimulation of private crop breeding research and development, enhancement of genetic diversity in breeding programs, and novel trait confinement. Potential risks and costs associated with GURTs include intra- and interspecific escape of the technology, reduced access and increased cost of genetic material for breeders, increased regulation, liability risks in the event of GURT failure or escape, increased seed costs for farmers, further limits on access to novel genetic material for farmers, greater industrial control over agriculture, and a further decrease in agro-biodiversity. Although topical and controversial, the potential benefits versus the potential risks and costs of implementing GURTs are difficult to adequately assess because they are in the developmental stage and there has been no known field-based testing to-date. Until the results of peer-reviewed research on the environmental, social, economic and political impacts of GURTs are publicly available, no fair and useful assessment for the commercial release of the technology can occur. As of 2014, genetically modified crops occupied 448 million acres globally, representing a global market value of 15.7 billion dollars. The United States planted 170 million acres of genetically engineered crops in 2012, including 95% of the nation's sugar beets, 94% of the soybeans, 90% of the cotton and 88% of the feed corn. While many argue that biotechnology is essential to ensuring long-term food security in the climate change era, little is known of its impact on ecosystems.  Potential risks such as changes in adaptive characteristics, gene flow, pest resistance, genotypic or phenotypic instability and adverse effects on non-target organisms must be balanced with the benefits of genetically modified crops. Despite much perseveration about the risks and benefits of GMOs, the United States regulatory regime has remained stagnant, unable to adapt to new innovations in the field. This lack of adequate oversight cannot go on. We propose shifting responsibility to a single agency charged with implementing science-based regulations that embrace the precautionary principle and promote early collaboration among stakeholders, multidisciplinary research, and well-designed monitoring. Part I of this Article provides an overview of biotechnology in modern agriculture.  More specifically, it evaluates potential benefits and risks associated with genetically modified crops. Part II outlines the United States regulatory regime as it applies to genetically modified crops.  Part III analyzes the current regulatory process, focusing specifically on the Department of Agriculture’s ineffective role in the environmental review process. Last, Part IV offers several potential adjustments to improve our ability to identify and mitigate the unforeseeable consequences of implementing this revolutionary technology.

This chapter argues for a reinvigorated role of the market access doctrine and references a number of important antitrust and intellectual property law decisions in which courts have given priority to market access. It finds a novel function for market access to play within antitrust and intellectual property law liability: courts that grant plaintiffs access to a defendant’s production output should refer to a three-step test under which they inquire (1) whether the inventor, through first-mover advantages, has reaped a sufficient reward such that contractual or intellectual property rights protection would no longer be required to facilitate innovation, (2) whether competitors were able to challenge the proprietary platform’s position in the market without the possibility of granting access, and (3) whether competitors seeking to benefit from market access will make use of it to facilitate the introduction of new goods rather than merely to copy the initial invention.

Based on the oligopoly game theory and the intellectual property rights protection policy, we investigate the complex dynamical behaviors of a mixed duopoly game with quadratic cost. In the new system, a few parameters are improved by considering intellectual property rights protection and the stability conditions of the Nash equilibrium point are discussed in detail. A set of the two-dimensional bifurcation diagrams is demonstrated by using numerical modeling, and these diagrams show abundant complex dynamical behaviors, such as coexistence of attractors, different bifurcation, and fractal structures. These dynamical properties can present the long-run effects of strengthening intellectual property protection.

The aim of this paper is to identify the perceptions of teachers and regulators in implementing fully privately run public schools (FPRPS) in Malaysia. Under the Malaysian Educational Blueprint (MEB) 2013 - 2025, it is clearly stated that the programs and activities that would encourage and allow parents, the public and private sectors, NGOs, and society to forge a partnership with the school will benefit especially concerning values education. These school community partnerships can be related to the ninth shift in the Blueprint which is “partnering with parents, community and private sector at scale,” although, the emphasis of this shift is more on students’ academic progress. This study was conducted for three months’ periods, involving 87 teachers and principals (in 13 schools) in the districts of Petaling Utama, Wilayah Bangsar-Pudu and Hulu Langat and 23 regulators in 10 Regulatory Bodies. The method used was in the form of focus group discussion (FGD). The data was processed by using Atlas ti. From the interviews conducted on FPRPS, all of the respondents (i.e. teachers, principals and regulators) indicated that they are ready and willing to accept the FPRPS implementation. This is because FPRS offers huge potential benefits to them. These include improvement in students’ skill, teacher training, academic performance, employability, financial support, infrastructures, facilities, security, maintenance, workload, and school efficiency. The study contributes to the development of a new type of school in Malaysia.

Aim: this study assessed the patients’ perception of the outcomes of prosthetic treatment in a University of Southern Brazil. Methods: patients seeking for prosthetic treatment were invited to answer a questionnaire with 41 items about the potential risks, benefits, and consequences of no treatment. Answers were obtained according to a five-item Likert-scale varying from 1 (completely disagree) to 5 (completely agree). Sociodemographic data was included in the comparison. Mann-Whitney or Kruskal-Wallis (95%) compared data depending on the variable. Results: two-hundred twenty-five patients answered the questionnaire. Median age of participants was 45-54 years. The potential benefits were similar among participants irrespective of the variable adopted. The perception of risks was significant influenced by variables gender, age, education level, type of edentulous space, prior treatment with prosthodontics, type of prosthodontics, and prosthodontics usage in years. Consequences of no treatment were affected by age, prior treatment with prosthodontics, and prosthodontics usage in years. Conclusions: the study showed the fundamental importance of correct elucidation about the potential risks (negative perception) in the initial appointment for the studied population. Elucidation about the consequences of no treatment are relevant because some differences were seen into the variables. Prosthodontics patients from the city of Passo Fundo seem well informed about the benefits of the prosthetic treatment, besides the significant influence of some sociodemographic and prosthetic conditions.

This review summarizes the biological and ecological factors of hexaploid wheat (Triticum aestivum L.) that contribute to trait movement including the ability to volunteer, germination and establishment characteristics, breeding system, pollen movement, and hybridization potential. Although wheat has a short-lived seedbank with a wide range of temperature and moisture requirements for germination and no evidence of secondary dormancy, volunteer wheat populations are increasing in relative abundance and some level of seed persistence in the soil has been observed. Hexaploid wheat is predominantly self-pollinating with cleistogamous flowers and pollen viability under optimal conditions of only 0.5 h, yet observations indicate that pollen-mediated gene flow can and will occur at distances up to 3 km and is highly dependent on prevailing wind patterns. Hybridization with wild relatives such as A. cylindrica Host., Secale cereale L., and Triticum turgidum L. is a serious concern in regions where these species grow in field margins and unmanaged lands, regardless of which genome the transgene is located on. More research is needed to determine the long-term population dynamics of volunteer wheat populations before conclusions can be drawn with regard to their role in trait movement. Seed movement has the potential to create adventitious presence (AP) on a larger scale than pollen, and studies tracing the movement of wheat seed in the grain handling system are needed. Finally, the development of mechanistic models that predict landscape-level trait movement are required to identify transgene escape routes and critical points for gene containment in various cropping systems.
