Higher education is often touted as a recession-proof occupation and industry. During a recession, jobs are lost, but people's hunger for higher education typically grows. The Covid-19 pandemic shattered this belief, particularly in the private higher education industry. The campus closures due to Covid-19 have led to a drastic decline in new student enrolment, increased student deferments while disrupting academic calendars and campus operations, with some universities and colleges likely to close down or merge. Institutions have had to pivot to online learning to try and maintain learning and business continuity. The pandemic accelerated digital adoption across the global higher education sector. For any recovery to be meaningful and sustainable, there must be reform. This chapter explores how higher education must transform in the new normal post Covid-19 pandemic. It implores university leaders to reimagine and adopt game changing strategies in curriculum design, assessment, and delivery in order to sustain and grow ahead of the market when the pandemic is over.

The contribution of private higher education institutions (PHEIs) in Malaysia is important to the higher education industry. Among the roles of PHEIs are providing a pathway to local and international students to the tertiary level of education, contributing towards making Malaysia an international and highly reputable hub for higher education as well as limiting the flow of our intellects to foreign countries. However, there has been a major concern over the performance of PHEIs. Due to the volatility of the higher education landscape, many local PHEIs are facing with serious issues and challenges which affect their organizational self-sustainability. If the issues and challenges are not seriously addressed, it could impede the growth of PHEIs as well as become the barriers to PHEIs to serve their roles in Malaysia higher education sector. This conceptual paper provides some insights into the issues and challenges of PHEIs in Malaysia. It also identified leadership and innovation as the critical success factors for PHEIs organizational self-sustainability and proposed that these two independent variables are tested in future research.

The position of the lecturer as a professional educator who runs the college tridharma causes the legal relationship of the lecturer of Private Higher Education with the Private University Administration Board to have its own distinct characteristic from the legal relationship in the labor law which is characterized by a limited relationship or sub-ordinate (dienstverhovding) Which characterizes the relationship between the government/the authorities and the people. The construction of these different legal relationships causes the courts in Indonesia to have no strong foothold regarding the absolute authority to adjudicate disputes or disputes arising in the legal relations of Private University lecturers with the Private University Organizing Body. Thus, it is necessary to create a new concept of legal relationship in parallel position whose basic rights and obligations are determined by the Law because the implementation of education should be the obligation of the government so that the people who assist its implementation should be given optimal protection both in terms of freedom of academic pulpit and welfare protection of lecturers
