Freedom of association operates as an organizational "meta-norm," appreciated both as an independent value and as a touchstone for the institutional design of the International Labour Organization (ILO). Despite the renewed interest of the ILO in various aspects of the norm, its understanding of freedom of association lacks a comprehensive normative framework. This article presents such a conceptual framework and a critical in-depth analysis of current ILO freedom of association jurisprudence. Freedom of association should be understood in terms of equitable dialogue (ED), a term offered and developed herein, as an understanding that is already partly embedded in ILO jurisprudence.

Masalah hak-hak dan kesejahteraan buruh di perusahaan-perusahaan Di Indonesia kian marak dibicarakan terkait masalah pelanggaran HAM yaitu, pemberian hak yang seharusnya sesuai dengan hak buruh yang telah diatur dalam UU maupun ILO . Sulitnya bagi buruh untuk memperjuangkan sendiri kesejahteraannya, mengakibatkan terjadinya ketidakpuasan yang pada akhirnya akan menimbulkan gejolak sosial dan ketidakstabilan perekonomian. Jika tidak ada perwujudan nyata dari pihakpihak yang berwenang mengenai permasalahan ini, dapat mengakibatkan terjadinya stagnasi bahkan kemunduran untuk jangka panjang tidak hanya dari sisi karyawan, juga terhadap perusahaan dan negara secara keseluruhan. Buruh membutuhkan perhatian atas nasib mereka sebagai sumber daya dan aset perusahaan.Kata Kunci:  Hak Asazi Manusia, Buruh, Teori KeadilanThe problem of the rights and prosperity of labor in companies in Indonesia being discussed related to human rights violations, namely, workers rights entitlements refers to government regulation and ILO. The labors’ difficulties in reaching their own prosperities resulted the dissatisfaction which leaded to social and economic instability. If there is no real appropriate manifestation from authorities of about it, , it can lead to stagnation and even retrogression for long time, not only in employees side, as well as to the companies and the country. Labors need attention for their fate as the company resources and assets. Key Words: Human Right, Labor, Justice Theory

Since the Coronavirus Disease 2019 (Covid-19) pandemic in Indonesia, which continues to grow and has an impact, not a few companies have gone bankrupt. Whether it's a small company, a medium-sized company or even a large corporation are affected by the Coronavirus Disease 2019 (Covid-19). This paper aims to find legal issues on labor right during Covid-19 pandemic in Indonesia. Using the normative legal research, this paper analyzess some of regulation and legal government act to protect labor right who terminated (Pemutusan Hubungan Kerja/PHK) during Covid-19 pandemic. In the end, this paper finds that the government issued two program to solve PHK and protect labor rights, namely Pre-Works Card and Cash Incentive Program (Bantuan Langsung Tunai/BLT). It actively helps employee to create a new job and continue their daily life.

This paper describes the demand of the labor union movement which to attend the justice of the labor payment policy. In the reformation era, there are many conflict among the labor union movement against the association of the implementation of the Indonesian Entrepreneur Association (APINDO-ASOSIASI PENGUSAHA INDONESIA) and the goverment to take place as the mediator and decided some labor policy.Strikes becomes the tools of the labor union for struggle their labor right such as compensation, salary, the regional minimum fee (UMR) and another insentive.The effect of the Minister of Man Power act number 150/2001, makes many enterprise has reallocated to another country in ASEAN, especially to Vietnam who decided the open policy investment.
