An increasing number of African States are recognizing customary land tenure. Yet, there is a lack of research on how community rights are recognized in legal and policy frameworks, how they are implemented in practice, and how to include marginalized groups. In 2018–2019, we engaged in collaborative exploratory research on governing natural resources for food sovereignty with social movement networks, human rights lawyers and academics in West and East Africa. In this article, we reflect on the process and methods applied to identify research gaps and partners (i.e., two field visits and regional participatory workshops in Mali and Uganda), with a view to share lessons learned. In current debates on the recognition and protection of collective rights to land and resources, we found there is a need for more clarity and documentation, with customary land being privatized and norms rapidly changing. Further, the voices of women and youth are lacking in communal land governance. This process led to collaborative research with peasant and pastoralist organizations in Kenya, Tanzania, Mali and Guinea, with the aim to achieve greater self-determination and participation of women and youth in communal land governance, through capacity building, participatory research, horizontal dialogues and action for social change.

This book argues that the mass party emerged as the product of two distinct but related “primitive accumulations”—the dismantling of communal land tenure and the corresponding dispossession of the means of local administration. It illustrates this argument by studying the party central to one of the longest regimes of the 20th century—the Partido Revolucionario Institucional (PRI) in Mexico, which emerged as a mass party during the 1930s and 1940s. I place the PRI in comparative perspective, studying the failed emergence of Bolivia’s Movimiento Nacionalista Revolucionario (MNR) (1952–64), attempted under similar conditions as the Mexican case. Why was party emergence successful in one case but not the other? The PRI emerged as a mass party in areas in Mexico where land privatization was more intensive and communal village government was weakened, enabling the party’s construction and subsequent absorption of peasant unions and organizations. Ultimately, the overall strength of communal property-holding and concomitant traditional political authority structures blocked the emergence of the MNR as a mass party. Where economic and political expropriation was more pronounced, there was a critical mass of individuals available for political organization, with articulatable interests, and a burgeoning cast of professional politicians that facilitated connections between the party and the peasantry.

AbstractThis study explores the challenges of land tenure reform for three former settler colonies in southern Africa–Zimbabwe, Namibia, and South Africa. While land redistribution programmes have been the primary focus of land reform for these countries since independence, land tenure reform for the inhabitants of communal areas is an equally important and complex policy challenge. Before independence, the administration of these areas was more or less in the hands of traditional leaders, whose roles were sanctioned by the colonial and apartheid authorities. Therefore, one of the primary concerns with respect to reforming land tenure systems in communal areas is related to the power and authority of traditional leaders in the post-independence period. This study highlights striking similarities in the nations’ land tenure reform policies. All of them gave statutory recognition to traditional leaders and strengthened their roles in rural land administration. In understanding this ‘resurgence’ or tenacity of traditional leadership, the symbiotic relationship between the ruling parties and traditional leaders cannot be ignored and should be problematised. Nonetheless, this chapter also argues that this obsession with traditional leadership may result in the neglect of other important issues related to land tenure reform in communal areas, such as the role of customary land tenureas social security.

The facts in this case, which fell to be decided by the Supreme Court of Namibia in November 2018, can be succinctly put: in 1985, Ms Kashela’s late father was allocated a piece of land as part of communal land by the Mafwe Traditional Authority (MTA) in the Caprivi region of the then-South West Africa (now Namibia). In 1985, the Caprivi region fell under the then-South West Africa Administration. Following the independence of Namibia on 21 March 1990, all communal lands became property of the state of Namibia by virtue of section 124 of the Constitution of Namibia Act 1 of 1990, read with Schedule 5 of the Constitution. Paragraph (3) of Schedule 5 of the Constitution states that the afore-mentioned communal lands became property of the state “subject to any existing right, charge, obligation or trust existing on or over such property”.

Although it diverges markedly from the vision of the Melanesian Way elaborated in the 1975 constitution, large-scale resource extraction has in recent decades been championed as the key mechanism for development in Papua New Guinea. In this context, forms of “middle-way” land reform are advocated as means of rendering customary land tenure commensurable with the requirements of modern, capitalist practices of production and economic activity. Principal amongst these are Incorporated Land Groups (ILGs) and lease-lease-back arrangements. Ethnographic exploration of communities affected by the tuna industry in Madang Province shows how these land reforms transform structures and cartographies of power, privileging the agents of the state and global capital at the same time that they transform relations of power within communities. At the same time, however, forms of codification and the assertion of landowner identities allow communities to make claims against outside agents involved in resource extractive activity on their lands.
