Any business entity in a competitive environment must assess the degree of its own competitiveness in order to function effectively and assess its prospects for the future. Having information about personal competitive positions, industrial firms have the opportunity to reveal their advantages, choose the right tactics of behavior and strategy, true to the realities of the latest market processes. The basis of competitive advantages of enterprises is the socio-economic and progressive technological and organizational base, the ability to analyze and take timely measures to strengthen competitive advantages. The article analyzes ways to increase the competitiveness of Ukrainian enterprises. At the current stage of development of the national economy, the main issue to be addressed is the development of effective facilitators and mechanisms that will increase the competitiveness of domestic producers in the market and will guarantee the overall strengthening of Ukraine’s economic situation. The purpose of the article is to identify ways to increase the competitiveness of the enterprise. Compare the tools that allow you to find your weaknesses, the elimination of which can increase the competitiveness of the organization. The strategic goal is to increase the competitiveness of the domestic economy through innovation, which will create advantages for domestic producers to compete with opponents in domestic and international markets, and help Ukraine to take one of the first places among developed countries. Competitiveness is a key concept that is actively used in theory and practice of management, is a multifaceted concept, which translated from Latin means rivalry, the struggle to achieve the best results. This opens for Ukraine the possibility of transition to world standards of rational and reasonable energy consumption, development of natural resources, raising the level of technology, legal protection of intellectual property. The ultimate goal of these shifts is to create progressive and competitive innovative products on world markets. It should be noted that in the context of globalization and ever-increasing competition, the basis of competitiveness is innovation, which allows countries with innovative competitive advantages to take their rightful place in the world community.

At the present stage of development of the Ukrainian economic system, the concept of «competitiveness» and its effective organizational support is becoming increasingly important. The problem of competitiveness management is recognized as one of the most important in the theory and practice of economics. It is important for Ukrainian enterprises operating in a transitive economy, whose competitive position in today's world markets remains insufficiently high. A significant number of scientists agree that in the context of rapid globalization and an informatized society, it is impossible to achieve the projected level of economic development due to traditional intensive and extensive factors of production. For companies operating internationally or seeking to develop their own foreign economic activity and face international competition, it is important not only to offer certain goods and services to the market, but to achieve sustainable competitive advantages in the global economic space. A significant place in the process of increasing the competitiveness of modern ukrainian enterprises is occupied by the organizational support of competitiveness management. In the course of this study, the problem of managing the competitiveness of modern ukrainian enterprises was considered, as well as the organizational and economic model of managing the competitiveness of the enterprise in terms of entering foreign markets was proposed. The results of the study are of practical importance for the enterprise of non-specialized wholesale trade LLC EL-ITEX, as proposed in the article organizational and economic model will create a kind of «foundation» for effective management of the competitiveness of the enterprise in terms of entering new markets.


The article studies the theory and practice of using the most important categories of state regulation of foreign trade – protectionism and free trade. That rational regulation in foreign trade policy can lead to the development of nation economies. The study considers historical aspects of the relevance of protectionism and free trade for different countries and their correlation under the influence of technological progress; underlines the urgency of the protectionism at the present stage of development of the world economy. Such a topicality of protectionism is caused by new phenomena in geopolitics and geo-economics that occurred at the turn of the century. The authors agree with the point of view that has been voiced in the past (by Friedrich Liszt), that free trade is an effective policy for developed countries. For those who do not have a highly developed industrial sector, elements of protectionism to protect the domestic economy remain extremely relevant. The policy that is imposed on the underdeveloped countries by the "Washington Consensus" pattern condemns the latter to a permanent lag. The ideas of protectionism remain topical for post-Soviet countries, where deindustrialization occurred during the quarter of a century, the share of the manufacturing sector in the structure of the national economy dropped sharply, and economic growth rates fell.

In today's market economy, competition is an important concept. Today, issues of competition and competitiveness are especially relevant due to the processes of globalization and intensification of competition between producers of goods and services. As a result, the question arises as to what makes one producer better than another and whether he is able to fully meet the needs of his consumer, thus ensuring his profit? Therefore, assessing the competitive advantages, production, personnel, technological and marketing capabilities of the enterprise, as well as identifying ways to improve them affect the competitiveness of the enterprise in both domestic and foreign markets, as well as the possibility of expanding into new markets. Assessing the competitiveness of the enterprise allows to determine its advantages and disadvantages in comparison with competitors, identify ways to improve it, strengthen the company's position in the national market and identify new target markets. The article provides a review of scientific literature, research and publications on the subject of research, describes the methods, their advantages and disadvantages for assessing the competitiveness of the enterprise in terms of entering new international markets. The stages, the sequence of which must be followed when assessing the competitiveness of enterprises, are summarized. The main indicators, factors, as well as some characteristics of the product that affect the competitiveness of enterprises are presented. It is established that for effective assessment of the competitiveness of the enterprise in terms of entering new international markets, it is advisable to use a set of several valuation methods using a certain sequence. The evaluation results influence the choice of strategy and forms of the company's entry into new international markets, market choice, sales policy, and also allows to effectively assess the company's performance and ability to respond quickly and effectively to external changes, make the right management decisions and take measures to improve competitiveness of the enterprise.

Последние двадцать лет было предпринято немало усилий для активизации инновационной деятельности в стране. Тем не менее, статистические материалы ФСГС РФ свидетельствуют, что ожидаемые результаты в виде значимого роста инновационной составляющей ВВП и объемов реализации российских инновационных продуктов на международных рынках так и остались нереализованными. Бесспорно, все это актуализирует необходимость поиска современных подходов, точек роста инновационного развития. В первую очередь, речь идет о государственных высокотехнологичных корпорациях. Именно в них создаются новые знания, появляются новые компетенции, развиваются прорывные производственные технологии и др. Для мировой экономики характерно циклическое развитие, активный рост всегда сменяется стагнацией, кризисом. Вместе с тем, даже во время острейшего кризиса путем трансформации структуры экономики и рынка можно получить дополнительные возможности для экономического рывка и захвата новых рынков для своих продуктов. Очевидно, что все это сопряжено с решением комплекса задач: корпорациям необходимо оптимизировать свой организационный дизайн, реализовать эффективное стратегическое управление, направленное на укрепление позиций на соответствующих рынках, наращивать конкурентные преимущества и т. п. Over the past twenty years, a lot of efforts have been made to spur innovation in the country. Nevertheless, the statistical materials of the Federal State Statistics Service of the Russian Federation indicate that the expected results in the form of a significant increase in the innovation component of GDP and the volume of sales of Russian innovative products in international markets remained unrealized.Undoubtedly, all this actualizes the need to search for modern approaches, points of growth for innovative development. First of all, we are talking about state high-tech corporations. It is in them that new knowledge is created, new competencies appear, breakthrough production technologies are developed, etc.The world economy is characterized by cyclical development, active growth is always replaced by stagnation, crisis…At the same time, even during the most acute crisis by transforming the structure of the economy and the market, you can get additional opportunities for an economic breakthrough and capture new markets for your products.It is clear that all this is associated with solving a set of tasks: corporations need to optimize their organizational design, implement effective strategic management aimed at strengthening positions in the relevant markets, increase competitive advantages, etc. All this prompted us to take up the stated research topic.

The article presents a scientific discussion on trends and prospects for product innovation in the tourism business. The main objective of the study is to substantiate the nature and role of innovative tourism products in improving the efficiency of economic and product activities of tourism enterprises, the need for their implementation in tourism at its present stage in Ukraine. Analysis of literature sources and existing approaches to solving the problem of implementation of innovative products by tourism enterprises allowed us to formulate conceptual tools in this area, taking into account industry specifics, to characterize the types of product innovations of tourism enterprises. The topicality of solving this scientific problem boils down to the fact that in conditions of competition, the development of tourism business is ensured primarily by the use of product innovations by tourism enterprises, the introduction of effective ways to implement priority areas of innovation. The study of the problem of implementation of innovative tourist products in the practical activities of enterprises is carried out in the following logical sequence: the subject matter and types of innovative tourist products have been analysed, the main prerequisites for their implementation in the activities of enterprises have been defined; the main trends in the development of innovations in the tourism business of Ukraine, in particular, new tourism products and innovative approaches used to retain regular customers and attract new ones in a competitive environment; an optimal model of implementation of innovative tourist products has been developed. The methodological tools of the conducted study were general theoretical and specific methods, in particular, logical and dialectical, graphoanalytical method, method of scientific abstraction, systemic and integrated approaches. The study covered the period of 2010—2019. The object of research is an innovative tourist product that allowed implementation of its model taking into account the effect of external and internal environment. The article presents the results of empirical analysis of the main trends in the development of innovation at the present stage of development of the tourism business in Ukraine. In addition, there are reasons that inhibit innovation in tourism, which must be taken into account for the development and implementation of innovative tourist products. The study theoretically proves and supports that the development of innovative activities and the introduction of innovative tourist products provide tourism enterprises with competitive advantages. The results of the study can be useful in the practical work of travel agencies that seek to create a portfolio of innovative products and increase the efficiency of their activities.

With the adoption of the World Trade Organization’s (WTO) Agreement on Trade-Related Aspects of Intellectual Property Rights (henceforth, TRIPS), the WTO members agreed to provide a minimum level of Intellectual Property (IP) protections to a broad range of subjects, including “undisclosed test or other data.” However, following the entry into force of TRIPS, some WTO members (particularly, developed countries) have concluded Free Trade Agreements (FTAs) that consist of TRIPS-plus provisions, which go beyond the minimum standard established under TRIPS. One of the agreements that represent such a trajectory is the newly renegotiated agreement between the U.S, Mexico and Canada. The agreement has been negotiated, among other issues, to replace the North American Free Trade Agreement (NAFTA). This trilateral agreement also changed the name NAFTA to the United States-Mexico-Canada (USMCA) Agreement or NAFTA 2.0. The new agreement contains rules that govern undisclosed test or other data (hereafter, test data), which biopharmaceutical companies submit to Health Regulatory Authorities for the purpose of obtaining the right to market biological medicines (hereafter, biologics). Drawing upon the aforementioned background, this article examines if and how USMCA’s test data rule contravenes the obligations of the USMCA Parties to fulfill, protect and respect the right to biologics, as contained under the International Covenant on Economic, Social and Cultural Rights (hereafter, ICESCR) and other international human rights instruments that cover the right to health. The first section provides an overview of USMCA, the second section addresses the nature of legal protection given to test data under the TRIPS Agreement, the third section is devoted to examining the nature of obligation as contained under USMCA’s rule on test data, the fourth discusses the legal basis of the right to biologics, while the fifth section assesses if and how the rule on test data impedes the USMCA Parties from realizing the right to biologics. The last section provides a conclusion.

В статье на основе анализа оперативно-розыскного, трудового и пенсионного законодательства РФ исследуется специфика пенсионного обеспечения граждан, конфиденциально содействовавших оперативным подразделениям УИС. Проводится сравнительно-правовой анализ мер социальной и правовой защиты конфидентов с учетом двух основных форм содействия, выделяемых в теории и практике оперативно-розыскной деятельности: контрактной и бесконтрактной. Рассматривая меры пенсионного обеспечения в рамках общей системы мер социальной и правовой защиты лиц, оказывающих содействие на бесконтрактной основе, автор отмечает отсутствие законодательного закрепления права данной категории лиц на зачет периода содействия в страховой стаж, предусмотренного ч. 6 ст. 18 ФЗ «Об ОРД». В свою очередь, исследуя вопрос пенсионного обеспечения, автор акцентирует внимание на основаниях возникновения правовых отношений, складывающихся между конфидентом и органом, осуществляющим ОРД, а также на выяснении характера данных отношений. Проводится сравнительно-правовой анализ контракта о негласном содействии с трудовым и гражданско-правовым договорами. На основании проведенного анализа норм оперативно-розыскного, трудового и пенсионного законодательства РФ выделяются три обязательных условия, необходимых для включения в страховой стаж периода контрактного сотрудничества конфидента: 1) наличие контракта о содействии; 2) сотрудничество должно быть основным видом оплачиваемой деятельности лица; 3) периодам содействия должны были предшествовать и (или) за ними должны были следовать периоды деятельности, указанные в ст. 11 ФЗ «О страховых пенсиях». Делается вывод о необходимости внесения изменений в ст. 18 ФЗ «Об ОРД». Based on the analysis of the operational-search, labor and pension legislation of Russia, the article studies the specifics of pension provision for citizens who provided confidential assistance to operational unts of FPS of Russia. A comparative legal analysis of measures of social and legal protection of persons providing confidential assistance is carried out, taking into account the two main forms of assistance identified in the theory and practice of operational-search activity: contractual and non-contractual. Considering the measures of pension provision within of persons providing assistance on a non-contractual basis, the author notes the absence of legislative consolidation of the right of this category of persons to offset the period of assistance in the insurance experience provided for in Part 6 of Art. 18 of the Federal Law «About operatively-search activity». Investigating the issue of pension provision for persons providing confidential assistance on a contract basis, the author draws attention to the grounds for the emergence of legal relations between the confidant and the body carrying out operational-search activities, and clarification of the nature of these relations. A comparative legal analysis of the contract for covert assistance with labor and civil contracts is carried out. Based on the analysis of the norms of the operational-search, labor and pension legislation of Russia, there are three mandatory conditions necessary for offsetting the period of confidential cooperation of a citizen on a contractual basis in the insurance record: 1) the existence of a cooperation contract; 2) cooperation should be the main type of paid activity of the person; 3) the periods of assistance should have been preceded and / or followed by the periods of activity specified in Art. 11 Federal Law «On Insurance Pensions». It is concluded that it is necessary to amend Art. 18 of the Federal Law «About operatively-search activity».

This article discusses the ranking of metallurgical complexes. The attention is paid to the study of Kazakhstan's position in the world. The analysis showed that Kazakhstan takes 34th place in the world in steel production. The leaders are Asian countries such as China, Korea, India, which account for about a third of steel production in the world. At the present stage of development, there is a tendency towards globalization of production in the field of metallurgy, associated with the influence of the world economy on many parameters of the metallurgical industry. Such trends, in turn, lead to higher prices for metal products on world markets. Another trend is the continuous modernization of the production process. The experience of developed countries in the field of metallurgy shows that a new level of quality requires the creation of innovative production capacities that are periodically modernized. The attention should also be paid to the expectations of consumers of metal products with special structural and technological properties. Innovative technologies are developing rapidly to improve the quality of finished metal products. The interest in the development of metallurgy in the world led to the development of various strategies for managing metallurgical complexes aimed at increasing the share of products with high added value, strengthening production cooperation, and the formation of transnational production chains. This experience and global trends should be taken into account when managing the metallurgical complex of Kazakhstan.

The article focuses on assessing the current situation and analyzing foreign experience, studying the main issues of organizing commodity movement, solving problems of wholesale food trade, and improving the mechanism of state support in this area to realize Russia’s competitive advantages and opportunities in the domestic and international markets.
