Religion and Education… The problem of their relationship has long interested the pedagogical community and the Church. Recently, in connection with the actualization of a religious factor in public and spiritual life, the desire of some Churches to use the public school selfishly, outrightly and illegally, it has appeared in Ukraine as well. The question is not whether or not to give knowledge of religion through the education system. The question arises as to what knowledge and to what extent it should be taught, when, where and by whom it should be given. The question also arises as to whether there should be two systems of education in parallel - secular and spiritual, and whether spiritual education by its status should be equated with secular and attested by the same documents as in the sphere of secular life. But if this is the case, then it is likely that spiritual education is then subject to the rule of studying in educational institutions the compulsory list-minimum of the disciplines currently taught in all secular educational establishments and which form a broad outlook on their recipients.

There is a question of what knowledge and how much it can be taught about when, where and who should give them. There is still a question and whether there should exist in parallel two systems of education - secular and spiritual, and whether spiritual education by its status should be equated with secular and certified by the same documents, which are valid in the sphere of secular life. But if that is the case then it is likely that spiritual education is then covered by the rule of studying in the educational institutions of the compulsory list-the minimum of educational disciplines, which are now taught in all secular educational institutions and which form a broad world view of their recipients. It would seem that the Ministry of Education and Science should also be subject to the control of spiritual education. The state should know not only what they are taught here, but also how and who they are teaching.

The article analyzes the system of spiritual education in Russian theological educational institutions. It is shown that the Spiritual and Educational Directorate, created during the reign of Nicholas I, made significant changes in the curricula of theological schools. The author revealed contradictory results in the field of spiritual education following the results of these transformations. The work used legislative acts, archival and documentary materials.

Acquaintance with the work of "Problems of Ukrainian Religious Consciousness" by Arsen Richinsky showed that the questions raised by the researcher at the beginning of XX century. even more actualized at the beginning of the XXI century. - in the period of Ukrainian Independent Nation's approval, when with the adoption of the Law of Ukraine "On Freedom of Conscience and Religious Organizations", in 1991 the influence of religious factor on the consciousness of Ukrainian society increased. This research, without exaggeration, is a tremendous contribution to the Ukrainian theoretical and practical religious studies. Also important is the scientific editing and streamlining of its leading contemporary scholars in the field of national-religious issues A. Kolodny, O. Sagan, and A. Goodyma, without which it would remain unknown to the reader and history as a whole, and would not be an incomplete component of the Christian factor - universal perception of the gospel doctrine through the prism of national color.

The word "freedom" at all times was worried by progressive humanity. The notion of "freedom of conscience" is one of the specific varieties of the word. At the end of the nineteenth and early twentieth centuries. He was interpreted in all ways abroad and in Russia in particular. Declared by the manifesto of the king in 1905, the freedom of conscience, according to many, did not bring the expected release of "religious slavery." For several decades, the Soviet ideologues have argued that only the Leninist decree on freedom of conscience, church and religious organizations, or, in other words, the Decree on the separation of church from state and school from the church, issued in 1918, marked a new era in the spiritual life of the people.

Статья посвящена церковному и государственному регулированию правового положения духовных учебных заведений Русской Православной Церкви в Российской Федерации в современный период. Основная цель исследования заключается в анализе правового статуса духовных учебных заведений как религиозных организаций, с одной стороны, и как образовательных организаций, с другой стороны. Первичность правового статуса религиозной организации отличает правовое положение духовных учебных заведений от остальных образовательных организаций. В связи с необходимостью соблюдения положений Конституции России, касающихся свободы совести и вероисповедания, положений Федерального закона «О свободе совести и о религиозных объединениях», а так же норм международного права, государство и Церковь ведут поиск правовых решений во избежание дискриминации христиан в реализации их права на подготовку священнослужителей, церковнослужителей и религиозного персонала согласно внутренним установлениям Русской Православной Церкви. В статье представлены особенности церковного статуса духовных учебных заведений, связанных, прежде всего, с предъявлением требования к студентам и преподавателям высокого уровня христианской нравственности, а также особенности государственного статуса, которые призваны обеспечить, по возможности, все требования церковного статуса духовных учебных заведений. The article is devoted to the Church and state regulation of the legal status of theological educational institutions of the Russian Orthodox Church in the Russian Federation in the modern period. The main purpose of the study is to analyze the legal status of religious educational institutions as religious organizations, on the one hand, and as educational organizations, on the other. The primacy of the legal status of the religious organization distinguishes the legal status of theological educational institutions from other educational organizations. In connection with the need to comply with the provisions of the Constitution of Russia concerning freedom of conscience and religion, the provisions of the Federal Law «On Freedom of Conscience and Religious Associations», as well as the norms of International Law, the state and the Church are looking for legal solutions to avoid discrimination training of clergy and religious personnel in accordance with the internal regulations of the Russian Orthodox Church. The article presents the features of the church status of theological educational institutions, associated, first of all, with the presentation of requirements for students and teachers of a high level of Christian morality, as well as the features of state status, which are designed to ensure, if possible, all the requirements of the church status of theological educational institutions.

AbstractPositive spirituality is about acknowledging the personal spiritual growth that can occur through the use of some techniques from positive psychology. Contemporary educational philosophy within secular government educational departments rarely, if ever, addresses the notion of a spiritual life within educational institutions. Religious schools, on the other hand, usually include prayer and spirituality at the foundation of their educational aims. There is a clear disconnection between the two systems in this respect. Positive spirituality potentially provides a bridge between these two systems, bringing a focus on a broad notion of spirituality to otherwise secular government/public systems, and scientifically validated approaches to potentially narrowly focused religious schools. For instance, meditative techniques, relaxation, and physical stillness can help bring spiritual awareness to the fore, and in the process highlight a connection to something larger than oneself—the very goal of all mystics and a noble educational objective as teachers strive to inspire a greater sense of meaning and purpose in their students.
