Mahkamah Konstitusi sebagai lembaga yang lahir berdasarkan amandemen UUD 1945 memiliki fungsi sebagai lembaga terakhir penafsir konstitusi atau yang sering disebut sebagai the final interpreter of constitution. Fungsi ini biasanya dilaksanakan Mahkamah Konstitusi dalam kewenangannya menguji undang-undang terhadap Undang-Undang Dasar 1945. Terhadap frasa, ayat, pasal atau undang-undang yang dianggap tidak jelas atau multitafsir telah dimohonkan untuk diberikan penafsiran sesuai dengan konstitusi. Pun demikian dengan frasa keadilan sosial yang terdapat dalam beberapa undang-undang yang telah diputus Mahkamah Konstitusi. Terdapat 16 (enam belas) putusan dengan 10 (sepuluh) isu konstitusional dalam pengujian undang-undang selama periode 2003–2010 dalam bidang ketenagalistrikan, minyak dan gas bumi, ketenagakerjaan, sistem jaminan sosial nasional, sumber daya air, penanaman modal, pajak penghasilan, pengelolaan wilayah pesisir dan pulau-pulau kecil dan pertambangan mineral dan batu bara. Dari 10 isu konstitusional tersebut, dalam pertimbangan hukumnya Mahkamah lebih sering memilih menggunakan interpretasi gramatikal, interpretasi historis, interpretasi teleologis atau sosilologis dan interpretasi komparatif atau perbandingan. Mahkamah Konstitusi menyatakan bahwa keadilan sosial dalam Pembukaan UUD 1945, mengandung makna “penguasaan negara” artinya negara harus menjadikan penguasaan terhadap cabang produksi yang dikuasainya itu memenuhi tiga hal yang menjadi kepentingan masyarakat: ketersediaan yang cukup, distribusi yang merata, dan terjangkaunya harga bagi orang banyak. Dengan dikuasai oleh negara, keadilan sosial diartikan mencakup makna penguasaan oleh negara dalam luas yang bersumber dan diturunkan dari konsepsi kedaulatan rakyat Indonesia atas segala sumber kekayaan “bumi, air dan kekayaan alam yang terkandung di dalamnya”, termasuk pula di dalamnya pengertian kepemilikan publik oleh kolektivitas rakyat atas sumber-sumber kekayaan dimaksud. The Constitutional Court as an institution born based on the amendments to the 1945 Constitution has a function as the final interpreter of constitution. This function is usually carried out by the Constitutional Court in its authority to examine laws against the 1945 Constitution. Regarding phrases, verses, articles or laws that are deemed unclear or multiple interpretations have been requested to be interpreted in accordance with the constitution. Even so with the phrase social justice contained in several laws that have been decided by the Constitutional Court. There are 16 (sixteen) decisions with 10 (ten) constitutional issues in judicial review during the 2003–2010 period in the fields of electricity, oil and gas, employment, national social security systems, water resources, investment, tax income, management of coastal areas and small islands and mining of minerals and coal. Of the 10 constitutional issues, in its legal considerations the Court often chooses to use grammatical interpretations, historical interpretations, teleological or sosilological interpretations and comparative or comparative interpretations. The Constitutional Court stated that social justice in the Preamble of the 1945 Constitution, contained the meaning of "state control" means that the state must make control of the controlled branch of production fulfill three things that are in the public interest: adequate availability, equitable distribution and affordability. By being controlled by the state, social justice is interpreted to include the meaning of control by the state in a broad sense that is derived and derived from the conception of the sovereignty of the people of Indonesia over all sources of wealth "earth, water and natural wealth contained in it" the people for the intended sources of wealth.

Fungsi negara tidak hanya sebagai regulator (pengatur) dan umpire (wasit), namun juga berfungsi sebagai provider (penyedia) dan entrepreneur (pengusaha). Oleh karena itu, sudah seharusnya negara terlibat langsung dalam usaha penyediaan listrik untuk kepentingan umum bagi sebesar-besarnya kemakmuran rakyat sebagaimana amanat Pasal 33 UUD 1945. Usaha penyediaan listrik untuk kepentingan umum dengan unbundling system yaitu terpisahnya antara usaha pembangkitan, transmisi, distribusi, dan penjualan listrik, telah dinyatakan inkonstitusional oleh Mahkamah Konstitusi dalam Putusan Nomor 001-021-022/PUU-I/2003, bertanggal 15 Desember 2004. Namun kemudian adanya putusan Mahkamah Konstitusi Nomor 149/PUU-VII/2009, bertanggal 30 Desember 2010, justru dipandang sebagai peluang dibolehkannya kembali sistem unbundling dalam usaha penyediaan listrik sebagaimana ketentuan Pasal 10 ayat (2) Undang-Undang Nomor 30 Tahun 2009 tentang Ketenagalistirkan. Hal tersebut kemudian mendorong diajukannya kembali permohonan pengujian terhadap ketentuan Pasal 10 ayat (2) Undang-Undang Nomor 30 Tahun 2009. Melalui Putusan Nomor 111/PUU-XIII/2015, bertanggal 14 Desember 2016, Mahkamah Konstitusi pun menegaskan bahwa unbundling dalam usaha penyediaan tenaga listrik adalah tidak sesuai dengan konstitusi.The function of the state is not only as a regulator and referee, but also serves as provider and entrepreneur. Therefore, the state should be directly involved in the business of electric providing for the public interest to the greatest prosperity of the people as mandated by Article 33 of the 1945 Constitution. The unbundling system in electric providing for the public interest is the separation between the business of generation, transmission, distribution, and sales. The unbundling system has been declared unconstitutional by the Constitutional Court in Decision Number 001-021-022/PUU-I/2003 dated December 15, 2004. However, the decision of the Constitutional Court Number 149/PUU-VII/2009 dated 30 December 2010, is judged as an opportunity to re-enable the unbundling system in the business of electric providing as stipulated in Article 10 paragraph (2) of Law Number 30 Year 2009 about Electricity. It then encourages the re-submission of the petition for judicial review of the provisions of Article 10 paragraph (2) of Law Number 30 Year 2009. Then, through Decision Number 111/PUU-XIII/2015, dated December 14, 2016, the Constitutional Court confirm that unbundling in the business of providing power electricity for public interest is inconstitutional.

Doktrin Mahkamah Konstitusi (MK) yang dahulu dipercaya hanya sebagai negative legislature telah bergeser menjadi positive legislature. Menjadi pertanyaan, apakah doktrin MK sebagai negative legislature maupun positive legislature, dapat pula dimaknai sebagai negative budgeter dan positive budgeter dalam pengujian Undang-Undang Anggaran Pendapatan dan Belanja Negara (UU APBN). Berdasarkan hasil kajian konseptual dan pendalaman terhadap beberapa putusan MK dalam pengujian UU APBN, secara nyata dan dalam keadaan tertentu, doktrin MK sebagai negative legislature dapat dimaknai sebagai negative budgeter dalam bentuk pernyataan mata anggaran tertentu dalam UU APBN bertentangan dengan UUD 1945. Bahkan dapat pula dimaknai sebagai positive budgeter karena MK juga mengharuskan pemerintah dan DPR untuk menambahkan mata anggaran tertentu dalam UU APBN. Hal tersebut tidak lain sebagai bentuk diakuinya supremasi konstitusi, sehingga MK yang berperan sebagai the guardian constitution harus menjaganya. Apalagi dalam UUD 1945 terdapat pasal yang spesifik menyebut batas minimal anggaran pendidikan 20% dan pasal-pasal lain yang mengharuskan APBN harus dipergunakan untuk sebesar-besarnya kemakmuran rakyat.The doctrine of the Constitutional Court which was previously believed to be only as a negative legislature has shifted into positive legislature. The question, is the doctrine of the Constitutional Court as a negative legislature and a positive legislature can also be interpreted as a negative budgeter and a positive budgeter in the judicial review of the State Budget Law. Based on the result of conceptual study and deepening of several decisions of the Constitutional Court in the judicial review of the State Budget Law, in real and in certain circumtances, the doctrine of the Constitutional Court as a negative lagislature can be also interpreted as a negative budgetary in the form of specific budget items in the State Budget Law contradictory to the 1945 Constitution. Also as a positive budgeter because the Constitutional Court requires the executive and the legislative to add a specific budget in the State Budget Law. It is a form of recognition of constitutional supremacy, so that the Constitutional Court can role as the guardian constitution. Moreover in the 1945 Constitution there is a specific article that mentions the minimum limit of 20% education budget and other articles that require the state budget should be used for the greatest prosperity of the people.

The polemic of Marriage Law Number 1 of 1974 is back into hot issue to be discussed. It reminds to the public discussion in a long history and the dynamics of the appearance of this laws. This time, the spotlight is article 2, paragraph 1 of the Marriage Law Number 1 of 1974 which contains "Marriage is legitimate, if it is done according to the laws of each religion and the belief it". Against with the decision, any parties asked a judicial review to the Constitutional Court (MK) for the article. This paper wants to give exposure of reactions of the people who are doing legal efforts with the proposal, as well as how to find the best solution for its completion. The core problem in this paper is to be appointed about whether or not may interfaith marriage. Referring to the Marriage Law Number 1 of 1974 and the 1945 Constitution, this paper will describe how the views of classical scholars, ulama (Muslim jurists), community leaders, officials and legal experts in the country explain about marriage in different religion.

Putusan Mahkamah Konstitusi Nomor 36/PUU-X/2012 tentang judicial review UU No. 22 Tahun 2001 tentang Minyak dan Gas Bumi telah menimbulkan perdebatan publik tentang sistem tata kelola minyak dan gas bumi di Indonesia. Adapun hasil yang ditemukan dalam penelitian ini yaitu, Pertama, konsep “hak menguasai negara” dalam Pasal 33 UUD 1945 secara filosofis berangkat dari konstruksi Pancasila yang memberikan kekuasaan kepada negara untuk campur tangan dalam pengelolaan sumber daya alam demi mewujudkan sebesar-besarnya kemakmuran rakyat, namun pada saat yang sama tetap memberikan peluang bagi kepemilikan perdata sepanjang tidak mendegradasi peran negara dalam pengambilan keputusan dan penentuan kebijakan. Kedua, Putusan Mahkamah Konstitusi Nomor 36/PUU-X/2012 tidak membatasi kewenangan Pemerintah dan DPR untuk membentuk badan pengelola migas tertentu sejauh tidak bertentangan dengan opsi yang terdapat dalam pertimbangan hukum MK, yakni BUMN atau Pemerintah. Terminologi “Pemerintah” dalam pertimbangan hukum MK memiliki makna yang jauh lebih luas dan tak harus dibatasi pada Kementerian ESDM, namun mencakup pula BUMN atau badan independen yang mungkin dibentuk oleh pemerintah berdasarkan peraturan perundang-undangan.The Constitutional Court Decision No. 36 / PUU-X / 2012 concerning the unconstitutionality of BP Migas in Law No. 22 of 2001 on Oil and Gas has provoked public debate about the management systems of Indonesian oil and gas. This study focuses on the following questions: First, what the meaning and the concept of the state control rights of oil and gas under the 1945 Constitution of The Republic of Indonesia?; Second, what what are the legal consequences of the Constitutional Court Decision No. 36/PUU-X/2012 on the national oil and gas management policy?. The results of the study shows the following conclusions. First, the concept of state’s rights in Article 33 of the 1945 Constitution of the Republic of Indonesia philosophically derived from the construction of Pancasila which empowers the state to involve in the management of natural resources in order to provide the prosperity of the people, but at the same time providing opportunities for private ownership as far as not to degrade the state's role in determining the decision-making and policy-making. Secondly, the Constitutional Court Decision No. 36/PUU-X/2012 does not limit the authority of the Government and the Parliament to form any oil and gas administrative body to the extent not contrary to the options proposed by the Constitutional Court, i.e. the state-owned enterprises or the government. The term ‘government’ in the legal consideration of the Constitutional Court has a much broader meaning and should not be limited to the Ministry of Energy, but also includes the SOE itself or an independent agency that may be established by the government based on the law.

Kondisi tatanan tektonik dan geologi Aceh memiliki prospek untuk dilakukan eksplorasi dan pengembangan serta produksi Minyak dan Gas Bumi, baik di Wilayah Darat maupun di Wilayah Laut. Penemuan cadangan Minyak dan Gas baru di Aceh diharapkan dapat meningkatkan Penerimaan Negara dan Penerimaan Pemerintah Aceh dalam membangun infrastruktur dan Ketahanan Energi Aceh untuk melahirkan kembali industri-industri skala internasional. Ketentuan dalam Pasal 3 Peraturan Pemerintah Nomor 23 Tahun 2015 Tentang Pengelolaan Bersama Sumber Daya Alam Minyak dan Gas Bumi di Aceh, kewenangan pengelolaan Migas pada Wilayah Laut 12 (dua belas) sampai dengan 200 (dua ratus) mil laut yang merupakan Zona Ekonomi Eksklusif (ZEE) dikelola dan dilaksanakan Pemerintah Pusat dengan mengikutsertakan Pemerintah Aceh. Tafsir dalam 3 (tiga) Putusan Mahkamah Konstitusi No. 002/PUU-I/2003, 20/PUU-V/2007 dan Putusan Mahkamah Konstitusi No. 36/PUU-X/2012 tentang Uji Materiil Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 bahwa penguasaan negara terhadap sumber daya alam dan cabang-cabang produksi yang penting bagi negara dan menguasai hajat hidup orang banyak dimaknai sebagai mandat yang harus dilaksanakan oleh pemerintah untuk mengadakan kebijakan (beleid), pengurusan (bestuursdaad), pengaturan (regelendaad), pengelolaan (beheersdaad), dan pengawasan (toezichthoudensdaad) untuk tujuan sebesar-besarnya kemakmuran rakyat.Conditions of tectonic and geological structure in Aceh prospect for explorating and producing Oil and Natural Gas, either in onshore or offshore. The discovery of Oil and Gas news reserved in Aceh is expected to increase the Central Government Take and Aceh Government Take to build infrastructure and Aceh’s Energy Security to regenerate industries on an international scale. The provisions in Article 3 of the Government Regulation Number 23 Year 2015 concerning Joint Management of Natural Resources Oil and Gas in Aceh, the joint management authority of Oil and Gas in Offshore 12 (twelve) to 200 (two hundreds) nautical miles of an Exclusive Economic Zone (EEZ) is managed and held by the Central Government to include the Government Aceh. Commentary within 3 (three) Decision of Constitutional Court Number 002/PUU-I/2003, 20/PUU-V/2007 and Decision of the Constitutional Court Number 36/PUU-X/2012 of Judicial Review of Law Number 22 Year 2001 concerning Oil and Gas (Oil and Gas Law) Against the 1945 Constitution of the State of the Republic of Indonesia the meaning of “controlled by the state” must be comprehended to include the meaning of a wide-ranging state occupation, as a result of the people’s sovereignty concept. The people, collectively constructed by the 1945 Constitution, provide a mandate to the state to conduct policy (beleid) and functions of administration (bestuurdaad), regulation (regelendaad), management (beheersdaad) and supervision (toezichthoudensdaad) for the greatest prosperity of the people.

Agriculture is a one of land resources called agrarian which brings strategic functions and roles for Indonesia as agrarian country. It is identified as being strategic due to a great number of Indonesian people who rely their lives on agricultural sector. Thus, farms do not only have economic value but also social value, and even religious one. Besides, farms are also subjected for agricultural investment activities involving huge-capital companies through which a large-scale extensification of farms will increase over time. This paper focused on the state control over agrarian resources. Starting from farms as agrarian resources, the governance rights of land by a country is based on both UUPA and the exegesis of Constitutional Court. Findings showed that there were 4 (four) models of The state control over agrarian resources based on Article 2 UUPA. However, as Constitutional Court verdict Number 002/PUU-I/2003 testing toward the Law Number 22, 2001 on oil and gas toward the Constitution 1945 was established, the state control over farms could be broadly defined as public rights for all people of Indonesia over its agrarian resources.

Many Indonesians—primarily those living in rural areas—still follow customary law (adat). The precise rules and processes of that adat differ significantly from place to place, even within short distances. This chapter shows that for many decades, adat has been subservient to national law. State-made law overrode it, leaving it applicable only in a very small proportion of cases where no national law applied, where judges could apply it as ‘living law’. Even in these cases, many judges ignored adat or distorted it when deciding cases. The 1945 Constitution was amended in 2000 to require the state to formally recognize and respect customary law, as practised in traditional communities. The Constitutional Court has given effect to this in various judicial review cases, as have some statutes enacted in the past decade or so. However, this constitutional and statutory ‘protection’ has been impeded in practice by requirements for traditional communities to be formally ‘recognized’ by their local governments, many of whom have been unresponsive to calls for recognition.

AbstrakThe role of the state in combating poverty is very strategic. Combatingpoverty means to free citizens who are poor. The strategic role given thenational ideals (read: state) is the creation of public welfare. Therefore,countries in this regard the government as the organizer of the state musthold fast to the national ideals through legal product that is loaded withsocial justice values in order to realize common prosperity. Therefore, thenature of the law is justice, then in the context of the state, the lawestablished for the creation of social justice. Law believed that social justiceas the path to the public welfare so that the Indonesian people in a relativelyshort time to eradicate poverty.

The domination of the state (government) and Corporate (PT LBI) in the oil and gas resource management lead Lapindo mudflow disaster that caused misery to the people. This study aims to assess the forms of domination and injustice by the state (government) and the corporation in the case of Lapindo mudflow disaster, and how Lapindo mudflow disaster victims negotiate (resist) against the state (government) and corporations in an effort to fight for their rights. This study used a qualitative approach with case study. Subjects and informantsresearch include: (1) Lapindo mudflow disaster victims; (2) group coordinator of Lapindo mudflow disaster victims; (3) Public figures Siring village, Tanggulangin, Renokenongo, Jabon, and Jatirejo, Porong district, Sidoarjo; (4) Representation of the corporation (PT. LBI); and (5) Representation of BPLS. The data collection process using the in-deepth interviews, observation, focus group discussions, and review documents. Stage processing and data analysis includes the coding process, memoing, and concept mapping. The results showed that the government (the state) and the corporation (PT LBI) action dominating the oil and gas resource management in the area of Porong district, Sidoarjo regency, East Java, resulting misery for the victims (people). Forms of injustice felt by residents Lapindo mudflow disaster victims not only related to the issue of compensation for land and building assets alone, but more than that, including various dimensions. Through a variety of collective action, such as demonstrations and negotiations, Lapindo mudflow disaster victims filed various charges, such as demands for payment of compensation for land and building assets destroyed.

Walfare State concept born in the era of the 20th century as a correction of the development of the concept of the country as night watchman, the phenomenon of economic capitalism that gradually leads to lameness in the distribution of sources of prosperity. In the Walfare State concept, the state is required to extend its responsibility to the socio-economic problems facing the people. The functions of the state also include activities that were previously beyond the scope of state functions, such as extending the provision of social services to individuals and families in specific matters, such as social security. The role of the state can not be separated with Welfare State because the state that plays a role in managing the economy which includes the responsibility of the state to ensure the availability of basic welfare services in certain levels. Welfare State does not reject the existence of a capitalist market economy system but believes that there are elements in the public order that are more important than market objectives and can only be achieved by controlling and limiting the operation of such market mechanisms.Keywords: walfare state, country, economic systemKonsep Walfare State yang lahir di era abad ke-20 sebagai koreksi berkembangnya konsep negara sebagai penjaga malam, gejala kapitalisme perekonomian yang secara perlahan-lahan menyebabkan terjadinya kepincangan dalam pembagian sumber-sumber kemakmuran bersarma. Dalam konsep Walfare State, negara dituntut untuk memperluas tanggung jawabnya kepada masalah-masalah sosial ekonomi yang dihadapi rakyat. Fungsi negara juga meliputi kegiatan-kegiatan yang sebelumnya berada diluar jangkauan fungsi negara, seperti memperluas ketentuan pelayanan sosial kepada individu dan keluarga dalam hal-hal khusus, seperti social security, kesehatan.  Peran negara tidak bisa dipisahkan dengan Welfare State karena negara yang berperan dalam mengelola perekonomian yang yang di dalamnya mencakup tanggung jawab negara untuk menjamin ketersediaan pelayanan kesejahteraan dasar dalam tingkat tertentu. Welfare State tidak menolak keberadaan sistem ekonomi pasar kapitalis tetapi meyakini bahwa ada elemen-elemen dalam tatanan masyarakat yang lebih penting dari tujuan-tujuan pasar dan hanya dapat dicapai dengan mengendalikan dan membatasi bekerjanya mekanisme pasar tersebut. Kata Kunci: walfare state, negara,sistem ekonomi
