This article examines the conflict between gas production and the preservation of bitumen resources in Alberta's oil sands area. After providing a synopsis of the relevant technical and legal issues facing the industry, the authors then focus on the clash of factual, technological, legal and policy issues facing both regulators and industry in the gas/bitumen dispute. The authors then conclude with an analysis of the current status and future of the gas/bitumen dispute.

On 17 December 2002, Canada ratified the Kyoto Protocol to the United Nations Framework Convention on Climate Change (Kyoto Protocol), taking on binding targets to reduce Canadian emissions of greenhouse gases (GHGs). Canada's ratification decision and the proposed domestic emissions trading system forming part of Canada's Kyoto implementation plan continue to be the source of considerable disagreement and conflict between the provinces and thefederal government regarding: the practical challenges associated with multiple Canadian jurisdictions implementing emissions trading systems: the current status and legal issues associated with covenants between industry and government(s) to enforce GHG reduction targets; the legal jurisdiction over domestic emissions trading system(s); and the impact on interprovincial and international trade. Each ofthese issues is examined in the unique Canadian legal context. The authors conclude that many ofthe most significant challenges may be mitigated through harmonization and coordination byfederal and provincial governments in a manner that allows for local concerns to be addressed without fragmenting the Canadian emissions markets.

Abstract Hydraulic fracturing treatment is one of the most efficient conventional matrix stimulation techniques currently utilized in the petroleum industry. However, due to the spatiotemporal complex nature of fracture propagation in a naturally- and often times systematically fractured media, the influence of natural fractures (NF) and in situ stresses on hydraulic fracture (HF) initiation and propagation within a reservoir during the hydrofracturing process remains an important issue. Over the past 50 years of advances in the understanding of HF–NF interactions, no comprehensive revision of the state of the knowledge exists. Here, we reviewed over 140 scientific articles on investigations of HF–NF interactions, published over the past 50 years. We highlight the most commonly observed HF–NF interactions and their implications for unconventional oil and gas production. Using observational and quantitative analyses, we find that numerical modeling and simulation is the most prominent method of approach, whereas there are less publications on the experimental approach, and analytical method is the least utilized approach. Further, we suggest how HF–NF interactions can be monitored in real time on the field during a pre-frac test. Lastly, based on the results of our literature review, we recommend promising areas of investigation that may provide more profound insights into HF–NF interactions in such a way that can be directly applied to the optimization of fracture-stimulation field operations.

The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (Agência Nacional do Petróleo Gás Natural e Biocombustíveis - ANP) is the regulatory body responsible to regulate, contract and supervise the activities that integrates oil, natural gas and biofuels industry in Brazil, including the onshore and offshore pipelines. With this intent, ANP’s Resolution n° 06/2011, Technical Regulation of Onshore Pipelines for the Transport of Petroleum, its Derivatives and Natural Gas (Regulamento Técnico de Dutos Terrestres para Movimentação de Petróleo, Derivados e Gás Natural - RTDT), was published, establishing the essential critical requirements and the minimum safety directives for onshore pipelines, aiming at the protection of human life, facilities, and environment. The Technical Regulation covers onshore pipelines, new and existing ones, acting on the transference of the oil and gas production in the Brazilian jurisdiction and it is also applied on design, construction, assembling, operation, inspection, maintenance, integrity management, emergency response and decommissioning of the pipelines. Currently, ANP is elaborating a normative instrument applied to offshore pipelines, intending to establish the essential critical requirements for its safety management system. This paper presents an evaluation of the RTDT after its publication, including the improvements that will be concern with the review of the Resolution, and also gives an overview of the elaboration of the normative instrument for offshore pipelines.

Encouraging results of shale gas production in different countries viz. USA, China and Australia, India is also inspired to explore shale gas resources, which may not only support meeting the growing energy demand but also assist to reduce the import of hydrocarbons. This paper aims to review the current status of shale gas exploration programs in various sedimentary basins in India for a better understanding of the prospect of shale gas. The signicant thickness of organic-rich shale deposits is reported in various Gondwana and Tertiary sedimentary basins including Damodar valley, Krishna-Godavari, Cauvery, Cambay, Assam-Arakan, Ganga and Vindhayan basins. The geochemical properties like TOC and thermal maturity, Organo-inorganic mineral compositions, pore-network system, and depth of shale deposits are favoring the potential prospect of shale gas in India. Several agencies namely EIA, ONGC, USGS, Schlumberger, and CMPDI reported enormous resources of shale gas in its various sedimentary basins.

Assistance dogs are a very diverse group of working dogs that are trained to assist humans with different types of disabilities in their daily lives. Despite these dogs’ value for humankind, research on their welfare status, cognitive and behavioural capacities, selection criteria for the best fitting individuals, effective training and management practices, and genetic issues are so far lacking. This review highlights the need to address these topics and to promote progress in legal issues around assistance dogs. The topic of assistance dogs is approached comprehensively by outlining the current status of knowledge in three different dimensions: (1) the legal dimension, outlining important legal issues in the EU and Australia; (2) the welfare dimension; and (3) the dimension of research, covering assistance dog selection and training. For each of these three dimensions, we discuss potential approaches that can be implemented in the future in order to support assistance dog working performance, to protect the dogs’ welfare, and to improve our knowledge about them. Additionally, there remain many legal issues, such as the presence of assistance dogs in public areas, the resolution of which would benefit both the assistance dog and the owner with disability.

AbstractThis presentation analyses the outcomes of the 8th ICP meeting devoted to Marine Genetic Resources, from the perspective of policy issues arising from the international debate at that meeting. After describing the purpose and working procedures of the ICP, findings derived from the specific panel discussions and state-to-state debate during the meeting are summarized. Common elements between findings from the panels and discussions, as well as tensions among positions of states, are identified. With regard to policy and legal issues that remained contentious and unresolved, eight considerations underlying divergent views are considered. It is suggested that these divergences may themselves be rooted in further deep-seated tensions between developing and developed states, as well as between commercial benefits and environmental interests. It is concluded that considerably more international debate is necessary in order to develop a better understanding of the contentious issues and to agree on a common way forward. Future solutions at the international level will require patience and realism, but in the meantime practical measures can be put forward that would generate benefits to all states and stakeholders.

Marketers of used products face uncertainty in the legal environment because of the inconsistent ways their offerings are treated with respect to strict product liability. The authors analyze the conceptual underpinnings of strict liability to assess its applicability to used goods. Then they examine litigated cases to present an overview of current judicial treatment of defective used products. Finally, they discuss policy issues related to used products in the context of both the law and marketing.

The NLRB, in a significant ruling for organized labor, recently ruled that employees who are forced to pay union dues are entitled to know how their money is being spent. The NLRB ruled in January 1997 that unions must supply financial information to workers who pay dues but who have elected not to join the union. The use of union dues for political activity continues to be a controversial issue for both public and private unions. This paper will provide a brief overview of the legal history of unions in America and the current issues they are encountering. Legal issues relating to the use of union dues for political activities for both public and private unions will also be discussed.

Purpose Science and technology diplomacy (STD) is an emerging area in the field of public policy and technology management. The purpose of this study is to overview the concept of STD based on the two approaches “Science and Technology” and “Diplomacy” to explain its necessity for Non-Aligned Movement member countries. Design/methodology/approach To design the work, principal domains and sub-domains of STD are identified based on the thematic analysis. By using MAXQDA software, the initial codes are analyzed and validated for the case study. Then, six areas and 29 sub-areas are identified based on the fuzzy Delphi and the framework is designed. Findings STD is defined from six scopes, including political, economics, law and legal issues, social sciences, philosophy and science and technology. Each scope has its own mechanism that is discussed in the article. Originality/value This work is one of the first in the literature of science and technology policy making.
