Alternativas para superar el hacinamiento carcelario en Colombia con enfoque en derechos humanos

El presente artículo sobre la situación actual de las cárce- les, se ocupa específicamente de lo relacionado con el ha- cinamiento y las posibles alternativas para su superación. El objetivo es hacer un análisis crítico sobre el verdadero nivel de hacinamiento en que se encuentran ahora los cen- tros penitenciarios, y la relación que existe con la protec- ción de los derechos humanos por parte del Estado, como un imperativo que requiere de su pleno cumplimiento. Esta problemática es una situación permanente, recurren- te y con tendencia a profundizarse, lo que ha ocasiona- do una crisis en materia del derecho internacional de los derechos humanos, que ha supuesto necesariamente una responsabilidad del Estado, producto sin duda del estado de cosas inconstitucional que fue establecido por la Corte Constitucional a través de la sentencia T-153 de 1998. Las conclusiones reflejan en su conjunto el alto nivel de inefi- ciencia con la que se ha actuado por parte del ejecutivo y el legislativo en la solución de la crisis de hacinamiento car- celario y la necesidad de emprender acciones afirmativas, libres del discurso propositivo, que no hace otra cosa que simplificar el problema pero no solucionarlo.This article, about the current situation of prisons, spe- cifically related to prison overcrowding and alternatives to overcome them, are part of the goal to make a critical analysis of the true level of overcrowding in which are now centers prisons and the relationship with the protec- tion of Human Rights by the State as an imperative that requires full compliance, this is a permanent, recurrent and tend to deepen situation, which has caused a crisis in the International Law of Human Rights (HR), which has necessarily meant a state liability in this situation, as a re- sult without question of “Unconstitutional Things in the State” established by the Constitutional Court through the final desition T-153 of 1998. The closures as a whole reflect of the high level of inefficiency with which action has been taken by the Executive and legislative branches in the solution of the overcrowding crisis in prisons and the need to undertake purposeful assertive speech affir- mative action, which does nothing to simplify the problem but not in solving it.

The internationalization of adjudication in the Colombian high court refers to the growing importance that the American Convention on Human Rights has gained among the judicial forums of this country, but especially to the phenomenon that occurs when national judiciaries implement and appropriate the doctrine of the control of conventionality. The Convention has claimed a high ground in the Colombian constitutional system due to the appropriation of international law by national courts decisions, and to the process of the internationalization of the law. By consistently applying the control of conventionality doctrine, courts like the State Council have reaffirmed the binding nature and the effectiveness of the decisions of the Inter-American Court of Human Rights for the Colombian legal system. In contrast to a much more regressive posture assumed by the Constitutional Court in recent decisions, the State Council, drawing on the legal contents of international law, has broadened the range of legal sources for rights interpretation in Colombia. By this action, as it will be further stated in this article, the State Council has contributed to a move away from a paradigm of a legalism based solely on the state sovereignty and national constitutionalism, towards one that endorses the pluralist structure of post-national law. Against this background, this article aims to discuss how the relationship of national judiciaries with international law is best understood as reflecting the development of a pluralist legal dynamic, sometimes referred to as jurisprudential dialogue, that involves the broadening of the normative horizon and the internationalization of the sources available for national judges in their reasoning; particularly in the cases that involve human rights violations.

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

Artigo trata na construção de reflexões e proposições sobre a relação da educação, direitos humanos e formação de professores para atuarem na educação básica. Aborda a relação entre o poder político e a sociedade a partir da análise do Estado como instância promotora de direitos e pelos mecanismos que o mesmo se apodera para forjá-los na educação. Analisa o papel das reformas curriculares em conformidade às políticas dominantes. Discute a formação de professores e sua relação com a pobreza, com as desigualdades sociais e direitos humanos. Os fundamentos que norteiam as análises são do campo de conhecimento educacional e pedagógico. Para elucidações contextuais apropria-se de referencial sócio histórico, das políticas educacionais e políticas curriculares. Permite o diálogo com o objeto da formação e atuação de professores na área dos direitos humanos. Artigo se organiza metodologicamente em cinco tópicos a saber: Introdução, O Estado e a promoção de direitos, Currículo enquanto princípio político, Formação de professores para os direitos humanos e Considerações. Conclui ponderando a importância do papel do Estado na promoção dos direitos humanos a partir de políticas públicas comprometidas com a educação e com a formação de professores para o trabalho com os vulneráveis, as desigualdades sociais e os direitos humanos. Também chama a atenção da educação para os direitos humanos nos diferentes níveis e modalidades de ensino, expansiva à comunidade escolar.Palavras-chave: Educação. Direitos humanos. Currículo.EDUCATION, HUMAN RIGHTS AND TEACHER TRAINING: reflections and propositions.AbstractArticle deals in the construction of reflections and propositions on the relationship of education, human rights and teacher training to work in basic education. It addresses the relationship between political power and society based on the analysis of the State as a promoter of rights and the mechanisms it takes to forge them in education. It analyses the role of curricular reforms in line with dominant policies. It discusses teacher education and its relation to poverty, social inequalities and human rights. The foundations that guide the analyses are the field of educational and pedagogical knowledge. For contextual elucidations it appropriates the socio-historical reference, educational policies and curricular policies. It allows dialogue with the subject of the training and action of teachers in the area of human rights. Article is organized methodologically in five topics: Introduction, The State and the promotion of rights, Curriculum as a political principle, Training of teachers for human rights and Considerations. He concludes by considering the importance of the role of the State in the promotion of human rights from public policies committed to education and teacher training for working with the vulnerable, social inequalities and human rights. Planteada directamente la cuestión de la responsabilidad patrimonial del Estado por dilaciones indebidas (como funcionamiento anormal) del Tribunal Constitucional, se analizan críticamente dos recientes sentencias de la Jurisdicción Contencioso-Administrativa y una reforma legislativa. Para la mejor comprensión de tales actuaciones, previamente se estudia la jurisprudencia del Tribunal Europeo de Derechos Humanos con respecto a la violación del plazo razonable por las jurisdicciones constitucionales, así como la postura mantenida por el Consejo de Estado. As the question of the State patrimonial liability for undue delays (abnormal operation of the Adminstration) has already been addressed by the Constitutional Court, two recent rulings by the Contentious-Administrative jurisdiction and a legislative amendment are critically analyzed. For a better comprehension of them, it is studied the European Court of Human Rights case law regarding the violation of the reasonable delay in constitutional jurisdictions together with the position sustained by the Council of State.

It is never too late. In two decisions handed down at the end of October 2007, the Italian Constitutional Court seems finally to have begun to take seriously one of the Italian Constitution's fundamental principles: the openness to international law which is embodied in Articles 10, 11 and – the provision chosen by the Constitutional Court in the judgments being examined – 117, paragraph 1 of the Constitution, which was added by the constitutional revision of 2001. In particular, the two decisions focus on the relationship between the Italian constitutional legal order and the Convention for the Protection of Human Rights and Fundamental Freedoms.

The article presents the judgment of the German Federal Constitutional Court from 26 February 2020 on assisted suicide. The statements regarding human dignity, human rights and the relationship between citizens and the state are examined. Furthermore, the consequences resulting from this interpretation of human dignity for states that are pluralistic and based on human rights will be laid out. The court’s judgment limits the power of parliaments and poses a challenge to many laws in states that see themselves as pluralistic, human rights-based states.

AbstractIn the case concerningJurisdictional Immunities of the State, the ICJ held that rules ofjus cogensdid not automatically displace hierarchically lower rules of state immunity. The Court's decision was based on the rationale that there was no conflict between these rules as the former were substantive rules while the latter were procedural in character. The ‘substantive–procedural’ distinction has been heavily criticized in the literature. Much of the criticism seems to be motivated by the unwanted result of the distinction, namely de facto impunity for the most serious human rights violations. This paper takes a step back from the alleged antinomy of human rights and state immunity and broadens the picture by looking at the relationship between substantive and procedural rules more generally. It is shown that substantive rules of ajus cogenscharacter generally leave procedural rules unaffected and, in particular, do not automatically override such rules. Substantive rules may, however, have a limited effect upon the interpretation and application of procedural rules. It is argued that the ‘substantive–procedural’ distinction is well established in international law and makes eminent sense even when substantive rules ofjus cogensand procedural rules of immunity are involved.

En este artículo se aborda la relación entre empresa y Estado, que se encuentra ligada por la aplicación de los Principios Rectores de las Naciones Unidas sobre las empresas y los derechos humanos «John Ruggie». Aunque estos principios no son fuente formal del derecho internacional, ya que son soft law, en su esencia, recopilan las bases para mitigar, prevenir y reparar las afectaciones a derechos humanos que causen las empresas en el desarrollo de actividades económicas a comunidades que se encuentren en un territorio específico. Debido a esto, cada vez más se ve su aplicación en políticas públicas por parte de los Estados y en planes de ejecución empresarial mediante la aplicación de la debida diligencia. Este concepto cobra mayor relevancia por ser una herramienta más de defensa de la Consulta Previa, y a su vez ser el puente de conexión entre la aplicación de los Principios Rectores y los efectos que conlleva generar una afectación a los derechos humanos. Abstract: This article approach the relationship between business and the State is linked by the application of the United Nations Guiding Principles on Human Rights and Business «John Ruggie». Although these principles are not a formal source of international law since they are soft law, in essence, they gather the bases to mitigate, prevent and repair the human rights violations caused by companies in the development of economic activities to communities that are in a specific territory. Also, it is increasingly seen its application in public policies by the States and in business execution plans through the application of due diligence. This concept is more relevant because it is one more tool to defend the Prior Consultation; and at the same time, be the connecting bridge between the application of the Guiding Principles and the effects entailed in generating an impact on human rights.
