The purpose of this study was to describe the ownership status of Soko land in the Indigenous People of the Bendang Tribe, Kampar, Riau; and explain the settlement of the transfer dispute over the ownership of Soko Land to the Indigenous People of the Bendang Tribe, Kampar, Riau. The existence of indigenous peoples will not be separated from their customary lands. The existence of indigenous peoples will be determined by ownership of their customary land. Indigenous people will not be called indigenous peoples without owning their customary land. This type of research is sociological legal research, namely research in the form of empirical studies to find theories about the process of occurrence and the process of working the law in society. The results of this study are, the status of ownership of Soko land in the indigenous people of the kampar tribe of the kampar district is attached to the community that has a maternal lineage. The transfer of ownership of soko land to the indigenous people of the dam tribe of Kampar District is the transfer of ownership of land between generations according to lineage and the transfer of land ownership to the settlement of land disputes.

The status and function of customary land causes land problems to become complex, which can be a source of legal and social problems that appear in various forms of land disputes. Likewise with respect to the village plots, it is not free from disputes. There are many factors that lead to the disputes in village yards. The objectives of this study is to examine the rights and obligations of the village manners who occupy the village reef land and to examine the position of the village manners who are no longer Hindu towards the village coral land are in accordance with the Canggu Badung Adig village awig-awig. The type of study used is empirical legal research. The results of this study is 1) the rights and obligations of the village manners who occupy the village reef land in accordance with awig- awig Adat Canggu Badung Village is to occupy the village coral land, bearing in mind the village manners who occupy the village coral land have been regulated in Awig-Awig Canggu Adat Village, Pawos 4 Paragraph (1) and is obliged to participate in retribution, carrying out village directives and paying contributions. 2) The position of the village manners who are no longer Hindu towards the village coral land is in accordance with the awig-awig of the Traditional Village of Canggu Badung every village manners who convert, then the manners are called tamiu manners. Based on this, all the assets or facilities of the customary village must be returned to the customary village, including the village coral land it occupies, as stated in the Pararem of the Canggu Customary Village, Pawos 4 Paragraph (3).

Regulations on the Recognition and Protection of Customary Law Communities are not always effective. This study was to determine the concept of recognition and protection of the Customary Law Community in Rawa Aopa Watumohai National Park. This research is a normative legal research. The results of the research are First, the law still provides conditional recognition of indigenous peoples, which limits their space. second, that the recognition and protection of the customary MHA of Moronene Hukaea Laea in Bombana Regency has not been maximized. They have received recognition and protection through a recognition of perda, but their customary territory still has the status of designating a National Park Area, so they cannot use it as customary land.

Abstract: Land registration through PTSL activities is conducted for all parcels of land throughout Indonesia. However, there are some ohoi in Southeast Maluku regency that refuse the registration of land which has been implemented through PTSL in recent years, whereas almost all of ohoi in Southeast Maluku Regency has already done land registration. This study aims to determine the implementation of PTSL in Ohoi Ngabub and Ohoi Sathean, the reason the Ohoi Sathean indigenous people accepted PTSL activities and the Ohoi Ngabub indigenous people rejected PTSL activities, and the land law system that applies in both ohoi. The research method used is qualitative with a sociolegal approach. The results showed that PTSL-UKM activities carried out in 2017 at Ohoi Sathean received good responses from the Ohoi Government and indigenous people of Ohoi Sathean, while the Ohoi Ngabub government refused to do PTSL activities. This is due to the local land law system that applies in both ohois. The local land law system that applies in Ohoi Sathean is individual land ownership, whereas the local land law system that applies in Ohoi Ngabub is joint land ownership. Keywords: customary land, communal rights, PTSL, indigenous peoples of Kei Intisari: Pendaftaran tanah melalui kegiatan PTSL dilakukan untuk seluruh bidang tanah di seluruh wilayah Indonesia. Akan tetapi terdapat beberapa ohoi (desa) di Kabupaten Maluku Tenggara yang menolak dilaksanakannya pendaftaran tanah melalui PTSL, sedangkan hampir seluruh ohoi sudah dilakukan pendaftaran tanah. Penelitian ini bertujuan untuk mengetahui pelaksanaan PTSL di Ohoi Ngabub dan Ohoi Sathean, alasan masyarakat adat Ohoi Sathean menerima kegiatan PTSL dan masyarakat adat Ohoi Ngabub menolak kegiatan PTSL, dan sistem hukum pertanahan lokal yang berlaku di kedua ohoi. Metode penelitian yang digunakan yaitu kualitatif dengan pendekatan sosiolegal. Hasil penelitian menunjukan bahwa kegiatan PTSLUKM yang dilaksanakan pada tahun 2017 lalu di Ohoi Sathean mendapatkan tanggapan yang baik dari perangkat ohoi dan masyarakat adat Ohoi Sathean sedangkan perangkat Ohoi Ngabub menolak untuk dilakukan kegiatan PTSL. Hal ini disebabkan oleh sistem hukum pertanahan lokal yang berlaku di kedua ohoi. Sistem hukum pertanahan lokal yang berlaku di Ohoi Sathean yaitu kepemilikan tanah secara individual, sedangkan sistem hukum pertanahan lokal yang berlaku di Ohoi Ngabub yaitu kepemilikan tanah secara bersama. Communal land is the identity of indigenous communities whose existence is protected by the Constitution. Customary land is not only used for the purposes of indigenous peoples, but also exploited by the outsiders. This study examines how the pattern of the legal relationship between the indigenous people and to outsiders by using socio-legal research. This study was conducted in West Sumatera by limiting the study to the four natural resource sectors, namely plantations, water resources, mining and forestry. The results of this study indicate that the legal relationships that are not obvious to trigger disputes between indigenous people and outsiders. Tanah ulayat merupakan identitas masyarakat hukum adat yang diakui dan dilindungi keberadaannya oleh UUD 1945. Tanah ulayat tidak hanya digunakan untuk keperluan masyarakat hukum adat, namun juga dimanfaatkan oleh pihak luar. Penelitian ini mengkaji bagaimana pola hubungan hukum antara masyarakat hukum adat dengan pihak luar dalam pemanfaatan tanah ulayat dengan menggunakan pendekatan yuridis empiris. Penelitian ini dilakukan di Sumatera Barat dengan membatasi kajian pada 4 (empat) sektor sumberdaya alam, yaitu perkebunan, sumberdaya air, pertambangan dan kehutanan. Hasil penelitian ini menunjukkan bahwa ketidakjelasan hubungan hukum menjadi pemicu munculnya sengketa antara masyarakat hukum adat dengan pihak luar di dalam pemanfaatan tanah ulayat.

This article discusses land ownership from the perspective of tradition, especially the tradition of the revival of the dead earth (Iḥya ‘al-Mawāt). This relates to the land conflicts that often occur, so it requires a religious perspective in land ownership. Therefore, the issue raised is how the ownership of land in the Hadith? How Hadith provide a solution to the land dispute? To answer it used historical approach, hermeneutic, and sociology. Turns ownership in Islam there are three, namely individual ownership, common ownership and state ownership. Islam recognizes individual ownership is perfect (al-milk al-tāmm) and imperfect (al-milk al-nāqis). Criteria of land ownership in the Hadith oriented aspects of justice and benefits (maslaḥlah). Hadith Iḥya ‘al-Mawāt give you an idea that the Prophet prevent conflicts caused by land disputes by explaining the status and ownership of land with cultural framework. Efforts were made persuasively by a cultural approach, in addition to the structural approach.[Artikel ini membahas tentang kepemilikan tanah dari perspektif tradisi, terutama tradisi kebangkitan kembali bumi yang mati (Iḥya ‘al-Mawāt). Hal ini berkaitan dengan konflik tanah yang kerap terjadi, sehingga membutuhkan perspektif agama dalam kepemilikan tanah. Karena itu, masalah yang diangkat adalah bagaimana kepemilikan tanah dalam Hadis? Bagaimana Hadis memberikan solusi terhadap sengketa tanah? Untuk menjawabnya digunakan pendekatan historis, hermeneutik, dan sosiologi. Ternyata kepemilikan dalam Islam ada tiga, yaitu kepemilikan individu, kepemilikan bersama dan kepemilikan negara. Islam mengakui kepemilikan individu sempurna (al-milk al- tāmm) dan tidak sempurna (al-milk al-nāqis). Kriteria kepemilikan tanah dalam hadis berorientasi aspek keadilan dan tunjangan (maslaḥlah). Hadis Iḥya ‘al-Mawāt memberi Anda gagasan bahwa Nabi  mencegah  konflik yang  disebabkan  oleh  sengketa  tanah  dengan  menjelaskan  status  dan kepemilikan tanah dengan kerangka budaya. Upaya dilakukan secara persuasif dengan pendekatan budaya, disamping pendekatan struktural.]

Pengakuan pemerintah terhadap hukum adat masih setengah hati. Padahal, eksistensi hukum adat memiliki landasan konstitusional yang kuat dalam Pasal 18B ayat (2) UUD 1945. Tubrukan antara proyeksi pembangunan dari pemerintah, kepentingan masyarakat umum, beserta hak ulayat dari masyarakat adat, telah menimbulkan gesekan yang sangat rentan akan timbulnya konflik. Seperti halnya yang memicu terjadinya konflik yang memanas di dalam masyarakat sunda wiwitan atas sengketa lahan. Yang mana perlakuan Jaka yang mengklaim tanah adat menjadi tanah milik pribadi sebagai bentuk pelanggaran hukum adat dan kemudian ditambah dengan putusan PN Kuningan yang memanangkan permintaan Jaka atas hak milih tanah adat seluas 224 m2. Putusan PN tersebut dinilai cacat hukum dan tidak memperhatikan asal usul sejarah. Maka hal tersebut menimbulkan berbagai aksi perlawanan dari pihak kubu masyarakat adat Sunda Wiwitan untuk berusaha memperoleh kembali haknya atas tanah adat mereka. Tujuan penulisan artikel ini yaitu untuk menjelaskan latarbelakang terjadinya konflik dan pemicu terjadinya konflik dengan menggunakan teori identitas yang nantinya dapat dirumuskan resolusi konflik yang efektif. Metode yang digunakan dalam penulisan artikel ini yaitu menggunakan studi litelatur yang diperoleh dari jurnal,buku, dan berbagai macam berita. Hingga saat ini konflik yang bergulir belum menemukan kejelasan karena belum terdapat resolusi konflik yang jelas dan masih sampai kepada tahap digagalkannya proses eksekusi tanah adat seluas 224 m2oleh Pengadilan Negri Kuningan. Government recognition of customary law is still half-hearted. In fact, the existence of customary law has a strong constitutional foundation in Article 18B paragraph (2) of the 1945 Constitution. Collisions between projected development from the government, the interests of the general public, along with customary rights from indigenous peoples, have created a very vulnerable friction in the emergence of conflict. As is the case that triggered a heated conflict in Sunda Wiwitan society over land disputes. Which is the treatment of Jaka who claimed customary land to be privately owned as a form of violation of customary law and then added with the Kuningan District Court decision to adopt Jaka's request for customary land rights of 225 m2. The Kuningan District Court ruling was deemed legally flawed and did not pay attention to the origin of history. So this caused various acts of resistance from the sides of the Sunda Wiwitan indigenous people to try to regain their rights to their customary lands. The purpose of writing this article is to explain the background of the occurrence of the conflict and the trigger for the occurrence of conflict by using identity theory which can later be formulated effective conflict resolution. The method used in writing this article is to use litelatur studies obtained from journals, books, and various kinds of news. Until now the rolling conflict has not yet found clarity because there is no clear conflict resolution and is still up to the stage where the process of execution of customary land of 225 m2 was thwarted by the Kuningan District Court.

One of the natural wealth or natural resources created by God Almighty that is needed for human life is land. Humans live on land and obtain food by utilizing land. Human life cannot be separated from the land. The emergence of a legal dispute is originated from the objection of the guideline of a land right both to the status of the land, its priorities and ownership in the hope of obtaining administrative settlement in accordance with applicable regulations. This study uses normative juridical research methods so that the sources used are sourced from literature and legal literature. the conclusion in this study is The modus operandi in the occurrence of land disputes usually involves a systematic network between financiers, land speculators, land certificate brokers, thugs, regional government officials, the police and of course BPN elements. Commonly used modus operandi: Use of falsified land rights; Counterfeiting Warkah; Provision of false information; Letter forgery; Fictitious buying and selling; Fraud or embezzlement; Lease; Suing land ownership; Mastering thug-style land.

This article aims to discuss the conflict of tenure rights between Perhutani and the community and the status of land held by the community after the entry into force of Presidential Regulation No. 86 of 2018 concerning Agraria Reform. The study uses a sociological juridical method. The location of the study is in the forest area of   Perhutani Public Corporation, Malang Regency. Data collection techniques using observation, interviews, and documentation. The results of the study show that conflicts over ownership of land rights between Perhutani and the community have been going on for a long time. Physically the land has been controlled by the community since the Dutch colonial era and passed down from generation to generation. The granting of permission to manage the land and payment of land tax strengthened the community’s argument about land ownership. The land status which is the object of the dispute is based on Presidential Regulation No. 86 of 2018 concerning Agrarian Reform became the authority of Perhutani Public Corporation. Communities can get ownership rights or get land compensation if the Ministry of Forestry releases the land.

This research discusses about the status of land rights whose ownership has been not clear yet, which is the object of cooperation in utilization between the Sawir Village Government and PT Solusi Bangun Indonesia Tbk, according to the laws and principles in force in Indonesia. The problems that will be answered in this study include: (1) What is the status of land rights that are used as objects of utilization between the Sawir Village Government and PT Solusi Bangun Indonesia Tbk? (2) How is the land use cooperation between Sawir Village Government and PT Solusi Bangun Indonesia Tbk according to Western and Islamic Covenant Law? This type of research is a qualitative research, while the approach used is an empirical juridical approach, namely legal research that functions to see the laws that apply in the community. The results of this research are: (1) According to the Sawir Village Government, the land belongs to the Village Government as evidenced by the existence of a field map in the village C book. Meanwhile, according to the Tuban Regency Government, the Tuban Regency National Land Agency, and PT Solusi Bangun Indonesia Tbk, the land ownership is not registered and cannot be claimed as an asset of Sawir Village. According to Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles article 19 paragraph 1, the land cannot be referred to as land belonging to Sawir Village until the certification is completed on behalf of the village. And to get the ownership certificate, the Sawir Village Government must register or submit an application for ownership of the land to the National Land Agency of Tuban Regency. (2) According to the Islamic Covenant Law, the status of the land does not meet the requirements as an object of the agreement. This is because the land has not been legally proven to be owned by the Sawir Village Government. Whereas one of the main requirements for the validity of an agreement is that the object of the agreement must be legally owned by one of the parties who entered into the agreement.Keywords: Utilization, Non-Certified Land, Covenant Law, Customary Rights

The purpose of this research was to find out the contribution of Balai Besar Bromo Tengger Semeru National Park (TN-BTS) from the utilization of tourism in TN-BTS to the Tengger indigenous people as the original owner of the Bromo-Tengger Semeru area as well as to know the solutions that can be done by the Balai Besar TN-BTS to contribute in improving the welfare of Tengger indigenous people living in the national park. This research is qualitative research with an explanative approach, where the interviewed informants were selected using a purposive sampling technique and analyzed with ethnographic analysis techniques. From the results of the research, it is known that Balai Besar TN-BTS has conducted a program of development and utilization of national parks for tourism object activities as well as community empowerment as a form of direct contribution to the improvement of the welfare of Tengger indigenous peoples. However, both development programs have not been able to answer the priority needs of Tengger indigenous peoples. The limitations of authority and main functions owned by Balai Besar TN-BTS become an obstacle for them to be able to contribute to the improvement of the welfare of Tengger indigenous peoples. As a strategic effort so that Balai Besar TN-BTS can contribute directly to the improvement of the welfare of Tengger indigenous people who live in the village within the National Park zone is to share the revenue of National park tourism activities. However, this strategic effort needs to be accompanied by a change in the status of Balai Besar which was originally the Technical Implementation Unit (UPT) of the Minister of Environment and Forestry to the Public Service Agency (BLU).
