Accepting on 26 February 2014 by the European Parliament and the Council a new directive concerning procurement and the necessity to transposition its provisions to the Polish legal system caused the appearance of vital changes in the area of procurement referring to social aspects. The most momentous changes are connected with the specified in regulations possibility to describe a subject-matter of the contract including social requirements, possibility to exclude contractors exclusion and forming conditions of participating in proceedings, and possibility of forming offers assessment criteria referring to social aspects. Therefor the social aspects became a momentous, yet facultative premise of the optimisation of the public expenses within public contracts.

Celem pracy jest identyfikacja głównych problemów występujących na rynku zamówień publicznych z perspektywy zamawiających. W badaniu sondażowym przeprowadzonym w drugiej połowie 2017 roku uwzględniono trzydzieści jeden podmiotów udzielających zamówień publicznych z województwa opolskiego. Zidentyfikowano następujące problemy: przerost procedur biurokratycznych, niestabilny system prawa, zbyt mała liczba pracowników, niewystarczający zakres szkoleń oraz wysoki stopień złożoności samego procesu udzielania zamówień publicznych. W konsekwencji rekomendowano następujące działania: zmniejszenie obciążeń administracyjnych i skomplikowania procedur, unormowanie statusu zamówień całkowicie wyłączonych z reżimu ustawowego, zwiększenie liczby szkoleń, upowszechnienie korzystania z pomocy biegłych i rzeczoznawców oraz udrożnienie kanałów komunikacji między zamawiającymi a organami administracji państwowej. Problems occurring on the polish public procurement market in the opinion of procurers from the Opolskie voivodeship The aim of the work is to identify the main problems appearing on the public procurement market from the perspective of procuring entities. In the survey conducted in the second half of 2017, 31 entities awarding public contracts from the Opolskie Voivodeship were included. The following problems were identified: excessive bureaucratic procedures, unstable legal system, too few employees, insufficient training and a high degree of complexity in the procurement process itself. As a consequence, the following activities were recommended: reducing administrative burdens and complicating procedures, normalizing the status of contracts completely excluded from the statutory regime, increasing the number and frequency of training, popularizing the use of experts and appraisers, and improving communication channels between procurers and state administration authorities.

Reading short stories “Suku Pompong” (Pompong Tribe) and “Rumah di Ujung Kampung” (House at the End of the Village) is like reading a historical reality that is happening on the ground of Riau Malay. The exploitation of forest resources on a large scale in recent decades in Riau Province has changed the land use of the area of intact forest into plantation area. The exploitation process causes friction in the community. The friction is eventually lead to conflict between communities and plantation companies. Their struggle to resolve conflicts and maintain their ancestral land, the strength of the company that has the license to the land and sadness when the public finally has always been on the losing side. This study objected to describe the objective reality of the Malay community in terms of land conversion, the communal land into plantations and reality of imaginative literature contained in the short stories “Suku Pompong” dan “Rumah di Ujung Kampung”. This study applied the sociology of literature approach, while the sociological approach to literature is a literary approach that specializes in reviewing literature by considering the social aspects. Based on these approaches, it can be concluded that short stories Suku Pompong and Rumah di Ujung Jalan are short stories that raised the reality of the Malay community.AbstrakMembaca cerpen “Suku Pompong” dan cerpen “Rumah di Ujung Kampung” seperti membaca sebuah realita sejarah yang terjadi di tanah Melayu Riau. Ekploitasi sumber daya hutan secara besar-besaran pada beberapa dekade terakhir di Provinsi Riau telah mengubah tata guna lahan dari kawasan hutan yang utuh menjadi kawasan perkebunan. Proses eksploitasi tersebut menimbulkan gesekan-gesekan dalam masyarakat. Gesekan-gesekan inilah yang akhirnya menimbulkan konflik antara masyarakat dengan pihak perusahaan perkebunan. Perjuangan masyarakat dalam menyelesaikan konflik dan mempertahankan tanah leluhur mereka, kekuatan pihak perusahaan yang memiliki surat izin atas tanah tersebut, dan kesedihan ketika masyarakat akhirnya selalu berada di pihak yang kalah. Penelitian ini bertujuan untuk mendeskripsikan realitas objektif masyarakat Melayu Riau dalam hal alih fungsi lahan, dari lahan tanah ulayat menjadi lahan perkebunan, dan realititas imajinatif sastra yang terdapat dalam cerpen “Suku Pompong” dan cerpen “Rumah di Ujung Kampung”. Penelitian ini menggunakan pendekatan sosiologi sastra, yaitu suatu pendekatan sastra yang mengkhususkan diri dalam menelaah karya sastra dengan mempertimbangkan segi-segi sosial kemasyarakatan. Dari pendekatan tersebut dapat diambil kesimpulan bahwa cerpen “Suku Pompong” dan cerpen “Rumah di Ujung Kampung” memang merupakan cerpen yang mengangkat realitas masyarakat Melayu Riau.

ABSTRACTA Public Perception towards Benefits of the Landscape of Mangrove Center Tuban Tuban Regency - East Java ProvinceThis research was motivated by the problems that are often experienced by the manager of Mangrove Center Tuban changing the function of the region in this area which is the Environmental Educatian Center. This research uses descriptive qualitative approach with case studies in order to capture the phenomena that exist in the field then studied more deeply. The highest perception of knowledge of the benefits and advantages of mangrove forests in Mangrove Center Tuban rated public of the environmental aspects of the lowest 40% and the perception that the social aspects of the environment of 3%. Highest perception Mangrove Center Tuban by 40% of respondents perceived as the cultivation of mangrove and lowest perception is envorinmental education center at 14%. The highest perception of respondents stated assess the mangrove forests of the aspects of a life by 63% and the lowest was the respondent state on the features and functions of mangrove forests of 3%. The highest expression of respondents said getting information from the mass media by 37% and the lowest statement from the manager only by 29%. The conclusion of this study is the public perception of mangrove forests Mangrove Center Tuban is people just look at the circumstances that they see without looking for information first.

The article is devoted to the issue of the implementation of the Directive of the European Parliament and of the Council (EU) of 6 July 2016 on measures contributing to a high level of security of networks and information systems within the territory of the Union (the so-called NIS Directive) into the Polish legal system. In this context, the author analyses the Act on the National Cybersecurity System, presenting the system and its individual components. The subjects of consideration are the provisions of the Act on National Cybersecurity System of the Republic of Poland and other legal acts concerning the subject matter, which entered into force before the adoption of the analysed act. In conclusion, the author states that in some cases, it is necessary to amend individual legal acts in order to avoid ambiguities which lead to disruption of the system as a whole. The basic method used in this article is legal dogmatics and critical analysis of the scientific literature, documents and opinions of experts—practitioners.

The authors have analyzed the way of the origin and consolidation of the public procurement procedure in the Ukrainian national law from 1993 till the present day. That allowed us to determine the main conditions of public procurement, which have not changed during the whole period of existence of the independent legal system of Ukraine, and to critically evaluate them. Namely, the basis for payment is a report on the results of public procurement during the procurement of goods, works or services, and the cost of procurement should have been equal to or have exceeded the amount of UAH 200,000. The main scientific works focused on the consideration of public procurement issues in various branches of Ukrainian law have been summarized. The concept of the contract for procurement has been generalized and its features have been listed: the contract for procurement is an agreement between the customer and the participant (most of the parties), aimed at establishing, transferring or terminating property rights and obligations, which is concluded as a result of the procurement procedure and which provides the acquisition of freehold interest in the property, provision of services or performance of works. The main conceptual contradictions between the contract for procurement, the civil contract and the commercial agreement have been established and characterized. Based on the analysis of tender, civil and commercial legislation, the authors have carried out a critical analysis of the contract for procurement in terms of understanding and essential terms of the general civil contract, namely: violation of the concept of free agreement between the parties, non-compliance with equality of the rights, unreasonable narrowing of the contract for procurement up to the provision of services, performance of works or acquisition of ownership for goods, which contradicts the draft contract included in the tender documentation, the impossibility of reducing the contract price in the direction of reduction as agreed by the parties, the lack of electronic form of the contract for procurement provided by the tender legislation.

Public procurement concentrates large public sector’s purchasing power, and has a significant impact on each country’s economic development. The purpose of public procurement procedure is transparency, non-discrimination and accordance to the principles of fair competition in acquisition of goods, services and works necessary for the smooth functioning of the public administration. Besides, public procurement can be one of the most important instruments for sustainable development and other purposes useful to the whole society and the economy of the country. This article briefly discusses the concept of sustainable public procurement, reveals its main ideas and applications. One of them, the social sphere, was chosen the main object of the research. The possibility to decrease unemployment, to increase an integration of socially vulnerable group, and to achieve other socially-oriented goals through an effective implementation of the social aspect of sustainable public procurement has been illustrated. Thus, the article analyses the concept of social procurement, assesses the current situation in Lithuania, overviews the good practice of other countries and provides recommendations for measures to extend the application of socially oriented procurement.

A proper estimation of the value of the public contracts is of major importance of the contracting authority. First, value of contracts govers the regime of rules under which the proceedings will be conducted. Second the decision of the contracting authority concerning the application of specific procurement procedure depends whether the value of contract is below or above specific threshold. For multi year contracts or contracts with renewal option, the contracting Authority must provide clauses for the revision of prices in accordance with published official inflation. In case of goods the contracts through renting or leasing of these, the estimated value of the public contract shall be based on the monthly rent or fee multiplied by the number of months the contract will last. The contracting Authority is responsible for comparing the above mentioned elements with a cost analyses of the goods, services or works. European Union rules provided in Article 9 of the directive 2004/18/EC of the European Parliament and of the council of 31 March 2004 on the coordination of procedures for the award of public works, supply and services and in contain also more detailed rules concerning methods of estimation of contract value which should be applied in specific case. The priciple of the transparency of public procurement requires that all potential contractors have the same chances to compete for contracts being offeres by public administration. Social aspects of dementia are becoming increasingly important as part of a wider shift in emphasis from cure to care. This is partly because approaches based on finding a cure have proved far more difficult and complex than originally imagined (WHO, 2016). New evidence on the effectiveness of public health measures, that while incidence is growing as the proportion of older people in society increases its prevalence amongst older adults is actually falling, has also lead to increased interest in social dimensions of prevention, lifestyle change, and practical intervention in community settings (Prince et al., 2016; Kivipelto et al., 2017). This, in turn, has led to a rediscovery of the role of supports to people living with dementia in their daily lives, the needs of informal carers, and professional activities that can maintain the social engagement of each party (Winblad et al., 2016). The expansion of practice around person-centered care, beyond traditional institutional settings, has also contributed to a socialized view of how interactions in dementia care are thought about (Bartlett et al., 2017), as has an increased awareness of the effects of the social construction of dementia in the public mind (Biggs, 2018). Most recently, people living with dementia, and particularly with respect to younger onset dementia, have begun to find a voice and to make connections to the wider disability movement (Dementia Alliance International, 2017). Each of these developments, in their different ways, have led to a re-emphasis on psycho-social elements of dementia, its experience, and how that might translate into clinical practice and service delivery.

RESUMEN: En este trabajo se da cuenta de cómo ha quedado regulado el procedimiento restringido en la reciente Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, «por la que se transponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014». En general, mantiene la sistemática de su antecesor (Real Decreto Legislativo 3/2011, de 14 de noviembre, «por el que se aprueba el texto refundido de la Ley de Contratos del Sector Público»), pero también aporta algunas novedades que convendrá ir conociendo, como la exigencia de que los contratos de concesión de servicios especiales listados en el Anexo IV (servicios de carácter social, sanitario, educativo, investigación, seguridad y un largo etcétera) se adjudiquen siempre mediante el procedimiento restringido. Además la Ley considera especialmente adecuado este procedimiento cuando se trata de servicios intelectuales de especial complejidad, como algunos servicios de consultoría, arquitectura o ingeniería, por lo que, si bien no lo impone, recomienda el procedimiento restringido para ciertos contratos. Otra nueva previsión de la Ley para el procedimiento restringido es que, en contratos de servicios cuya presentación implique la realización de determinados desarrollos, los pliegos de cláusulas administrativas particulares puedan contemplar primas o compensaciones por los gastos en que incurran los licitadores al presentar su oferta. ABSTRACT: This work gives account of how restricted procedure has been regulated by the recent Act 9/2017 of November 8th of Public procurement contracts «that transposes European Parliament and Council Directives 2014/23/UE and 2014/24/UE of February 26th of 2014 to the Spanish legal system». In general, the previous system has remained (Legislative Royal-Decree 3/2011 of November 14th «approving the revised text of the Act of Public procurement contracts») but it also has some novelties that we should know, for example the requirement that special service concession contracts listed in Annex IV (services of social, health, education, research or security nature and so on) were always to be awarded through the restricted procedure. Besides, the Act considers this procedure particularly suitable when it is about intellectual services with particular complexity, as for example some consulting, architecture and engineering services so even if it is not compulsory, the restricted procedure is recommended. Another new provision of this Act concerning the restricted procedure is that in service contracts where their submission implies some specific developments, the administrative clauses can grant premiums and compensations due to the expenses the bidders incur when they submit their tenders.

Social Impact Bond (SIBs) attracts massive attention recently not only by major enterprises, but by SMEs in Japan to solve the social problems. This paper analyzes the first SIBs case on youth employment support in Amagasaki, Japan as well as the first SIBs case in Augsburg, Germany. Further, it considers the entry of SMEs that are familiar with local fields and circumstances to realize public-private partnerships and examine the possibility of their participating into the SIBs in Japan. SIBs invite the process improvement of the public procurement. Across SIBs, participation of SMEs in solving social problems conforms to the growth strategy of the Japanese government, and as a result to contribute the process improvement of public procurement.
