This article examines the evolving relations between Israel and the indigenous Bedouin Arab population of the southern Beer-Sheba region. It begins with a discussion of theoretical aspects, highlighting a structural conflict embedded in the ‘ethnocratic’ nature of nation-building typical of ‘pure’ settler states, such as Israel. The place of the Bedouin Arab community is then analyzed, focusing on the impact of one of Israel's central policies—the Judaization of territory. The study traces the various legal, planning and economic strategies of Judaizing contested lands in the study area. These have included the nationalization of Arab land, the pervasive establishment of Jewish settlements, the forced urbanization of the Bedouin Arabs, and the denial of basic services to Bedouins who refuse to urbanize. However, the analysis also finds a growing awareness among indigenous Arabs of their being discriminated against on ethnic grounds, and the emergence of effective resistance. In recent years, this has resulted in a deadlock between state authorities and the indigenous peoples. The case of the Bedouin Arabs demonstrates that the ethnocentric settler state is weakening and fragmenting, partially at least, due to its own expansionist land, planning and development policies.

The purpose of the article is to research the history of creation and formation of the Chancellery of Contract Affairs – the first supervisory and regulatory body in the field of public procurement in Russia. The early history of the Contracting Chancellery (1715–1717) can be traced in the context of the development of legislative and administrative regulation of public procurement during the reign of Peter the Great. The institution of public procurement itself, according to the author, is associated with the acquisition of distinct features of the modern state by Russia, which was manifested in the previous time. The immediate impetus for the development of the institution was the reform of the armed forces and the resulting mobilization efforts of the supreme power. The very content of the research predetermined the use of source-based and historical-legal methods. As a result of the study, the author states that the creation of a special body – the Chancellery of Contract Affairs, designed to take control of the situation under state contracts, turned out to be the right decision. The well-coordinated work of the Contracting Chancellery with the Senate, fiscal authorities and investigative bodies led to the creation of a number of important regulatory legal acts, almost ‘from scratch’ forming the legislative basis for the institution of public procurement functioning. The need for further work on the designated topic is noted.

Élément chef de la Politique énergétique nationale (PEN) énoncée par le Gouvernement fédéral en octobre 1980, l'extension du réseau de transmission de gaz naturel depuis Montréal jusqu'aux provinces Maritimes, par la Société Gazoduc Trans Québec & Maritimes Inc. (TQ & M) se veut le second lien d'acier depuis la construction des réseaux ferroviaires nationaux du siècle dernier. La réalisation de ce projet, en sus de ses dimensions politiques et économiques, génère de nombreuses tensions en matière d'aménagement du territoire que le régime juridique applicable se doit de cerner et de résoudre. Le présent article s'attache donc à analyser la problématique juridique dans laquelle s'inscrit la réalisation d'un projet d'une telle envergure au Québec. En premier lieu, les caractéristiques et l'évolution historique dudit projet sont présentées. Par la suite, nous discutons brièvement des principes de droit constitutionnel qui sous-tendent l'intervention des gouvernements fédéral et provincial. Puis, nous étudions en détail l'approche suivie par les intervenants relativement au choix du tracé du gazoduc (aménagement du territoire, protection des terres agricoles et environnement) pour compléter, enfin, par un aperçu des mécanismes d'appropriation du sol requis pour la construction proprement dite de cet ouvrage.
