AbstractThis article analyses the complicated and conflicted critical response to Andrew Lloyd Webber’sThe Phantom of the Operawithin the political, economic and cultural context of the Thatcher/Reagan era. British critics writing for Conservative-leaning broadsheets and tabloids took nationalist pride in Lloyd Webber’s commercial success, while others on both sides of the Atlantic claimed thatPhantomwas tasteless and crassly commercial, a musical manifestation of a new Gilded Age. Broader issues regarding the relationship between the government and ‘elite’ culture also affected the critical response. For some,Phantomforged a path for a new kind of populist opera that could survive and thrive without government subsidy, while less sympathetic critics heardPhantom’s ‘puerile’ operatics as sophomoric jibes against an art form they esteemed.

AbstractSchool prayer represents a curiosity of Reagan era politics. Reagan and the social conservative movement secured numerous successes in accommodating religious practice and faith in the public sphere. Yet, when it came to restoring voluntary school prayer, conservatives never succeeded in securing the judicial victory that they sought despite conditions that seemingly favored change. Herein, we attempt to reconcile Reagan era successes with Reagan era failures by exploring Reagan's entrepreneurial activity to affect both the demand (i.e., judges) and supply (i.e., litigants) side of legal change. Identifying Reagan's entrepreneurial activities in his attempt to alter national social policy reveals the resilience of legal institutions to presidential and partisan regimes. Reagan's efforts to change national school prayer policy gained some measure of legislative success by securing the Equal Access Act but it failed to garner a change in school prayer jurisprudence. We conclude by noting that the difficulty of influencing both the demand and supply side of legal change in a timely manner and its implication for reconstructing policy through the courts.

The article traces how American conservatives laid claim to the memory of Martin Luther King, Jr. We focus on a key moment in that process, when Republicans in the early 1980s battled other Republicans to establish King’s birthday as a federal holiday and thereby distinguish a conservative position on racial inequality from that associated with southern opposition to civil rights. The victory was consequential, aiding the New Right’s efforts to roll back gains on affirmative action and other race-conscious policies. We use the case to explore the conditions in which political actors are able to lay claim to venerated historical figures who actually had very different beliefs and commitments. The prior popularization of the figure makes it politically advantageous to identify with his or her legacy but also makes it possible to do so credibly. As they are popularized, the figure’s beliefs are made general, abstract, and often vague in a way that lends them to appropriation by those on the other side of partisan lines. Such appropriation is further aided by access to a communicative infrastructure of foundations, think tanks, and media outlets that allows political actors to secure an audience for their reinterpretation of the past.
