The subject matter with which we have here to deal may be distributed under the following headings :— (1) Determination of the nature of the action which is exerted upon the Staphylococcus pyogenes by normal human blood fluids, and by the blood fluids of patients who have been inoculated with a staphylococcus vaccine. (2) Comparison of the phagocytic power of the subjects of staphyloeoccus invasion with the phagocytic power of normal individuals. (3) Distribution in the infected organism of the opsonins which here come into consideration. (4) Determination of the question as to whether the opsonins are present in the blood of the infant at birth. (5) Determination of the course of the reaction of immunisation which supervenes upon the inoculation of a staphylococcus vaccine.

AbstractThe subject matter of this paper is assessment of the suitability of a dynamic cone penetrometer for determination of the state of soil. The principle of operation of the dynamic cone penetrometer, similar to commonly used DPL penetrometers, is described in the paper. Next the results of investigation conducted in Poland using a new dynamic cone penetrometer are presented. A series of measurements were performed in real field conditions. An attempt was made to correlate the results obtained with the dynamic and static cone penetrometers (CPT) respectively. These correlations were then subjected to validation to obtain a preliminary evaluation of the suitability of the dynamic cone penetrometer for determining the state of soil.

Rule 138 UPCARoP sets out the required contents of the Defence to the Application for the determination of damages. The provision contains formal requirements (lits a–c) which enable the service and allocation of the action. These requirements are meant to ensure service on the parties and allocation to the corresponding application. This information must be included in the written pleading and correspond to the requirements for the Statement of defence in the infringement action as set out in Rule 24(a)–(c). Lits d–f govern the requirements for the substantive content of the Defence to the Application. This enables the unsuccessful party to take control of the subject matter it introduces to the proceedings.

The title for this paper poses a deceptively simple question, and it is this: How do we utilise an earlier obtained judgment from country X to prevent abusive re-litigation in country Y? To this question the answer might appear obvious: one reaches for the doctrine of res judicata, that arcane yet fundamental body of law which provides that an earlier judgment is conclusive in a second suit involving the same subject-matter and same legal bases. However, while the doctrine of res judicata is well understood in the domestic setting, it is not entirely obvious how the doctrine applies to foreign judgments to prevent abusive re-litigation before the English courts. Nor is it obvious how the various judgment recognition regimes—in particular the regime established by the Brussels Regulation1—pre-ordain the preclusive effects to which a foreign judgment can give rise if relied upon to prevent abusive cross-border re-litigation.
