<p class="IIABSBARU">Conflict resolution on SARA requires pluralistic approaches. Hence, the presence of legal pluralism becomes a new approach to resolve the problem. This study is a qualitative research that convey three dimensions of legal pluralism, namely natural law, state law and society law. The study used secondary data, with primary and secondary legal materials obtained by documentation resources. Data were analyzed inductively, used the contemporary theories to produce more conceptual and general propositions for conclusions and recommendations. The result shows that there have been 8 cases on SARA conflict in Indonesia during the last three years. To solve these problems, religious leaders can use <em>natural law</em> approach to re-internalize religious values and tolerance. In addition, the government also should understand that those conflicts were a form of <em>society law</em> owing to discreditable law society and religious diversity. Therefore, non penal policy with persuasive appeals is needed to reduce the problems. However, penal policy through law enforcement should also be implemented as a form of <em>state positivism law</em>. In other words, <em>state positivism law</em> should go hand in hand with <em>natural law</em> and <em>society law</em> in order to reach the best decision based on moral and religious ethics as well as social values.</p><p class="IIABSBARU">***</p>Penyelesaian konflik SARA membutuhkan pendekatan-pendekatan yang plural. Oleh karena itu pluralisme hukum hadir sebagai pendekatan baru untuk menyelesaikan tersebut Penelitian ini adalah penelitian hukum dengan tradisi kualitatif yang berusaha mendialektikakan 3 dimensi dari <em>legal pluralism</em>, yaitu <em>natural law, state law</em> dan <em>law society</em>. Penelitian menggunakan data sekunder, dengan bahan hukum primer dan sekunder yang diperoleh dengan teknik dokumentasi. Data dianalisis secara induktif dengan menggunakan teori-teori yang ada untuk mem­produksi suatu proposisi yang umum, sehingga menghasilkan kesimpulan dan rekomendasi. Hasil penelitian menunjukkan bahwa telah terjadi 8 konflik SARA di Indonesia dalam 3 tahun terakhir. Untuk memecahkan masalah tersebut, para pemuka agama menggunakan pendekatan <em>natural law</em> untuk reinternaliasasi nilai-nilai keluhuran atas agama dan toleransi. Pemerintah seharusnya me­mahami bahwa konflik tersebut adalah bentuk <em>society law </em>karena tercederainya keragaman dan keberagamaan. Perlu kebijakan non penal dengan seruan-seruan persuasif agar persoalan serupa tidak lagi terjadi. Di sisi lain, kebijakan penal melalui penegakan hukum juga harus dilakukan, sebagai bentuk <em>state positivism law</em>. <em>State positivism</em> <em>law </em>harus mampu menggandeng <em>natural law </em>dan<em> law society</em>, agar diperoleh putusan terbaik yang berlandaskan nilai-nilai moral <em>ethic religion</em> dan nilai-nilai sosial kemasyarakatan.

Efforts to increase public awareness of the law are not only carried out on legal development but also on economic development, given the condition of Indonesia's economy leading to complex social problems. Referring to the above issue, the understanding towards the Indonesian people is necessary  to carry out economic development in accordance with the objectives of Indonesia's economic development to increase the welfare of the community. The article aimed to investigate the efforts to increase public legal awareness in supporting legal development and economic development in order to realize welfare. The method in this research was normative juridical by using descriptive qualitative analysis. In relation, secondary data were obtained from primary legal materials, secondary legal materials and tertiary legal materials. The results proved that increasing public legal awareness in legal and economic development should be conducted by the government and all parties involved. Hence the government and law enforcement officers can proceed through counseling, legal information, assistance and guidance so that people understand the importance of legal and economic development in order to realize order, certainty, justice and community welfare.

Law enforcement without direction and not based on the three pillars of the justice of law, legal certainty and the benefits to society can break the law anyway even violate human rights. As one of the policies of the government that are not considered mencerminakan the values of justice and disturbing for the people, the government policy that acts of omission or delay in the application of the death penalty. This research is a normative legal normative juridical approach. The data collected is secondary data were analyzed using qualitative methods juridical analysis. Based on these results it can be concluded that in the application of the death penalty there are serious legal issues, this is due to government policies that commit omission or delay in the execution of the death penalty is a violation of human rights as stipulated in Article 28 of the 1945 Constitution. The social reintegration of former combatants is the most important aspect of the disarmament, demobilization and reintegration (DDR) process. Post conflict societies are marked by their past traumas long after the interest of most outsiders has ebbed. Reintegration understood in this context, speaks to societal transformation, which both takes time and is prone to setbacks long after peace has formally been declared. The purpose of the study was to investigate the role of reintegration of former combatants on promotion of inclusion and equity. The objective of the study was to explain the role of the former combatants’ reintegration on promotion of inclusion and equity in Mt. Elgon region. The desistance theory was used in the study. The study used the cross sectional descriptive survey design. The population of the study comprised former combatants, Sub County Commissioners, peace committee members, religious leaders and NGOs. The respondents comprised former combatants, sub county commissioners and peace committee members, religious leaders and NGOs. The stratified and purposive random sampling technique was used to select a sample of 150 former combatants, Three Sub County commissioners and 16 peace committee members, five religious leaders and Four NGO members. Data was collected by use of questionnaires, interviews and Focus Group discussion. In order to ascertain validity, the questionnaires and interview schedules were given to experts who matched all the items with the research questions to ascertain whether the instruments would measure all that it is supposed to measure. The reliability of the instruments was determined through test retest of the instruments. Data was analyzed by use of descriptive statistics of frequencies and percentages. Data from in-depth interviews was audio taped and transcribed. The transcripts were then organized into themes and categories as they emerged from the field. The findings of the study were presented descriptively. The findings of the study showed that: in the context of social reintegration the three dimensions of family and community; sustainable employment; and civic responsibilities should be given proper attention: to achieve the goal of reintegration there should be a major shift in the contemporary DDR approach by moving from the insertion approach towards a social reintegration one; community support is essential for the successful reintegration of former combatants  and the sustainable social and economic reintegration of former combatants should be the ultimate objective of disarmament and demobilization and reintegration (DDR). Consequently, the study recommends that the government should budget for and give priority to the reintegration programmes so that they are fully completed instead of leaving them at the reinsertion stage; the communities take the lead in proposing community- based solutions for the issues identified.

AbstractThe trend of the spread of Coronavirus (Covid)-19 which continues to soar has an impact on society for health, peace and safety of the soul.  Public awareness and compliance with laws and regulations and the government's call for a Large-Scale Social Restrictions (PSBB) policy are important not to be violated or ignored.  The application of criminal sanctions for fines is an alternative sanction in law enforcement so that people are deterred, educated and as a means of government social control. The research method is normative juridical supported by empirical research using secondary data in the form of books, legislation and the internet. Type of qualitative research. Given the complexity of the problem of corruption, it must be treated seriously through a balance of rigorous and precise steps. This step is not only taken by the government and law enforcers, but also by involving the participation of indigenous peoples. In the indigenous Dayak Ngaju community, they are familiar with the principle of not having a bahadat. This principle means that the behavior of life that upholds honesty, equality, togetherness and tolerance and obeying the law (state law, customary law and natural law). According to the author, the existence of the principle of Belom Bahadat can be used as a preventive instrument for the prevention of corruption by government officials in Central Kalimantan Province. This means that there is a contribution of customary law norms to the government's efforts to prevent the occurrence of criminal acts of corruption through the initiation of the belom bahadat principle of Dayak Ngaju customary law.

The misuse of social media that causes defamation Decision: No 574 K / pid.sus / MA / 2018, is one of the many legal problems that have been ensnared due to the misuse of social media. The author uses three types of data sources, namely primary data sources of data obtained from laws and Supreme Court decisions. And secondary data data obtained from law books, law magazines and legal writings. And the last is tertiary legal material is complementary legal material obtained from dictionaries and the internet. and data analysis using qualitative data which is data in the form of words that talk about statutory regulations. The results of the research show that in the application of law enforcement of the ITE Law article 27 paragraph 1 in conjunction with article 45 paragraph 1 there is still a sense of injustice for the community, factors that must also be considered in imposing sanctions on victims of Baiq Nuril. and sociology of law and a strong conscience against actions or decisions in law enforcement. In this case, the government should have strict supervision of the use of information technology. This is aimed at preventing and overcoming efficiently and effectively the act of defamation through social media.

Corruption is the abuse of power for private gain that dangers various aspects in a country. Recently, corruption case that eroded the moral legitimacy of law enforcement officers had been revealed. The purpose of this article is to evaluate law enforcement against corruption by public officials in Indonesia as well as measures to overcome its problems effectively. The methodology used in this research is normative legal research which focused on secondary data approach. The injustice that includes weak sentencing regarding the bribery case of Pinangki Sirna Malasari had caught the public's attention for the lack of impactful sentencing. This injustice makes more potential corruptors who are ignorant of the law. Indonesia’s law enforcement agencies are considered to have high tolerance for corruption cases, and this principle of conditional justice has become common knowledge for the people. Corruption has the potential to destroy the nation’s morale, hinder economic development, and trigger anarchism. The government and society must synergize in instilling an anti-corruption mindset towards themselves and the younger generation. Surveillance towards government institutions must be strengthened with public participation. Intervention of president as the highest authority is needed when there’s injustice under his realm of authority. Formulation of a supporting legislation and establishment of anti-corruption institutions in every government or state agencies are needed. In order to create a government that is free of corruption, realization of anti-corruption law in Indonesia had to be done seriously. Korupsi adalah penyalahgunaan kekuasaan untuk kepentingan pribadi yang membahayakan berbagai aspek kehidupan. Belum lama ini, terkuak kasus korupsi yang mengikis legitimasi moral aparat penegak hukum. Karya tulis ini bertujuan untuk mengkaji bagaimana penegakan hukum terhadap tindak pidana korupsi oleh oknum pejabat publik di Indonesia, serta langkah-langkah pemberantasan korupsi secara efektif. Metode penelitian yang digunakan dalam penyusunan artikel ini adalah metode penelitian hukum normatif yang berfokus pengumpulan data sekunder. Ketidakadilan tuntutan hukum akan kasus penyuapan Pinangki Sirna Malasari menyita perhatian publik karena tuntutan pidana yang kurang memadai terlepas dari pelanggaran kode etik yang dilakukan sebagai aparat penegak hukum negara.. Jika ketidakadilan ini terus terjadi, akan muncul banyak koruptor potensial bebal hukum yang menjadi awal bagi kehancuran negara. Apabila implementasi penegakan hukum tidak maksimal, maka nilai dari hukum tersebut akan berkurang. Lembaga penegakan hukum di Indonesia dinilai memiliki toleransi yang tinggi terhadap kasus korupsi, dan prinsip keadilan bersyarat ini sudah menjadi pengetahuan umum bagi rakyat. Korupsi dapat menghancurkan moral bangsa, menghambat pembangunan ekonomi, serta memicu anarkisme. Pemerintah dan masyarakat harus bersinergi dalam menanamkan pola pikir anti korupsi terhadap diri sendiri dan para generasi muda. Transparansi dan pengawasan terhadap lembaga-lembaga pemerintahan harus diperkuat dengan adanya partisipasi masyarakat. Presiden sebagai pemegang kekuasaan tertinggi wajib turun tangan ketika terdapat ketidakadilan yang terjadi di bawah rumpunnya. Dibutuhkan perumusan legislasi yang mendukung dan pembuatan lembaga pemberantas korupsi di setiap badan penyelenggara negara. Demi mengusahakan suatu pemerintahan yang bersih dari korupsi, penegakan hukum atas tindak pidana korupsi di Indonesia harus direalisasikan dengan sungguh-sungguh.

Abstract The government initiated the birth of the Law on Information and electronic transactions in an effort to prevent the occurrence of ciber crimes. The percentage of cyber crimes in Indonesia is 32%. This figure is certainly not a small number and certainly can have a serious impact on the protection and welfare of the Indonesian people This research emphasizes first, how the cyber crime policy in Indonesia in mitigating the second, how cyber prevention efforts in the future. The research method in this research is normative juridical using primary and secondary data analyzed qualitatively. First, law enforcement in dealing with cyber crimes in Indonesia has not been optimally implemented. Factors that influence law enforcement against cyber crimes include legal factors, law enforcement factors, facilities and facilities in law enforcement and community factors Second, prevention of cyber crimes in the future can be done by increasing facilities, knowledge and specialization and training of law enforcement officers in the cyber field as well as efforts to secure information systems through collaboration with Internet Service Providers (ISP).Keywords:  Policy, Criminal Act,  Cyber

AbstractThe border area is one of the national strategic areas, the development of border areas is often faced with various security, defense, economic, social and cultural issues. The vulnerability of violations occurring in the Indonesia-Malaysia border region can cause many problems that arise from illegal border crossers, Smuggling of Goods, Illegal Workers, Terrorism. In this essay investigate the extent of government efforts in reducing border violations in Indonesia-Malaysia border region especially in Nunukan district. This research was conducted by Nunukan Regency in several agencies that handle border issues, Nunukan District Government Office, District Command 0911 of Nunukan, Ministry of Immigration Nunukan District, Navy Command Nunukan District This research was conducted by data collection method (field research), to obtain primary data through interview with the competent party in this research, and by method of literature research, to obtain secondary data through binding legal materials. Post-border crossings in Sei Pancang have a significant impact on border residents who want to pass. This can lead to a large number of illegal borderline subscribers. Penelitian ini dilakukan Kabupaten Nunukan di beberapa instansi yang menangani masalah perbatasan, Kantor Pemerintahan Daerah Kabupaten Nunukan, Komando Distrik 0911 Kab. Nunukan, Kementerian Keimigrasian Kab. Nunukan, Komando Angkatan Laut Kab. Nunukan. Penelitian ini dilakukan dengan metode pengumpulan data (field research), untuk memperoleh data primer melalui wawancara dengan pihak yang kompeten dalam penelitian ini, dan dengan metode studi literatur (literature research), untuk memperoleh data sekunder melalui bahan-bahan hukum yang mengikat. Pasca pentupan pos lintas batas di Sei Pancang berdampak signifikan terhadap warga perbatasan yang ingin melintas. Hal ini dapat memunculkan banyaknya pelangggar batas illegal. A participatory society can play an essential role in the prosecution of corruption cases. By providing information on alleged corruption, a participatory community can assist anti-corruption institutions so that corruption as an extraordinary crime can be eradicated as a means of enforcing people's constitutional rights. The authors attempt to perceive things by defending constitutional rights from a societal standpoint, a right of citizens who have had their rights violated by acts of corruption. The method used in this research is a normative legal method that refers to the norms in the laws and regulations, court decisions, and social society.  The data used is secondary data obtained from various sources with appropriate and relevant topics so that it becomes chaotic in discussing related problems. The community's active role in uncovering corruption cases is part of the obligation to break the chain of corruption and fulfil citizens' rights to enforce the law. The amount of budget allocated for disclosing corruption cases is leading the government to protect citizens' constitutional rights from the threat of corruption. Although the handling is still considered unsuccessful because many cases have not been revealed, the efforts made deserve to be recognised.
