Election Law Originalism: The Supreme Court's Elitist Theory of Democracy

The darkness that Europe lived in the shadow of the Church obscured the light that was radiating in other parts, and even put forward the idea of democracy by birth, especially that it emerged from the tent of Greek civilization did not mature in later centuries, especially after the clergy and ideological orientation for Protestants and Catholics at the crossroads Political life, but when the Renaissance emerged and the intellectual movement began to interact both at the level of science and politics, the Europeans in democracy found refuge to get rid of the tyranny of the church, and the fruits of the application of democracy began to appear on the surface of most Western societies, which were at the forefront to be doubtful forms of governece. Democracy, both in theory and in practice, did not always reflect Western political realities, and even since the Greek proposition, it has not lived up to the idealism that was expected to ensure continuity. Even if there is a perception of the success of the democratic process in Western societies, but it was repulsed unable to apply in Islamic societies, because of the social contradiction added to the nature of the ruling regimes, and it is neither scientific nor realistic to convey perceptions or applications that do not conflict only with our civilized reality The political realization created by certain historical circumstances, and then disguises the different reality that produced them for the purpose of resonance in the ideal application.

Outside of some states still struggling with post-communist transitions, Europe itself may be the first European democracy to collapse in decades. Though never a bastion of participatory democracy and even subject to continuous criticism due to its democratic deficit, the European Union (EU) has provided hope to those who envision a post-national democratic political community. As such, whether the EU survives its present crisis or not, cosmopolitan democrats will look to the EU as a vindication of their ideals. Though perhaps surprising given their track record, this paper will argue that political scientists, especially those concerned with democratization, can also be optimistic about what the EU has brought to the table in terms of how we conceive processes of democratic development. Throughout the paper it will be demonstrated that the creation and maintenance of the European democracy has challenged much of the literature's fundamental assumptions of what makes democracy work. Five key lessons from the European democratic experience will be presented in an attempt to disrupt some of these assumptions including lessons regarding the diversity of the demos, the contingency of democratic upkeep, the challenges of the state, the role of elites in political transformation, and the necessity of exclusion within inclusive spaces. Though a general theory of democracy will not be presented, suggestions will be made as to how we can incorporate some of these lessons into the dominant approaches to democracy found in the literature. The Ideal

In keeping with the radical openness of his theory of democracy, Habermas avoided pre-determining the ideal mode of economic organization for his favoured model of deliberative democracy. Instead of attempting a full-blown derivation, in this article, I propose adapting the Rawlsian method of comparing different political–economic regimes as candidate applications of his theory of justice to Habermas’s theory of deliberative democracy. Although both theorists are seen as endorsing liberal democratic world views, from the perspective of political economy, the corollary of their conceptions of democracy would arguably veer elsewhere: in Rawls’s case, into the territory of property-owning democracy or democratic socialism, and in Habermas’s, into any political–economic regime which guarantees the real exercise of full political and discursive liberties against the background of legitimate lawmaking. The ultimate aim of this article is to discuss whether a concrete conception of democratic socialism, if any, is compatible with Habermas’s theory of deliberative democracy.

This article explains how the issue of inclusion is central to Habermas’s theory of democracy and how it is deeply rooted in his conception of a political public sphere. After recalling Habermas’s views on the public sphere, I present and discuss various objections raised by other critical theorists: Oskar Negt and Alexander Kluge, Nancy Fraser, Axel Honneth and Iris Marion Young. These criticisms insist on the paradoxically excluding effects of a conception of democracy that promotes civic participation in the public debate. Negt, Kluge and Fraser develop a Marxist line of analysis that question who can participate in the public sphere. Honneth and Young criticize in various ways the excluding effect of argumentation: are unargumentative speeches excluded from the public debate? I show how Habermas’s model can provide some responses to these various objections by drawing inspiration from his treatment of the gap between religious and post-metaphysical world views.
