Energy communities (EC) are expected to have a pivotal role to reach European decarbonization targets. One of the key aspects is the regulatory framework adopted by each Member State to properly manage such new customers’ aggregation. The paper firstly provides an updated overview of the EC regulation, focusing on the current Italian legislation. Next, a novel methodology for the design and management of energy community initiatives is proposed. The procedure firstly solves a design and operation optimization problem to calculate the best size of energy assets (boiler, heat pump, photovoltaic, thermal storage) to be installed. Second, a Shapley value-based approach is exploited to distribute a part of the community’s incomes to members, based on their contribution to the overall welfare. Results demonstrate that the adopted methodology is effective in ensuring a proper cash flow for the community, while pushing its members towards energy efficient behaviors.

The rise of renewable energy sources (RES) comes with a shift in attention from government and market energy governance to local community initiatives and self-regulation. Although this shift is generally welcome at domestic and EU level, the regulatory dimension, at both levels, is nevertheless not adapted to this multi-actor market since prosumers are not empowered and energy justice is far from achieved. The rise, in the UK, of Community Interest Companies (consumers and local actors’ collectives) in the energy sector provides an interesting perspective as it allows a whole system’s view. Research was conducted with six energy community organizations in the South West of England in order to evaluate their role and identity and assess whether this exemplar of “the rise of a social sphere in regulation” could be used as a model for a more sustainable social approach to the governance of economic relations. Findings illustrate that such organizations undoubtedly play an important role in the renewable energy sector and they also help to alleviate some aspects of “energy injustice”. Yet, the failure to recognize, in terms of energy policy, at domestic and EU level, the importance of such actors undermines their role. The need to embed and support such organizations in policy is necessary if one is to succeed to put justice at the core of the changing energy landscape.

Renewable energy has been suggested as the primary approach for decarbonizing the energy system and decoupling energy consumption from greenhouse gas emissions, both in the energy literature and in practice. The European Union has acknowledged the challenge and put renewable energy transition high on the policy agenda with the latest ambition of being a carbon-neutral economy by 2050. On the other hand, Western Balkan countries are still dependent on fossil fuels as one of their primary energy mix sources. The pledge about the European future has mostly driven the renewable energy transition ambition in the Western Balkan countries, including Serbia. Moreover, signing the Energy Community Treaty provided institutional and legal tools to both Contracting Parties and the European Union to build the common energy market. These processes inspired many authors in the last two decades to analyse technical, economic, market and environmental aspects of renewables. However, the governance and planning, even though identified as challenging, have been side-lined from the analysis. This paper aims to overview the selected renewable energy transition literature and legislation to analyse the main legal and policy milestones reached so far, as well as ambition in Serbia. It also discusses the lessons learned from the related literature from energy governance and planning prism. To do so, it firstly provides a literature review of the main concepts of the renewable energy transition. Moreover, the historical analysis of renewable energy policy and legal developments in the European Union, the Energy Community and Serbia are in the second part's focus. Finally, the discussion part summarizes lessons learned from the literature for future energy governance and planning with the perspective of the energy planning process, policy evaluation, and education and administrative capacity. The article concludes by emphasizing the importance of taking the current literature findings as prospective steps to follow towards accelerated energy governance and planning.

Can non-EU member states influence the EU’s energy policy? The Europeanization of energy policy in third countries is often described as a one-directional process in which these countries essentially adopt the EU <em>energy acquis</em>. Our article questions this dominant view by exploring whether and how third countries can influence the formulation and implementation of EU energy policy. We argue that relative differences in third country influence depend on their access to relevant venues and actors of EU policy-making as well as their structural power resources. We develop a typology linking these two factors to the outsider, follower, challenger, or shaper roles that third countries assume in EU energy governance. We empirically probe our argument in three case studies representing different models of EU–third country cooperation. Our cases include a group of nine Southeast and East European countries (Energy Community), Switzerland (bilateral arrangements), and Norway (European Economic Area). The analysis shows that it is access and structural power which together define the extent to which third countries are able to influence the formulation of EU energy policy and customize its implementation to their domestic needs. We find that while the Energy Community members are followers in EU energy governance, Switzerland and Norway are shapers. Strikingly, the influence of these two non-EU members may occasionally even surpass that of smaller EU member states. This highlights that third countries are not merely downloading EU energy regulation but sometimes also succeed in uploading their own preferences. Our contribution has implications for the post-Brexit EU–UK energy relations and qualifies claims about EU regulatory hegemony in the wider region.

In recent years, measures to stimulate local and rural communities’ involvement in the generation of renewable energy have been rather optimistically promoted as a means to engender greater legitimacy in and democratization of energy governance, tackle fuel poverty, and deliver energy justice. This chapter assesses what we really know about community energy and its suitability to deliver an equitable energy transition. It scrutinizes evidence from selected EU Member States that have pioneered the mainstreaming of community energy through the lens of justice theories, with the objective to gauge whether and how these policies address core justice questions associated with the energy transition, and the role of law in providing an answer to these. This chapter aims to probe the sometimes uncritical assumptions about community energy, highlighting the complex, layered, conflicting justice claims that underlie its mainstreaming. In order to do this, the chapter distils a set of distributive, procedural, and restorative justice questions associated with community energy, and considers the way in which they have been addressed, drawing on examples from Denmark, Germany, and the UK.
