A year ago, apprehensive about writing this address, I spoke with former president Joe Broder. He advised me to pick something I cared about deeply. That advice, although well meant, left me rather stymied. I care about teaching, but Joe Broder's own presidential address had handled that topic better than I thought I could. So I floundered for a while, without gaining a focus. Then came August and the signing into law of the new welfare bill. A few months earlier, farm programs had also been vastly modified. My topic finally came together. The combination of the 1996 Farm Bill and the new welfare legislation clearly signaled major changes for the rural South, and I wondered what these changes would entail.

O artigo analisa a eficiência das decisões proferidas no âmbito do OSC a partir do US Farm Bill de 2014 e do DS522 (2016), normativas que tratam de novos subsídios fornecidos respectivamente pelos Estados Unidos da América ao setor do algodão e pelo Canadá à indústria aeronáutica com potencial de produção de efeitos sobre os países concorrentes, como aqueles decorrentes do DS267 e DS46, DS70 e DS222. Em que pese à existência de decisões já proferidas no âmbito do OSC em relação a esses dois países, foram adotados, no curto prazo, mecanismos para fornecer novos subsídios, em desrespeito aos acordos internacionais que questionam, via de consequência, a autoridade do OSC e da própria OMC. Para a elaboração deste estudo, foi utilizado o método hipotético-dedutivo e o ferramental da Análise Econômica do Direito, especialmente o conceito de eficiência. Inicia-se com a apresentação do conceito de eficiência, seguido de uma abordagem sobre o OSC, em especial, sobre o procedimento de tomada e implementação das decisões. Na sequência, foram analisados os DS267 e DS46, DS70 e DS222 para fundar as bases necessárias para introduzir o US Farm Bill de 2014 e o DS522 (2016) e, consequentemente, questionar a eficiência das decisões proferidas no âmbito do OSC.

While most farmers take steps to enhance natural resources, times of low prices and high costs may create difficulties for farmers who wish to spend resources on agriculture conservation. Consequently, farming can have a harmful effect on natural resources. Because many farmers rely on income support payments, and most income programs do not require farmers to utilize environmental conservation practices, environmental degradation continues. To ensure adequate protection of water quality, soil quality and wildlife habitat, and to provide income support for farms of all sizes, politically feasible legislation is needed to link income payments with conservation practices. This article follows the outline of atraditional policy analysis to examine four policy options for the farm bill the Conservation Security Program (CSP), Flex Fallow, the Conservation Reserve Program, and conservation easements. The options range from conservative to liberal, with differing environmental and income impacts. Policy options for achieving these goals were judged using the following criteria: effectiveness in achieving conservation goals,' effectiveness in supporting farmer income,' political feasibility,' and strength of the linkage between conservation practices and income payments. Based on this analysis, CSP is the best option for the farm bill, because it is a compromise approach to achieving the goals of this analysis. This evaluation is presented as a policy analysis in order to provide a systematic technique for identifying solutions to current farm policy problems. The elements of a policy analysis traditionally include formulating a problem, identifying policy alternatives, forecasting the future, modeling the impacts of alternatives, and comparing and ranking the policy alternatives.
