Variety protection: An incentive for agricultural research

Abstract Addressing the multiple challenges facing global agriculture requires integrated innovation in areas such as seeds, biotechnology, crop protection, grain storage and transport. Innovations related to plant improvement and the development of new or improved plant varieties will only happen at an optimal level if plant breeders’ rights (PBR) are properly protected. The objective was to analyse the evolving landscape of wheat plant breeders’ rights to address the dearth of empirical evidence of the patterns and trends of wheat varietal improvements in South Africa. We compiled a detailed and novel count and attribute database of wheat varietal innovations in South Africa from 1979 to 2013 using various sources. This data set was then analysed to ascertain the main trends in, and ownership of PBRs for wheat varietal improvements in South Africa over this period. A total of 134 PBR wheat varietal innovations were lodged from 1979 to 2013, an average of 6 applications per year. The administrative delays in granting PBR applications were substantially reduced by 77 days during the post-deregulation period (after 1996), indicating increased efficiency. The main PBR applicants were Sensako (39%), the Agricultural Research Council Small Grains Institute (ARC-SGI) (25%) and Pannar (15%). The ARC-SGI contributed to some of the PBRs owned by private companies through shared genetic resources before Plant Variety Protection (PVP) was implemented. Future innovations and dissemination of wheat innovations can be stimulated by plant variety protection, together with broader variety sector legislation that encourages both public and private sector investment.

The U.S. Department of Agriculture’s Agricultural Research Service (ARS) and universities have a long and successful history of developing enhanced germplasm and cultivars that are transferred through public release. Today, nonprotected public release may not be the most appropriate mechanism. Intellectual property (IP) protection as it pertains to the plant germplasm and cultivars is involved and complex. Unlike other scientific areas, in the United States there are three distinct mechanisms to protect plants—namely, utility patents, plant patents, and plant variety protection certificates. Each of these mechanisms offers different criteria for protection and covers different types of plants. This article is a practical tool to help research institutions and scientists decide when to consider releasing a germplasm or cultivar, which factors to consider, who should be involved, and whether IP protection is appropriate.

Preserving rare grapes is not just a matter of variety. Recent dna research has shown that unusual and unknown grape varieties provide clues to wine history. During the centuries, 525 Georgian grape varieties had been known but most of them were degenerated. Nowadays, more than 437 rare Georgian vine varieties are preserved in the geo 038 collection of Agricultural Research-Scientific Center, established in 2014 under the Environment Protection and agriculture ministry. Study of the genetic pool of Georgian grape varieties determine the sustainability of the sector and enrichment of the modern wine market. For this reason the studies of the rare aboriginal grape varieties have begun by their ampelography, phenology, chemical, and oeno-caprological characterizes. The aim of this study is to investigate rare, Georgian, aboriginal wine-grapes by their ampelography, chemical and oenolo-caprological characterizes, and to offer different style and aroma wines to the market, enriching the modern wine assortment. The present study investigated firstly the rare Georgian aboriginal grape variety (Chvitiluri) by its characterizes. In this study grapes caprologycal indication, dynamic development of the sugar accumulation, TA and pH in berries, polyphenols extract in skin and seeds, and phenolic compounds were determined. The grape has been compared with Georgian and French wine-grapes and their products as well. The results show that the grape variety - Chvitiluri, and vinification technique (aging on lee) have the significant impact on the total phenol content in wine. White varietal wine contents high alcohol 13,2%, total phenols 733-500mg/l. Wine has specific, varietal characterizes color, taste, aroma. This study indicates that the rare local, aboriginal variety presents the perspective sort for wine production and can be returned in wine production.

Currently, a real challenge for the workers in the agricultural research field is to stop or reduce the use of expensive agrochemicals/ chemical fertilizers which are hazardous to the environment as well as human health. Present study was aimed to improve the growth and obtain optimum yield of Vigna crop with eco-friendly, non-toxic way and to reduce the use of agrochemical/chemical fertilizer application in agricultural activities. A pot experiment was conducted to study the effect of chemical fertilizer (DAP) and biofertilizer ( Rhizobium strain) separately and in combination on seed germination and seedling growth (at 30 days) based on morphological parameters such as seedling length (cm), fresh weight (g), dry weight (g) and leaf area (cm)2 of Vigna radiata (L.) Wilczek. After one month (30 Days) observations, it was found that seedling length, fresh and dry weights and leaf area were maximum in T4 and minimum in T15, T7 and T8 favored improved seedling length and leaf area whereas T7, T8, and T9 favored improved fresh and dry weights as compared to control.

A field experiment on a greengram-wheat cropping sequence was carried out under limited water supply conditions in 1997-98 and 1998-99 at the farm of the Indian Agricultural Research Institute, New Delhi. The greengram was sown either on flat beds or on broad beds 2 m in width, divided by furrows, with 0, 30 and 60 kg P2O5/ha. After the harvest of greengram pods, wheat was grown in the same plots, either with the greengram stover removed or with the stover incorporated along with 0, 40, 80 and 120 kg N/ha applied to wheat. The grain yield of greengram was higher when sown on broad beds with furrows compared to flat bed sowing, and the application of 30 or 60 kg P2O5/ha resulted in significantly higher grain yields compared to no phosphorus application. The combination of broad bed and furrows with phosphorus fertilization was found to be ideal for achieving higher productivity in greengram. The land configuration treatments had no impact on the productivity of wheat. The application of phosphorus to the preceding crop had a significant residual effect on the grain yield of wheat. The incorporation of greengram stover also significantly increased the grain yield of wheat. The increasing levels of N increased the grain yield of wheat significantly up to 80 kg/ha. The combination of greengram stover incorporation and 80 kg N/ha applied to wheat significantly increased the grain yield. Further, there was a significant interaction effect between the phosphorus applied to the preceding crop and N levels given to wheat on the grain yield of wheat.

The Beyond Compliance Global team held an interview by video link with Dr Eric Jang, United States Department of Agriculture, Agricultural Research Service (USDA/ARS), now retired. His lab was based in Hawaii, where he continues to reside. Eric was an early advocate and one of the originators of the concepts for Systems Approach.
