This research highlights the outcomes of the environmental diplomacy workshop held between members of civil society from Afghanistan and Pakistan on water cooperation in the Kabul River Basin, one of the most heavily conflicted transboundary river basins in the world. Lack of trust among these upstream and downstream riparian partners and persistent failures of Track 1 diplomacy initiatives has led to an absence of governance mechanisms for mitigating the water security concerns in the region. This research shows that science and public diplomacy, democratic participation, and social learning may pave a way to clear local misconceptions, improve transboundary water cooperation, and increase ecological stewardship in the Kabul River Basin.

The Kabul River, while having its origin in Afghanistan, has a primary tributary, the Konar River, which originates in Pakistan and enters Afghanistan near Barikot-Arandu. The Kabul River then re-enters Pakistan near Laalpur, Afghanistan making it a true transboundary river. The catastrophic flood events due to major snowmelt events in the Hindu Kush mountains occur every other year, inundating many major urban centers. This study investigates the flood risk under 30 climate and dam management scenarios to assess opportunities for transboundary water management strategy in the Kabul River Basin (KRB). The Soil and Water Assessment Tool (SWAT) is a watershed-scale hydraulic modeling tool that was employed to forecast peak flows to characterize flood inundation areas using the river flood routing modelling tool Hydrologic Engineering Center - River Analysis System -HEC-RAS for the Nowshera region. This study shows how integrated transboundary water management in the KRB can play a vital catalyst role with significant socio-economic benefits for both nations. The study proposes a KRB-specific agreement, where flood risk management is a significant driver that can bring both countries to work together under the Equitable Water Resource Utilization Doctrine to save lives in both Afghanistan and Pakistan. The findings show that flood mitigation relying on collaborative efforts for both upstream and downstream riparian states is highly desirable.

Transboundary rivers are increasingly difficult to govern and often involve issues of national security, territoriality, and competition. In developing countries, the management and governance of these rivers is dominated by a particular decision making group, often comprised of politicians, bureaucrats, and engineers. These groups perpetrate a technocratic paradigm towards the management of transboundary water, with limited genuine international cooperation. The transboundary water situation in South and Southeast Asia is becoming increasingly fraught as the geopolitical context is changing due to China’s increased involvement in regional issues and climate change. With over 780 million people dependent on these rivers, their governance is vital to regional and international stability. Yet, the technocratic management of transboundary rivers persists and is likely to become increasingly unsustainable and inequitable. A discourse-based approach is applied to consider transboundary water governance in the shifting South and Southeast Asian context. The result is an alternative perspective of why governance approaches on transboundary rivers have resisted meaningful reform.

AbstractWater resources in the Middle East and North Africa (MENA region) face over-exploitation and over-pollution due to population growth, climate change and the lack of advanced water governance approaches. These challenges become more serious in transboundary river basins and may lead to conflict between riparian countries. The main objective of this paper is to assess water resources and needs at the Medjerda River Basin (MRB), shared by Tunisia and Algeria using the Water Evaluation and Planning (WEAP) system between 2020 and 2050. Four scenarios were built to assess the current and future status of the water supply and demands in both countries. The results show that water demands, and shortages are increasing, and some demand sites will face real water scarcity in the future due to climate change and development practices. Therefore, new allocation and management plans should be examined at the regional level based on real collaboration among all stakeholders.

AbstractThis article examines the international legitimacy of unilateral dam development in an international watercourse from the perspective of international water law. Drawing upon technical analysis over the Harirud River Basin, the article discusses probable negative impacts of unilateral dam development in Afghanistan on downstream Iran and Turkmenistan. Competing claims are analyzed to assess emerging transboundary damage under customary international water law. Applying these insights to the case study, this article explores how legal norms and principles can contribute to transboundary water cooperation. It investigates how equitable and reasonable utilization, as required by the United Nations Watercourse Convention, could be reached and whether current activities are in conformity with international norms. Based on this analysis and in the light of international customary law, the article questions the compatibility of unilateral control and capture of water resources in Afghanistan, particularly through the Salma Dam, with ‘equitable and reasonable utilization’ and ‘no significant harm’ rules. The article also argues that building the Salma Dam results in significant transboundary harm to downstream states. Hence, such harm could be considered as significant transboundary damage. Conclusions point to an understanding of water law as a form of institutional guidance in order to provide a transparent setting for transboundary water cooperation among riparian states.
