Resumen: La sentencia del Tribunal Superior de Justicia de Cataluña de 18 de marzo de 2019 resuelve sobre la validez de una donación entre esposos de un bien inmueble sito en Ingarö (Suecia). La sentencia se pronuncia sobre la aplicación al caso del Reglamento Roma I y del desplazamiento del art. 11CC como norma de conflicto aplicable a la validez formal de la donación, tampoco la considera ley de policía del foro.Palabras clave: requerimientos de forma, donaciones internacionales entre esposos, leyes de policía, Reglamento Roma I. art. 11CC. Abstract: The Judgment of the High Court of Cataluña of 18 March 2019 ruled on the formal validity of an international gift between spouses of a land situated in Ingarö (Sweden). Resumen: en el Asunto Vinyls Italia, el TJUE recuerda que la ley rectora del concurso no es base suficiente para revocar un contrato perjudicial para el conjunto de los acreedores, si la contratante prueba que la ley rectora de tal contrato no permite su impugnación. Entre los aciertos de la Sentencia, des­taca que esta excepción no debe amparar prácticas fraudulentas, además de que su tramitación procesal debe hacerse conforme a la lex fori. No obstante, la Sentencia presenta serias dudas al obviar que la de­terminación de la ley rectora del contrato, y su carácter internacional, deben hacerse por el Reglamento Roma I y no por el Reglamento europeo de insolvencia. También es dudosa la remisión a la lex fori para la posible aplicación de oficio de esta excepción; más bien debería jugar a instancia de parte de acuerdo con una interpretación literal y finalista del Reglamento europeo de insolvencia.Palabras clave: acciones concursales de reintegración, ley aplicable, ley rectora del concurso, ley rectora del contrato, tramitación procesalAbstract: in Vinyls Italy Case, the CJEU reminds that the law governing the insolvency proce­eding is not a sufficient basis to revoke a contract detrimental to all creditors, if the contracting party provides proof that the law governing that contract does not allow its revocation. One of the hits of the Judgment is that this defense should not cover fraudulent practices, as well as procedural aspects shall be governed by lex fori. However, the Judgment presents serious doubts when it obviates that the determi­nation of the law governing the contract, and its international consideration, shall be made by the Rome I Regulation and not by the European Insolvency Regulation. The reference to the lex fori is also doubtful in relation with the possible ex officio application of this defense; rather, that defense should play at the request of a party according to a literal and final interpretation of the European Insolvency Regulation.Keywords: reintegration actions, applicable law, law governing insolvency proceedings, law go­verning the contract, procedure

The role of art. 57 § 1 of Polish Family and Guardianship Code in proceedings concerning international divorce is disputed and gives rise to many questions concerning its nature. The provision, addressed to the Polish courts dealing with divorce cases, obliges the seized court to rule on fault of spouses in the breakdown of marriage. It may then seem to remain unclear if the court shall apply art. 57 § 1 when the law applicable to divorce does not state for fault based grounds for dissolution of marriage, while the legal order applicable to maintenance obligation between former spouses requires, among other prerequisites, that the fault of the former spouse obliged to alimony is declared in court proceedings. This paper analyses the judgement of Polish Supreme Court from 23rd of March 2016, in which this issue was raised. The Author rejects the opinion of Supreme Court that the provision in question has a procedural nature. The view, that it constitutes an example of overriding mandatory provision should also be denied. As a provision of double nature: material and procedural, it should be applied by Polish courts as an instrument that enables to rule on fault in all those cases when applicable law provides for fault grounds for divorce; it should be also applied by foreign court deciding on dissolution of marriage when Polish law is applicable.

This chapter examines the applicable law for contracts. Domestic contract law consists of two very different sorts of rules: the traditional rules and the more modern rules. The concept of mandatory rules only deals with the second class of rules. This chapter first considers the nature of the problem of ascertaining the applicable law with respect to contracts and a number of different solutions that have been tried in different countries to address it. It then discusses the history and purpose of the Rome Convention, as well as its relevant provisions and those of the Contracts (Applicable Law) Act 1990. It also analyses the Rome I Regulation, the circumstances under which it applies, and how it deals with special contracts. Finally, it looks at the Rome I Regulation's relationship with other provisions of EU law and international conventions.

Resumen: Este trabajo analiza la determinación de la ley aplicable a las donaciones en Derecho Internacional Privado. La coexistencia de las normas de conflicto contenidas en el Reglamento Roma I y el Reglamento de sucesiones aplicables a distintos aspectos de los actos de liberalidad hace necesario distinguir entre sus respectivos ámbitos de aplicación. A ello hay que añadir la ineludible aplicación de las normas de Derecho Internacional Privado nacional para la determinación de la ley aplicable a los aspectos relativos a los derechos reales.Palabras clave: donaciones, norma de conflicto, sucesiones, contratos.Abstract: The article deals with the determination of the applicable law to donations in Spanish Private International Law. The coexistence of conflict of law rules included in Rome I and successions European Regulations makes necessary to distinguish between different types of donations. Additionally, the article addresses the unavoidable application of the rules of national private international law for the determination of the law applicable to some aspects of the rights in rem.Keywords: donations, conflict of law, successions, contracts.

Abstract This article presents an analysis of contractual relations in sport from the standpoint of the Croatian legislative system. Due to the complexity of the subject matter, the author considers only a small fragment of it - the significance and the role of sport in Croatian society and the law of contracts „as a cornerstone on which „sports law“ has been built and which is of primary importance in most areas where there is an interface between sport and the law, irrespective of whether the sport is being played at an elite level or at a more humble one“. Bearing in mind the limited extent of this article, the autor tries to provide some clarifications and some guidance on how to deal with the designation and the determination of the applicable law for contracts in the sporting context. Considering that there are different legal regimes which may come into play with regard to the designation of the law applicable to contracts in the sporting context, the author first presents the determination of the applicable law according to the Rome I Regulation and then according to the Croatian Arbitration Act, Swiss Private International Law Act and the CAS Code of Sports-related Arbitration, as the most common in sports practice. Then, the author deals with contracts concluded with minor athletes and the determination of the law applicable to some preliminary questions. Finally, the author presents her perception of the problems encountered and some suggestions for the improvement of the existing legal framework.

This chapter analyses the practical application of the law of belligerent occupation in internationalized armed conflicts in its temporal, geographical, and personal dimensions. Firstly, from a temporal perspective, the law is shown to apply once one of the conflict parties consolidates its control over the enemy territory and substitutes its own authority for that of the displaced enemy. Secondly, the chapter assesses the geographical scope of the applicable law and draws specific guidelines for the determination of the territory subject to the law of occupation in various types of internationalized armed conflicts. Thirdly, the chapter endorses the allegiance-based approach to the designation of protected persons under the law of occupation and applies it to the reality of internationalized armed conflict. Overall, the chapter presents a workable toolkit for the application of the law of occupation to internationalized armed conflicts.

The general practitioners (GPs’) practice faced serious challenges as a result of COVID-19 pandemic, including from a legal point of view. In this context, a series of questions related to the GPs’ professional activities might arise such as: (i) what happens if a doctor makes a mistake because he/she is exhausted, as a result of overtime or (ii) if he/she performs medical acts outside the boundaries of his/her own specialty or without consent, as requested by his/her own conscience, by the situation, by the authorities and by his/her principal? In all these special circumstances this could mean that the doctor fails to comply with the applicable law. Moreover, because he/she breaches the law, the professional insurance policy will cease to be applicable. With new roles and responsibilities, the GPs should adjust their practice to the current conditions.
